SUBJECT: Route 46 East Highway Safety Improvements
CAO RECOMMENDATIONS:
Adopt a resolution supporting actions taken by the Highway Patrol and proposed actions
by Senator Jack O'Connell to improve safety on Highway 46 east, requesting Caltrans to
conduct a comprehensive investigation of additional safety improvement measures which
could be implemented and authorizing staff to pursue any opportunities which may arise in
the future to support safety improvements on Highway 46 east.
DISCUSSION:
Route 46 east is an important east -west statewide travel link between the Central Coast and
the Central Valley. Most of the highway between Route 101 and the Kern County line is
a two -lane facility except for a four -lane segment from Route 101 to Airport Road. The
Caltrans Route Concept Report for the highway calls for it to be improved to a four -lane
expressway between Route 101 and the junction with Route 41 east. However, based on
current State funding expectations no capacity improving projects may be programmed until
1998, and no construction could occur until at least 2001. Caltrans recently estimated that
it would cost approximately $110 million to widen the highway to four lanes as proposed.
Following the recent multiple fatality accident, a number of actions which could be taken
immediately were announced by the Highway Patrol at the request of State Senator Jack
O'Connell:
1. Additional patrols and officers would be provided on the highway to carry out
increased speed enforcement;
2. There will be increased truck inspections, additional aircraft patrols and the use of
unmarked patrol cars;
3. The speed limit on Route 46 east has been recommended to remain at 55 miles per
hour.
Senator O'Connell also proposed a two-pronged approach to addressing the issue of safety
on Route 46 east, focusing on vigorous enforcement of traffic safety laws and road
improvements:
1. First, he introduced Senate Bill 12, an urgency measure calling for the Department
of Transportation and the Highway Patrol to develop four pilot projects around the

State designating certain highways, including Route 46 east between Route 101 and
the junction with Route 41 east, as "Safety Enhancement- Double Fine Zones ".
2. Second, he has proposed that Caltrans take actions to initiate improvements to the
highway, including widening, median barricades and establishment of a mandatory
headlight safety zone (which has already gone into effect).
The range of options for the immediate improvement of Route 46 east is limited primarily
by the significant State . transportation funding shortfall. The likelihood of the anticipated
level of funding required ($110 million) being made available within the foreseeable future
is very small. It may be possible that careful application of a much lower level of funding
in the short term could result in significant safety improvements. Given that a major portion
of the fatalities in accidents on Route 46 east, including the most recent accident, have been
due to head -on collisions, it is clear that an evaluation of measures to reduce the probability
for such occurrences would be appropriate.
Therefore, the City should request that Caltrans conduct an immediate investigation of all
operational improvements to increase the safety conditions along this stretch of highway
which could be implemented within the short term, with a report to be presented to the San
Luis Obispo Council of Governments ( SLOCOG) within six months. These measures should
include: installation of median barriers, center line 'hots dots" or rumble strips and
additional passing lanes.
The proposed resolution is designed to record the City's desire to support the safety
measures proposed by Senator Jack O'Connell for Route 46 east and to provide Caltrans
with suggested direction to carry out an investigation of practical options which could be
implemented within the short term, using financial resources expected to be available to
Caltrans and the region. It also supports the request already made to Caltrans by Senator
O'Connell to make the widening of Route 46 east its first priority and to immediately
undertake placement of median barricades.
CONCURRENCES:
SLOCOG has proposed a similar resolution to its board of directors.
FISCAL IMPACT:
While there is no direct impact from the proposed resolution per se, should Caltrans agree
to place a priority status on Highway 46, projects, funding for projects on State highways
within the City of San Luis Obispo limits could be impacted. The three state highways
which pass though the City are Highway 1, Highway 101 and Highway 227.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO
DECLARING ITS CONCERNS AND DESIRES REGARDING THE NEED FOR
HIGHWAY IMPROVEMENTS ON ROUTE 46 EAST
WHEREAS, the City of San Luis Obispo desires to see that all appropriate and
available steps are taken to assure the safety of travelers on the two -lane portion of Route
46 east between Airport Road and the Route 41 junction; and
WHEREAS, State Senator Jack O'Connell has initiated legislation (SB -12) which
calls on the Department of Transportation and the California Highway Patrol to establish
a "Safety Enhancement- Double Fine Zone" on Route 46 east in order to further emphasize
safe driving requirements and has asked the California Highway Patrol to increase
enforcement activity; and
WHEREAS, State Senator Jack O'Connell has also asked that Caltrans take
appropriate actions to ensure that the road itself be made safer and that road widening,
installation of median barriers and mandatory headlight safety zones be considered for
implementation; and
WHEREAS, The California Highway Patrol has initiated actions to provide
additional patrol and officers on Route 46 east to carry out increased speed enforcement,
truck inspections and aerial monitoring; and
WHEREAS, Caltrans has agreed to invest additional dollars to implement safety
improvements along portions of Route 46 that include the installation of "hots dots" and
rumble strips, and have indicated their intention to retain the 55 mph speed limit along this
roadway,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San

Luis Obispo as follows:
SECTION 1. The City of San Luis Obispo declares its support for the improvement
of safety on Route 46 east through the imposition of safety measure such as increased truck
inspections, added enforcement patrols, rumble strips, "bots dots" and other measures
designed to decrease the frequency and severity of accidents and supports the retention of
its posted 55 mph speed limit.
SECTION 2. The City of San Luis Obispo declares its support for Senate Bill 12,
directing the Department of Transportation and the Highway Patrol to establish a "Safety
Enhancement- Double Fine Zone" on Route 46 east.
SECTION 3. The City of San Luis Obispo requests that Caltrans conduct an
immediate investigation of all operational improvements to increase safety conditions on
Route 46 east that could be implemented within the short term and present a report of any
such improvements to the San Luis Obispo Council of Governments within six months.
SECTION 4. City staff is directed to pursue any opportunities which may arise in the
future to support safety improvements on Highway 46 east.

