SUBJECT: Approval of the Notice of Environmental Determination, the Siting
Element and Summary Plan.
CAO RECOMMENDATION
For waste management plan,
1) Adopt a resolution approving the Notice of Environmental Determination and 2) adopt a
resolution approving the Siting Element and Summary Plan.
DISCUSSION
Background
With the passage of California Assembly Bill 939 in 1989, all cities and counties are required
to prepare Integrated Waste Management plans which include the following documents:
• Source Reduction and Recycling Element
• Household Hazardous Waste Element
• Solid Waste Generation Study
• Non Disposal Facility Element
• Siting Element
• Summary Plan
The last two elements of the Integrated Waste Management Plan yet to be adopted by the City
are the Siting Element and Summary Plan. The San Luis Obispo County Integrated Waste
Management Authority (IWMA) has developed and approved these documents and a related
Negative Declaration, and has sent them to each jurisdiction for the required public hearing.
Approval by resolution is requested by the IWMA and required by law in accordance with
California Code of Regulation 18782..
Siting Element Description
The Siting Element is a planning document for the siting of new landfills in San Luis Obispo
County. This element defines goals and policies, quantifies remaining disposal capacity, and
identifies siting criteria and strategies for long -term disposal capacity. With approximately 32
years of disposal capacity remaining as of 1995, it was determined that identifying sites for new
disposal facilities is not necessary at this time. As capacity falls to below the 15 year
requirement, and if it is determined that expansion of existing facilities is not feasible at that
time, the appropriate jurisdiction(s) will plan for new disposal facilities and/or strategies as

outlined in the document. Upon local approval, the Siting Element will be incorporated into the
San Luis Obispo County Integrated Waste Management Plan and submitted to the California
Integrated Waste Management Board for final approval.
Summary Plan Description
The Summary Plan provides a synopsis of the required planning documents that were previously
approved by Council. These documents consist of the Source Reduction and Recycling Element,
Household Hazardous Waste Element, Non Disposal Facility Element, Solid Waste Generation
Study and the Siting Element. All of the documents together are considered the County
Integrated Waste Management Plan. The Summary Plan describes the programs, goals and
policies that guide existing as well as proposed solid waste collection and disposal systems
throughout the County.
Environmental Determination
The Integrated Waste Management Authority was the lead agency in drafting the Environmental
Impact Report (EIR) for the Siting Element and Summary Plan. The EIR determined that these
two documents will not result in significant adverse environmental effects as a result of the
suggested revisions made during the review process. In most cases, the effects were found to
be beneficial and positive with respect to maintaining existing landfill capacity and to siting new
facilities.
The Negative Declaration evaluates potential environmental impacts associated with draft
versions of the Siting Element and Summary Plan. The Preliminary Draft Siting Element and
Summary Plan have been reviewed by responsible agencies, technical advisory committee
members, landfill operators, and other interested parties. Comments received by the agencies
and interested parties have been incorporated into the two documents where .appropriate prior
to final approval. Comments have been also incorporated into the environmental determination.
Based on the above discussion, the potential impacts associated with the documents are not
considered significant. Therefore, a Negative Declaration is appropriate under the California
Environmental Quality Act.
FISCAL EMPACT
There is no fiscal impact associated with this action.

RESOLUTION No. (1996 Series)
APPROVING THE NOTICE OF DETERMINATION AND
NEGATIVE DECLARATION FOR THE SITING ELEMENT AND
SUMMARY PLAN AS PREPARED BY THE
SAN LUIS OBISPO COUNTY INTEGRATED WASTE
MANAGEMENT AUTHORITY
WHEREAS, the people of the State of California have enacted the Integrated Waste
Management Act of 1989 (Assembly Bill 939) which requires the preparation of solid waste
planning documents known as the "Siting Element" and the "Summary Plan", incorporated herein
by reference; and
WHEREAS, said procedures of the California Integrated Waste Management Board require
local approval of these documents, along with environmental documentation verifying compliance
with the California Environmental Quality Act (CEQA), as amended; and
WHEREAS, an Initial study has been completed and a Notice of Determination and
Negative Declaration, incorporated herein by reference, prepared in accordance with the
requirements of CEQA; and
WHEREAS, the City of San Luis Obispo has participated in the .preparation of these
documents; and
WHEREAS, the San Luis Obispo County Integrated Waste Management Authority approved
the Negative Declaration for the Siting Element and Summary Plan after considering all the
information presented to it, including the staff report and the public testimony presented in
writing and at the November 8, 1995, public hearing; and
WHEREAS, prior to acceptance of these documents by the California Integrated Waste
Management Board, the cities and the County of San Luis Obispo shall approve the documents;
and
WHEREAS, a duly advertised public hearing was held before the City Council of the City
of San Luis Obispo for consideration of all information presented to it regarding the Notice of
Determination and Negative Declaration, and
WHEREAS, the potential environmental effects were duly considered and proposed
mitigation measures reviewed and discussed.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Luis
Obispo has considered all information presented to it concerning the Notice of Determination and
Negative Declaration and determined that the Siting Element and Summary Plan shall not have
a significant effect on the environment, and

hereby approves the Notice of Determination and Negative Declaration.

SAN LUIS OBISPO COUNTY INTEGRATED
WASTE MANAGEMENT AUTHORITY
WHEREAS, the people of the State of California have enacted the Integrated Waste
Management Act of 1989 (Assembly Bill 939) which requires preparation of solid waste
planning documents known as the "Siting Element" and the "Summary Plan "' incorporated
herein by reference; and
WHEREAS, the City of San Luis Obispo has participated in the preparation of these
documents; and
WHEREAS, the San Luis Obispo County Integrated Waste Management Authority,
acting as the Local Task Force, Prepared and circulated the Siting Element in accordance
with the requirements of Public Resources Code Division 30, Part 2, Chapter 4, §41700
et seq. and California Code of Regulations Title 14, Division 7, Chapter 9, §18757 through
18758; and
WHEREAS, the San Luis Obispo County Integrated Waste Management Authority
approved the Siting Element and Summary Plan after consideration of all information
presented to it at the November 8, 1995 Public Hearing; and
WHEREAS, a duly advertised Public Hearing was held before the City Council of the
City of San Luis Obispo to receive and consider testimony on the Siting Element and
Summary Plan.
NOW, THEREFORE BE IT RESOLVED, that the City of San Luis Obispo has held
a public hearing and considered all testimony regarding the Siting Element and Summary
Plan; and
BE IT FURTHER RESOLVED, the City Council of the City of San Luis Obispo hereby
grants local approval of the Siting Element and Summary Plan in accordance with the
requirements of the California Code 'of Regulations Title 14, Division 7, Chapter 8,
§18783.