SUBJECT: Lease of Real Property - 45 Prado Road
CAO RECOMMENDATION:
By Resolution, approve and authorize the Mayor to execute a lease agreement for
approximately 23,450 sq.ft. of City owned real property located at 45 Prado Road, to
ECOSLO for operation of a recycling services center. Term of the lease shall be for a
period of one year with annual renewals considered following review by Council of
relevant operational and maintenance information.
DISCUSSION:
On July 25, 1995 Council directed staff to prepare a revised agreement for lease of certain real
property located at 45 Prado Road to ECOSLO for operation of a recycling services center. Staff
has prepared a revised agreement, consistent with todays standards and requirements and is
recommending Council approval of the agreement.
Given the history of use of the property by ECOSLO and problems with operations of the
recycling center and maintenance of the property, staff has incorporated performance standards
and provisions for public/Council review of the agreement should significant violation of these
standards occur. ECOSLO has made a commitment to resolution of these problems and concurs
with the standards, terms and conditions as identified in the agreement.
The lease of this property without charge is in recognition of the public benefit ECOSLO's
operation of the recycling center and other environmental services it supports provides to the
community. The term of the lease has been set for one year with extensions to be considered by
Council annually. This will ensure that Council and the public have adequate opportunity for
review of the use and maintenance of the site by ECOSLO.
Property Improvements
In recognition of the problems which have occurred at the site in the past, ECOSLO has been
worldng to identify certain site and operational improvements to enhance service and eliminate
recurrence of the problems. For example, of major significance was the issue of soil
contamination caused by the collection and storage of used motor oil at the site. ECOSLO has
removed and is treating all contaminated soil from the site. Once treatment (bioremediation) of
the soil is complete it will be properly disposed of. To prevent this from recurring, ECOSLO no
longer collects or stores used motor oil. Instead they direct customers with used motor oil to one
of the numerous other used oil collection programs in the City.
ECOSLO has also identified various site improvements to aid in customer service, visual
appearance, and control of stored materials from off -site migration. Staff has reviewed the
improvement plans and agrees that the improvements identified will go a long way toward
eliminating the problems which have plagued the site in the past. ECOSLO has proposed to fund

the necessary fencing improvements, site adjustments, and all planning and engineering costs and
is requesting the City to fund the needed on -site pavement improvements. Staff feels these
(pavement) improvements would be an enhancement to this City owned property and is therefore
recommending Council concurrence. In an effort to facilitate and expedite these improvements
staff is recommending Council provide direction to return with any necessary budget adjustments
at mid -year.
ECOSLO Director, Geoff Land, has provided the ECOSLO Recycling Yard. 1995 Report for
Council review and consideration (distributed to council under separate cover). The report details
information such as materials recycled in 1995, as well as past, current and future operational
changes and site improvements which will help ECOSLO resolve the issues which have
surrounded the operation of the yard in the past. Staff is extremely pleased with the information
in this report and the commitment exhibited by ECOSLO to resolve these issues and is confident
that with our cooperation, ECOSLO will make this "a clean, safe, attractive and efficient
recycling operation ".
Expanded Facility
At the July 25, 1995 Council meeting ECOSLO had asked that the City consider expanding the
property leased to ECOSLO an additional 25 feet to the south. Since that property is the proposed
future site of the Homeless Services Center and negotiations and design of the Center are still in
progress, the additional property has not been included in this lease. ECOSLO is still interested
in the additional space as it will facilitate storage of materials and loading and unloading of trucks
on -site. Utilities staff and ECOSLO will continue to work with the Police Chief (who is in charge
of the Homeless Services Center site development and negotiations) as plans for the Center are
developed to see if any opportunity for expanding ECOSLO's lease or cooperative use of a portion
of the property exists.
FISCAL IMPACT
Continued lease of the subject property to ECOSLO as a recycling center has no direct fiscal
impact. Operation of the recycling center by ECOSLO helps provide ECOSLO funding for their
environmental services and education programs which the City values greatly.
There may be some costs associated with site improvements ($5,000 -$ 10,000) should Council
concur with staff's recommendation to participate in certain site improvements which would
enhance the overall value of the property. With Council's conceptual concurrence, staff will work
with ECOSLO in the development of final plans and cost estimates and return to Council with a
mid -year budget adjustment for the recommended improvements.

OF REAL PROPERTY LOCATED AT 45 PRADO ROAD
WHEREAS, the Environmental Center of San Luis Obispo County ( ECOSLO) has, since
November of 1971, leased a portion of City owned real property located at 45 Prado Road for
the purpose of operating a recycling services center, and
WHEREAS, this lease has been subsequently extended and amended 4 times previous,
and
WHEREAS, the City (Lessor) and ECOSLO (Lessee) desire to enter into a revised lease
agreement to continue to lease to Lessee approximately 23,450 square feet of real property
owned by Lessor, consistent with the terms and conditions established in the attached lease
agreement.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of San Luis
Obispo does hereby approve and authorize the Mayor to execute a lease agreement for
approximately 23,450 sq.ft. of City owned real property located at 45 Prado Road, to ECOSLO
for operation of a recycling services center.

LEASE OF REAL PROPERTY
45 PRADO ROAD - APN 53 -051-45
This lease, made and entered into this day of , 1995 by and between the CITY
OF SAN LUIS OBISPO (hereinafter "City") a municipal corporation, and the
ENVIRONMENTAL CENTER OF SAN LUIS OBISPO (hereinafter "Lessee "), a community
based non -profit organization.
WITNESSETH:
WHEREAS, the parties hereto desire to enter into an agreement whereby the City will
lease to Lessee approximately 23.450 square feet of the City's real property located at 45 Prado
Road and known as a portion of APN 53- 051 -45, San Luis Obispo County, California; and,
WIFREAS, the Council of the City of San Luis Obispo has determined that the lease
of said property to Lessee will provide significant public benefit both directly and indirectly
through the operation of a recycling center and provision of certain environmental services; and,
WHEREAS, revenues generated from the use of said property shall be used solely for
the continued provision of non -profit environmental services, and maintenance and improvement
of the subject property, for the benefit of the citizens of the City of San Luis Obispo;
NOW, THEREFORE, in consideration of the promises and agreements, covenants and
conditions stated herein, the parties agree as follows:
I. PREMISES LEASED
City leases to Lessee that portion of APN #53- 051 -45, real property as shown on
Exhibit A to this lease, subject to any rights and/or easements as may be legally recorded with
the County Recorders Office for the County of San Luis Obispo.
2. TERM
The term of this lease shall commence on February 1, 1996, and extend for a
period of one (1) year.
3. RENEWAL
This lease may be renewed annually following a public review by City Council
of relevant operational information, maintenance and condition of said property, and

environmental services provided to and/or for the City. Following such review, City Council
may determine to extend this lease for an additional year, again pending review of operational,
maintenance and service information, or terminate this lease.
4. RENTAL
Lease of this property for the purposes described herein shall be at no charge to
the Lessee. Lessee agrees to provide recycling buy -back and environmental education services
to the City and community as a public benefit at no charge to the City.
5. UTILITIES
Lessee shall make all arrangements for any payment due for all utilities and
services furnished to or used by it on the leased premises, including , without limitation, gas,
electric, water, sanitation, telephone service, and trash collection. This includes any and all
costs for connection charges. The City assumes no responsibility and makes no warranties
regarding any utilities, and Lessee hereby holds the City harmless in this regard.
6. PROPERTY OR POSSESSORY rNTEREST TAX
If this lease should result in the assessment of taxes for this real property,
including, but not limited to, possessory interest taxes, Lessee agrees that any tax liability will
result in an increase in the amount of rent due to the City, equal to the amount of any such tax
liability.
7. USE OF PROPERTY
Lessee shall be entitled to use said property for the purpose of operation of a
recycling center, and for no other purpose.. Operation of the center shall consist of purchase of
recyclable materials from the general public, processing of materials purchased and or collected
by Lessee, and storage and transfer of processed recyclable materials. Lessee agrees that the
use of said property as described shall be for the sole purpose of supporting Lessee's non -profit
environmental services and programs and in no way shall be used for "for profit" activities.
Lessee further agrees that a full description of the use of said property, and activities and
improvements occurring on the property will be provided to the City Administrative Officer
annually, and, that any change in use will be submitted to the City for approval prior to
commencement of that use.
8. ALTERATIONS AND REPAIRS
Lessee shall be responsible for any and all alterations and repairs to the property
necessary for the orderly conduct of Lessee's operations. Lessee shall provide to the City for

approval, prior to commencement of any work or activity, a complete description of any
Physical alteration of the property including: modifications to fencing, installation of concrete,
paving, excavations and similar improvements and modifications. Lessee further agrees to
remove and return to original, any alterations to said property made by Lessee as requested by
the City upon termination of this Lease at Lessee's sole cost. Lessee shall be responsible for
any and all repairs of said property and improvements there -on. Any and all improvements and
alterations to said property shall be made in conformance to applicable laws and requirements.
Lessee shall be responsible for obtaining any necessary permits and the cost of such permits as
may be necessary to complete the improvements and /or alterations.
9. MAINTENANCE OF PROPERTY
Lessee shall maintain property in an orderly and first class condition at all times,
satisfactory to the City Administrative Officer or his /her designee. Lessee shall maintain
adjacent properties free of litter resulting from Lessee's activities. Lessee shall at all times
maintain property in a manner consistent with any .applicable federal, state, or local laws and
regulations, and in such a manner as to ensure the protection of the public, Lessee's employees
and the environment.
10. CONTROL OF MATERIALS
Lessee shall be solely responsible for control of materials received and/or
Processed at the property. Materials shall be controlled in such a manner as to eliminate any
off -site migration of materials caused by wind, rainfall run -off, seepage, etc. Materials received
shall be processed, bailed, or otherwise stored to ensure control of said materials the same day
the materials are received. No materials subject to migration shall be left loose during non -
business hours.
11. HAZARDOUS WASTE
Lessee shall be solely responsible for the proper storage and disposal of any
hazardous waste received or produced as a result of Lessee's operations. With the exception of
used oil received for recycling, Lessee shall not knowingly receive or store any hazardous waste
on said property. Lessee shall be responsible for the immediate legal-and proper disposal of any
hazardous waste received and any and all costs associated with the disposal of said waste.
Within 120 days of the execution of this lease, Lessee shall present to the City Lessee's Hazard
Communication Plan and Hazardous Waste Control and Disposal Plan for any hazardous waste
received and/or handled. The plan shall at a minimum identify procedures and provide
instruction to employees in the event hazardous wastes are found on the premises or in the
recyclables in the possession of Lessee. The purpose of the plan will be to ensure that any
hazardous waste found and possessed by Lessee is handled and disposed of in compliance with
Federal State an local laws, rules and regulations. Lessee shall be solely responsible and liable

for any and all costs associated with clean-up of any soil, water or other contamination resulting
from Lessee's operations. With regards to used oil received for recycling, Lessee shall at all
times receive, store, transport and dispose of used oil in accordance with all applicable laws.
12. TRAFFIC CONTROL
Lessee shall be responsible for control of traffic related to Lessee's operations.
Lessee shall establish adequate controls, traffic flow, parking, and materials transfer locations
and procedures so as not to interfere with the flow of traffic on Prado Road and the Water
Reclamation Facility (WRF) access road. Lessee shall provide and maintain the controls,
clearances and visibility necessary to ensure the safe and orderly ingress and egress of the
Public, employees and contractors to and from the property. All materials, vehicles and
equipment shall be properly stored or parked within the boundaries of the leased property. No
materials, vehicles or equipment shall be stored or parked on the WRF access road. Lessee's
operations related to the transfer and loading of materials for transport shall be conducted in
such a manner and at such times as to not interfere with the orderly flow of traffic in and around
the property. No loading of materials shall occur on the WRF access road during normal hours
of operation of the City transit system (Sept. through June, 6:30 am to 10:30 pm; July through
August, 6:30 am to 7 :30 pm.) Lessee shall at all times ensure a minimum clearance of twenty
(20) feet of available roadway for Fire access on the WRF access road.
13. COORDINATION WITH CITY
Lessee shall coordinate with the City any activities which have potential to impact
in any way City operations. Upon notification by the City, Lessee shall immediately cease any
operation deemed to interfere with the conduct of the orderly business of the City in its
operations.
14. REPORTING
Lessee shall provide to the City reporting necessary for the City to evaluate
compliance with the provisions of AB939. Lessee shall provide at a minimum a report of total
tonnage of recyclable materials processed, a breakdown of material tonnages by material type
and City of origin. City of origin may be determined by bi- annual surveys of not less than one
week in duration. Surveys shall be completed in February and August of each year. Reporting
shall be provided on a quarterly basis with reports due no later than 15 calendar days after the
end of the quarter. Quarters end on March 30, June 30, Sept 30, and Dec..30. Lessee further
agrees to provide the City any additional reports or information requested by the City relative
to Lessee's operations.

15. PERMITS
Lessee shall maintain any and all permits necessary for the conduct of the Lessee's
business at the site as required by Law.
16. INDEPENDENT CONTRACTOR
Lessee and all of its agents, representatives, and participants in any manner with
Lessee's operations shall be independent contractors or volunteers for Lessee and shall not for
any purpose be considered as employees or agents of City.
17. SUBJECT TO ALL LAWS AND BINDING
This lease shall be subject to and subordinate to all laws, rules and regulations of
the State of California and the City of San Luis Obispo, including any and all conditions
imposed by the City Council.
18. TERMINATION FOR CAUSE
Each of the terms, covenants and conditions of this lease are mutual and
dependant, and any breach of any of the said terms, covenants or conditions shall constitute
grounds for the termination, cancellation or forfeiture of this lease.
19. INDEMNIFICATION
Lessee shall defend, indemnify and save harmless the City and its agents, officers
and employees against any and all claims, demands, damages or liabilities (whether or not
caused by negligence) including civil or criminal fines, arising out of or relating to any of the
following:
(a) any damage, injury or death suffered by any person or corporation and
caused by any act or omission of Lessee, its agents, employees, tenants, invitees
or assigns under this agreement;
(b) any damage caused by any act or omission of Lessee, its agents,
employees, tenants or assigns under this agreement to any property of the City
and its agents, officers and employees;
(c) any damage, injury or death suffered by any agent, tenant, or assignee of
Lessee under this agreement, except for claims and demands resulting from the
sole negligence or willful misconduct of the City and its agents, officers and
employees;

(d) Lessee's violation of any law, any regulation or any term or condition of
any permit.
(e) any generation, processing, handling, transportation, storage, treatment or
disposal of solid wastes or hazardous wastes (including but not limited to used
motor oil) by Lessee.
(f) any releases by Lessee, including but not limited to any releases as defined
under the Comprehensive Environmental Response, Compensation and Liability
Act of 1980, to the extent occurring or existing as a result of Lessee's activities,
including such releases to land, groundwater surface water or into the air.
Lessee shall also defend, indemnify and save harmless the City and its agents,
officers and employees against any and all expense of investigating and defending against such
claims and demands, including, but not limited to, attorney's fees and costs.
20. INSURANCE
Lessee shall provide insurance, including but not limited to workers compensation
insurance as described in Exhibit B to this lease, Insurance Requirements for Lessees including
additional coverage for Automobile liability and Subcontractors as identified in Exhibit C to this
lease, Insurance Requirements of Contractors.
21. ASSIGNMENT
Lessee shall not assign this lease in whole or in part nor sublet the premises in
whole or in part without the written consent of the City. If the City consents to a sublease,
Lessee shall remain responsible for the performance of all the terms, covenants and conditions
of this lease including and in particular the use of the property as described in Article 7. of this
agreement. If Lessee assigns or subleases said lease or any portion thereof without the prior
written consent of the City, then said sublease or assignment shall be voided, and at the option
of the City, this lease shall immediately cease and terminate.
No interest of Lessee in this lease shall be assignable by operation of law. Each
of the following acts shall be considered an involuntary assignment:
a. If Lessee is or becomes bankrupt or insolvent, makes an assignment for
the benefit of creditors;
b. If a writ of attachment or execution is levied on this lease;
C. If, in any proceeding or action in which Lessee is a party, a receiver is

appointed with authority to take possession of the premises.
Any involuntary assignment shall constitute a default by Lessee and City shall
have the right to elect to terminate this lease.
22. INSPECTION
The City shall have the right at all reasonable times to enter upon the property
for the purpose of inspecting the same, determining that all the terms, covenants and conditions
of this lease are being kept and performed by Lessee.
23. ENFORCEMENT
The City Administrative Officer or his/her designee shall have all necessary
authority to enforce the terms, covenants and conditions of this lease. Upon notice of violation
of any of the terms, covenants and conditions of this lease, Lessee shall take whatever actions
are necessary to correct the violation. All violations shall be corrected within 30 days from the
date of Notice and Lessee shall provide to the City a report outlining the cause of the violation
and corrective measures taken to remedy the violation and prevent its recurrence.
Significant violation shall be defined as any violation of the terms, covenants and
conditions of this lease occurring and noticed more than two times in any calendar year, or,
violation and notice of violation of any three terns, covenants and conditions of this lease
occurring within any calendar year, or, failure to correct a violation of any of the terns,
covenants and conditions of this lease within 90 days from the date of Notice. Significant
violations as defined herein will result in a hearing before the Council of the City of San Luis
Obispo to determine appropriate remedies up to and including termination of this lease as defined
under Article 18. of this agreement.
24. LIENS
Lessee shall keep the premises free from any liens arising out of any work
performed for, materials furnished to, or obligations incurred by Lessee and shall hold City
harmless against the same.
25. TERMINATION WITHOUT CAUSE
The City Council may by motion terminate this agreement at its sole discretion
after a public hearing held upon ten (10) days written notice to Lessee. Said termination shall
be effective fifteen (15) days after City mails notice of termination to Lessee.

26. APPEALS
All decisions, directions and notice by the City Administrative Officer or his/her
designee, relative to the terms, covenants and conditions of this lease, shall be considered final
by Lessee. Appeals may be presented to the Council of the City of San Luis Obispo, which
decisions, directions and notice shall be final.
27. NOTICE
Any notice required or permitted to be given or served under the terms hereof
shall be considered delivered when sent registered,

INSURANCE REQUIREMENTS FOR LESSEES (NO AUTO RISKS)
Lessee shall procure and maintain for the duration of the contract insurance against claims for injuries to persons
or damages to property which may arise from or in connection with the Lessee's operation and use of the leased
premises. The cost of such insurance shall be borne by the Lessee.
Minimum Scope of Insurance
Coverage shall be at least as broad as:
1. hisuraiice Services Office Commercial General Liability coverage (occurrence form Co 0001).
2. Workers' Compensation insurance as required by the State of California and Employer's Liability Insurance
(for lessees with employees).
3. Property insurance against all risks of loss to any tenant improvements or betterments.

The Environmental Center of San Luis Obispo County (ECOSLO) is a
membership, non - profit organization dedicated to protecting and
enhancing the environmental quality of San Luis Obispo County.
Since 1971, ECOSLO has leased (at no charge) the City's property
located at 45 Prado Road for the purpose of operating a recycling and
buyback center. Since that time, revenues generated from the
recycling yard have provided support for environmental programs in
San Luis Obispo. ECOSLO's commitment to the diversion of usable
resources from the solid waste stream has meant accepting materials
(such as plastics, cardboard, metals, and used motor oil) even when it
was not profitable to do so.
ECOSLO presently maintains a downtown office at 967 Osos Street,
which provides environmental education and outreach, networking
and referral services, and program support for regional efforts to
promote environmental sustainability. Areas of focus have included
open space preservation, composting, traffic calming, waste
reduction, coastal resources protection, water conservation, creek
ecology, household hazardous waste solutions, and many others.
ECOSLO is grateful for the opportunity to continue providing
recycling services to the community of San Luis Obispo through our
Prado Road buyback center.

1995 -Yard Overview
Materials and Tonnage: During 1995, ECOSLO's recycling yard at
45 Prado Road collected and processed approximately 1,600 tons of
recyclable materials. Rock Solid, ECOSLO's curbside recycling
operation for Morro Bay, accounted for a little over three - fourths of
our total volume by weight. For a breakdown of tonnage by
material, see Table A below.

During the course of 1995, San Luis Obispo City Council and staff
articulated a number of concerns related to the recycling operation at
45 Prado Road. The primary areas of concern were overall site
cleanliness, hazardous materials clean -up, physical and structural
site issues, and the Rock Solid operation. ECOSLO Board of Trustees,
upper management and yard staff have worked to address these
concerns. Below find a breakdown of our progress in working to
resolve the problems at the yard.
In late August,. after more than 15 years of diverting used motor oil,
ECOSLO stopped accepting used motor oil and oil filters at the

recycling yard. ECOSLO continues to promote used oil recycling
through a county -wide network of California Certified Used Oil
Recycling Centers.I ECOSLO's decision was based on the accessibility
of other oil recycling centers (thereby ensuring diversion) and the
need to clean -up the yard operation. (See Addendum A.)
The removal of the oil tanks has provided more inventory space for
other materials being processed at the yard and eliminates the
possibility of future oil spills at the site. The yard's oil collection
equipment, which was purchased under a grant from the California
Integrated Waste Management Board, was returned to the grant
administrator (County Engineering Department) for use in county oil
recycling programs.

ECOSLO is in the final stages of our efforts to clean up the oil spill at
the Prado Road site. During the clean -up process, we have remained
in close communication with appropriate City officials. The
contaminated soil was assessed by Cuesta Geotechnical during the
period between March 1 and October 5, 1995. A total of
approximately 125 cubic yards of soil was excavated from three
different areas.
The soil is currently being stored on City property adjacent to our
existing recycling yard, where it is in the process of being
remediated through the application of bacterial cultures. (See
attached reports, Addendum C.)
Following bioremediation, the soil will be disposed in accordance
with prevailing ordinances. It is anticipated that the soil will be
removed from the site by early February, 1996.
1 During the summer, with a grant from the California Integrated Waste Management
Board, ECOSLO, the City of San Luis Obispo and the County Engineering Department
worked in partnership to produce an informational brochure on used motor oil recycling
in San Luis Obispo County. The guide, published in English and Spanish, describes the
correct and easiest ways to recycle used motor oil and lists all the certified used oil
collection centers in the county. At the same time, ECOSLO and the County Engineering
Department helped certify over 30 oil recycling centers throughout the county. During
July, over 3,000 copies of the bilingual guide were distributed county -wide to auto parts
dealers, libraries, government centers, motor oil sales outlets and grocery stores. (See
guide, Addendum B.)

Yard Safety and Insurance
ECOSLO prepared a site specific Safety and Handling Plan for
Hazardous Materials (as defined by Federal and State law), as
requested by the City. ECOSLO also prepared a Hazard
Communication Program as part of our Injury Illness Prevention
Program (IIPP) approved by Cal /OSHA. (See documents,
Addendum D.) These documents are in the final stages of being
translated into Spanish.
Insurance for the yard (equipment, workers compensation, etc.) is
covered by an accredited ANII insurance provider (State Fund), in
accordance with the City's policy for its contractors.
Phase Out of Rock Solid Recycling
In January, 1994, ECOSLO began a curbside recycling operation in
Morro Bay through a contract with that city. Rock Solid Recycling
was a non -profit operation conducted under the auspices of ECOSLO.
Hauling equipment was run out of the Prado Road site, and materials
were sorted at the yard by Rock Solid employees. The contract was
to continue through the end of 1996. However, in December, 1995,
the City of Morro Bay accepted a proposal put forth by ECOSLO and
RALCCO (a recycling company based in Nipomo with six curbside
operations in SLO and SB counties), whereby beginning January,
1996, RALCCO would perform hauling, sorting and marketing of
recyclables and ECOSLO would conduct the .education and community
outreach. Therefore. all activities related to the Rock Solid operation
were phased out effective January 1. 1996.
As a result of this transition, yard staff was be reduced from 18 full
and part-time employees to approximately nine. It is anticipated
that materials volume (in tonnage) will decrease by approximately
75% (see Table A). The yard will return to a simple, streamlined buy
back operation.
Physical and Structural Site Improvements
ECOSLO has been working in coordination with City representatives
to institute a number of physical changes at the yard designed to
improve the yard's visual appearance and overall efficiency.

Debris Control: Although wind continues to present a challenge
with respect to containment of materials and other debris from the
recycling operation, community service workers and yard staff are
regularly assigned to site cleanliness in order to reduce interior and
exterior debris. Implementation of our site improvement plans will
greatly reduce site cleanliness and visual appearance (See Site Plans
section, below).
Signage: Permanent, metal signs have been posted at the yard
warning against illegally leaving hazardous wastes (oil and filters,
paints, batteries, pesticides, etc.) at the recycling yard, citing
appropriate county ordinances. The signs have helped reduce
unwanted hazardous wastes deposited during off hours at the yard.
(See photo, Addendum E.)
Landscaping: ECOSLO yard staff has worked to improve the yard's
external appearance by landscaping a portion of the site exterior
along Prado Road. ECOSLO will work with City staff to explore other
options for improving yard appearance through appropriate exterior
landscaping. (See photo, Addendum F.)
Concrete Improvements: Several concrete slabs have been poured
in key areas (baling and processing areas) to improve processing
efficiency and reduce problems resulting from mud and rainwater
puddles. ECOSLO will notify the City of any additional plans to pour
concrete slab.
Parking: Parking is no longer permitted along the access road
shoulder, and "no parking" signs have been posted. All ECOSLO
equipment is parked either on site or across Prado Road at a site
established through an agreement with the owner.
Site Improvement Plans
ECOSLO has developed a site improvement plan for the yard designed
to improve site cleanliness, safety and the level of service to the
public (See proposed layout in Addendum ' G). ECOSLO will shift the
buyback operation to the front ( Prado Road) side of the yard,
thereby separating the public/buyback area from the processing and
inventory areas of the yard. A tall fencing (8 -10 ft. high) with wind
screen will replace existing fencing along the access road, and be
installed as a physical divider and wind screen between the buyback
and processing area. Loading and off loading will be done on site,

and we will move to ensure "same day" containment of recyclable
materials. Containments of chain link fencing will be erected around
and over the collection bins at the drop -off area to minimize debris
scatter. ECOSLO is working to ensure that all appropriate permitting
issues are properly addressed. We will work in coordination with
the City to provide a layer of asphalt in the buyback area. The
heightened fencing, separation of buyback and processing areas, and
improved paving will greatly reduce problems of debris and improve
the yard's overall appearance.
Yard Mana eg_ ment
As of February 1, 1996, the recycling yard will be under new
management. The transition from Rock Solid to a down - scaled, buy-
back operation is an opportunity for ECOSLO to reassess our yard
management needs and for the current manager to pursue
professional opportunities of his own. ECOSLO is currently evaluating
new management options. The new management will be directed to
move expeditiously toward a clean, safe, attractive and efficient
recycling operation for the .yard, in keeping with the terms of
ECOSLO's new lease agreement with the City.

Executive Director Geof Land said
the ECOSLO board decided Tuesday it
had had too many problems wgth
spills to continue accepting the oil,
which is a hazardous material.
The non -profit organization is cur-
rently under a city order to clean up
approximately 50 cubic yards of con -
tarninated earth, most of which was
the result of many small spills caused
by people recycling their oil.
The costs for that cleanup, said
Land, are likely to exceed a10,0o0.
The decision, he said, came after
many conversations with the Prado
Road yard manager and the geological
consultant in charge of the cleanup.
'Three times in the last 20 years,
we've had to .deal with cleanups,"
Land said.
"We wanted to make sure we didn't
run into the problem in the future."
In addition, he said, there are now
11 other drop-off sites for used motor
oil and filters in the city and 35 in the
county, so there are plenty of other
places for residents to go.
"It's not an issue of diversion
anymore," hb said.
"The public has all these options
now.,,

Dear Mr. Meyer.
This letter is a report on the excavation and remediation of contaminated soil at the
ECO -SLO Recycling Center, 45 Prado Road, San Luis Obispo, California. The
contaminated soil was identified and assessed by Cuesta Geotechnical during the
period between March 1, 1995, and October 5, 1995, and the soil was excavated
between September 15, 1995, and October 5, 1995. The contaminated soil was
identified at three areas: Area A, where the contaminated soil was contained in 55
gallon drums; Area B, where the contaminated soil was identified adjacent to the
recently used waste oil recycling tank; and Area C, where the contaminated oil was
identified adjacent to a previously used waste oil recycling tank (see figure 1). The
soil from Area A and the excavated soil has been stored on the City of San Luis
Obispo property adjacent to the subject property and is in the process of being
remediated.
SOIL EXCAVATION
Area B:
The contaminated soil identified at Area B was outlined in reports filed with your
office that were dated March 28,1995, April 17, 1995, and May 16,1995. The extent of
the contaminated soil prior to the excavation is shown on figure #2. Excavation of
the soil began on September 21; 1995, and soil samples #40 through #48 were
obtained on September 23, 1995, to determine whether or not all the contaminated
soil had been removed (see figure #3). Results of the soil analyses show samples
#40 through #47 to have Total Recoverable Petroleum Hydrocarbons (TPH)
concentrations below 100 ppm (the state action level). Sample #48, located one foot
below the drain nozzle of the waste oil tank's concrete container, had a TPH
concentration of 480 parts per million (ppm). On September 28, 1995, the

contaminated soil identified by sample #48 was excavated and the area was
reevaluated by samples #50, #51, and #52. Samples #50 and #52 had TPH
concentrations below 100 ppm. Sample #51, located below sample #48, had a TPH
concentration of 410 ppm. On October 5, 1995, additional soil was excavated in the
area of samples #48 and 951. The area excavated was approximately 9 square feet by
7 feet deep. Samples #55 through 4159 were obtained in this area, and their resulting
TPH concentrations were 18 ppm or less. Based on the results of the soil analyses,
the hazardous materials identified as Total Recoverable Petroleum Hydrocarbons
have been removed from this area. The results of Area B's soil analyses are
compiled in Table #1 and the laboratory company's report sheets are attached in
appendix A.
Area C:
The contaminated soil identified at Area C was outlined in reports filed with your
office dated March 28, 1995, April 17, 1995, and May 16, 1995. The extent of the
contaminated soil prior to excavation is shown on figure 94. Excavation of the soil
began on September 15, 1995, with the portion of contaminated soil identified inside
the City of San Luis Obispo's Fire Department Yard being excavated. Soil samples
#40A through #46A were obtained from this area on September 15 and 16, 1995, to
determine whether or not the contaminated soil had been removed (see figure #5).
Results of the soil analyses show all samples to be below 100 ppm (the state action
level). On September 15 and 21, 1995, the portion. of contaminated soil identified
inside the City of San Luis Obispo's Sewer Department Yard was excavated. Soil
samples #47A through #52A were obtained on September 21, 1995. Results of these
soil analyses show the sample's TPH to be below 100 ppm but sample #52A had a
TPH of 98 ppm. As we discussed during our meeting on September 27, 1995,
additional soil was removed from the area of sample #52A without the need for
additional soil testing. This additional volume of soil was 16 square feet by 1.0 to 1.5
feet deep. Based on the results of the soil analyses, the hazardous materials
identified as Total Recoverable Petroleum Hydrocarbons have been removed from
this area. The results of Area C's soil analyses are compiled in Table . #2 and the
laboratory company's report sheets are attached in appendix A.
SOIL REIVIEDIATION
The contaminated soil from Area's A, B, and C is in the process of being
bioremediated in the City of San Luis Obispo's Fire Department Yard adjacent to the
subject property. The volume of soil is estimated at 125 cubic yards. Soil samples
have recently been obtained for laboratory analyses andI ie results will be filed with
your office in the near future. The initial evaluation of the soil pile will be based on
5 soil samples or one sample per 25 cubic yards.

AREA B AND C BACK FILL
Area B was back filled with class 2 fill except immediately adjacent to the
underground pipes, where sand was used. Area C's City of San Luis Obispo's Fire
Department Yard was back filled with class 3 fill while the City of San Luis Obispo's
Sewer Department Yard was back filled with soil. Compacting tests were obtained
near Area B's soil sample #55 and Area C's soil sample 40A. The results of the tests
were above 90% and the laboratory results will be delivered to your office within
one week.
This report has been prepared for the use of the client as it pertains to the property at
45 Prado Road, San Luis Obispo, California. The findings and conclusions presented
in this report are based on the field work, and laboratory testing of soil samples
collected during this investigation. This report may not reflect potential variations
in subsurface conditions which may exist between sample locations. All work has
been performed in accordance with generally accepted practices in geologic,
hydrogeologic and environmental consulting. No warranty, either expressed or
implied, is made.

Injury and Illness Prevention Program
(as per SB 198)
POLICY
ECOSLO will institute and administer a comprehensive and continuous occupa-
tional Injury and Illness Prevention Program (IIPP) for all employees. The health and
safety of the individual employee whether on the road, in the recycling yard, or in the of-
fice takes precedence over all other concerns. Management's goal is to prevent accidents,
reduce personal injury and/or occupational illness, and to comply with all safety and health
standards.
RESPONSIBILITY
-The 85s1 5tar t yard -r►8hag&- has the authority and is responsible for
overall management and administration of the IiPP. All supervisors are responsible for
carrying out the IIPP in their work areas. A copy of the IIPP will be available for each
supervisor, who can then answer individual questions from any employee.
EMPLOYEE COMPLIANCE
Employees who follow safe and healthful work practices will have this fact recog-
nized and documented on their performance reviews. Employees who are unaware of cor-
rect safety and health procedures will be trained or retrained.
Willful violations of safe work practices may result in disciplinary action or termi-
nation of employment.
COMMUNICATION
Matters concerning occupational safety and health will be communicated to em-
ployees by means of written documentation, staff meetings, formal and informal training,
and/or posting of notices.
Communication from employees to supervisors and/or safety representatives about
unsafe or unhealthy conditions is encouraged and may be verbal or written. An employee
has the right fo remain anonymous; and also'has the right to report an unsafe or unhealthy
condition without fear of reprisal. The results of the investigation of any employee safety
or health suggestion will be made known to all employees by distribution of memos or by
posting in appropriate areas.

INSPECTIONS
Each supervisor and/or safety representative will conduct inspections and investi-
gations to identify unsafe work conditions and practices:
1. Monthly in all work areas
2. Whenever new substances, processes, procedures, or equipment intro-
duced into the workplace present a new occupational safety and health
hazard.
3. Whenever the supervisor or safety representative is made aware of a
new or previously unrecognized hazard.
INJURYALLNESS INVESTIGATION
Occupational injuries and illness will be investigated in accordance with established

CORRECTION OF UNSAFE OR UNHEALTHFUL CONDITIONS
Whenever an unsafe or unhealthful condition, practice, or procedure is observed,
discovered, or reported, the program administrator or designee will take appropriate cor-
rective measures in a timely manner based upon the severity of the hazard. Employees will
be informed of the hazard, and interim protective measures taken until the hazard is cor-
rected.
Employees may not enter an imminent hazard area without appropriate protective
equipment, training, and prior specific approval given by the program administrator or
designee.

The program administrator or designee shall assure that supervisors receive train-
ing on 'recognizing the safety and health hazards to which employees under their immedi-
ate direction and control may be exposed.
.1 Supervisors are responsible for seeing that those under their direction receive
training on general workplace safety, and specific instructions regarding hazards unique to
any job assignment.
This training is provided:
1. To all employees and those given new job assignments for which train-
ing was not previously received.

RECORDR EEPING
The program administrator or designee shall keep records of inspections, including
the name of the person or persons conducting the inspection, the unsafe conditions and
work practices identified, and action taken to correct these identified unsafe conditions
and work practices. These records shall be maintained for at least three 55 years.
The program administrator or designee shall also keep documentation of safety
and health training attended by each employee, including employee name, training date (s),
type of training, and training facilitators. This documentation shall be maintained for three

The two basic ingredients for a fire or explosion are:
1. Source of Ignition
2. Flammable Material
Common Sources of Ignition at the yard include: matches, welding
torches, lighted cigarettes, electrical equipment, -m-ba hot areas 0tj or
rz2r vehicles, direct sunlight on conductive materials.
Common sources of Flammable Materials at the yard include:
Waste oil, paint, solvents, fuels, paper or cardboard products, wood
structures, dry weeds, flammable vapers.
When working with any of these ingredients caution should be excercised
and work Should be performed in a well - ventilated area away from combustible
materials. Labels on containers shoul& be read and understood before using
product. If you have any questions;'ask your supervisor before proceeding.
The Maintenence Supervisor will oversee maintenence of equipment
any systems installed to prevent or control ignitions or fires. The yard
Supervisor or Asst. Yard Supervisor will oversee control of accumulation of
flammable or combustible materials.
*All flammable substances including oils, paints, solvents, and
fuels shall be kept in designated areas in the tool shed or with the
hazardous waste storage area. These areas must be kept clear and free
of trash and debris. Electrical conduit boxes and outlet areas must
also be kept clear.
*Smoking is allowed only in designated deck area.
*Fire extinguishers shall be mounted in easily visible and accessible
areas. Employees are to know the location of all fire extinguishers.
Periodic training on fire extinguisher use will be overseen by yard
supervisors.
LOCKOUT PROCEDURE
The Lockout Procedure for the recycling yard equipment pertains to:
*downstroke balers
*'glasshopper' glass crushing machines
*aluminum can flattener /blower machine
Thitiprocedure will consist of shutting off the labelled breakers
at the electrical panel and filling out and.attaching a tag'with the
appropriate information: date, time, initials. The person who tagged
the switches will then remove the info tag when they are finished working
on that particular piece of equipment.
HAZARD COMMUNICATION PROGRAM
All workers that handle any substances will be provided Hazard
Communication training prior to handling the hazardous substances.
This applies to all solvents, acids, caustics, pesticides, flammables,
paints, compressed gases, cleaners, or any other substances that falls
into the "hazardous" definition. Copies of the Material Safety Data
Sheets will be kept on file at the yard and employees will be shown how
to read them. They will be told to read the M.S.D.S. before using any
hazardous substance.and to talk to their supervisor about any concerns
or questions they may have.
For unknown substances which may appear on the recycling yard
premises through donation by the public, the procedure is as follows:
*Carefully transport material or substance to designated temporary
storage area, and contact the Fire Dept. immediately.
*If container contains a crystalline substance;*db not attempt,to
touch it (it may be explosive); call Fire Dept. immediately.
The County of San Luis Obispo performs periodic testing and proper
removal of these temporarily stored substances.
