McCluskey, Public Works Director Prepared by: Jerry Kenny, Supervising Civil Engineer SUBJECT: Public Hearing to establish Underground Utilities District 13 (Santa Rosa St. & Foothill Blvd.) CAO RECOMMENDATION: Introduce an ordinance to print, amending Section 13.12.040 of the Municipal Code to establish Underground Utilities District 13. DISCUSSION: The City has been actively engaged in undergrounding overhead utility lines using Public Utilities Commission (PUC) Rule 20A funding since 1965. To date, eleven (11) districts have been completed and District 12 was recently established in conjunction with the Jennifer Street bridge. Underground conversion projects have followed a"priority list', adopted by the City Council and the list was recently revised to add the Osos/Jennffer Street project. [See attached Resolution No. 8471 (1995 Series)]. This project is the next highest priority project. The preliminary district boundary was modified somewhat to add the block between Broad St and Ferrini Rd. on Foothill Blvd., which is a more logical terminus, according to PG & E and also eliminates more overhead wires along that corridor. In addition,the boundary was meandered to include only those overhead facilities that cause the most obvious clutter to the corridors and not those properties that receive overhead service from "less conspicuous" rear yards, etc. All of Santa Rosa Park is included in the district. This was considered as an option in prior considerations by the Council and is estimated to cost about$25,000 more than the amount to underground only the primary transmission wires that traverse the park. Staff feels this would be desirable from an aesthetic point of view and is an allowed expenditure of Rule 20A funding, according to PG & E. Procedures for underground utility districts are prescribed in Chapter 13.12 (Underground Utilities) of the Municipal Code. The respective utility companies and affected property owners have been notified of this public hearing by map and newspaper advertising. After hearing testimony and If the Council finds that the district should proceed, it must pass to print an ordinance,in accordance with the regulations. Final passage of the ordinance is tentatively scheduled for February 20, 1996. The ordinance provides a written description of the district and establishes the time by which all overhead utilities must be removed. The schedule has been coordinated with the various utility companies and is acceptable to them. This is a particularly complex district, according to the utility companies, and the preliminary schedule was extended due to their design schedule and current priorities. [twill also include coordination and processing of CalTrans permits, since Santa Rosa St is a State Highway. There are sufficient'Rule 20A' funds available to do this project, as noted below under Fiscal Impact. Additionally, fifteen thousand dollars ($ 15,000) is included in the 1996-97 Financial Plan to cover City costs associated with the district. Property owners will be required to make any necessary modifications to their own utility service connections to receive underground service at their own cost. This could vary from a hundred to a thousand or more dollars, depending on the points of connection,types of existing equipment and distance from the new utility mains. The utility companies will provide for a maximum of 100 ft. of conduit runs from the mains, as part of the district cost. Specific details will be worked out at a later date, which will be coordinated with the utility companies and City staff. This will be discussed in letters to be sent by staff after finalization of the district. ALTERNATIVES: The Council may add to or delete portions of the district, such as: 1. Add the portion of Foothill Blvd. between Santa Rosa and California Boulevard. The cost of this portion Is very high, complicated (per PG & E) and is estimated to cost an additional$340,000, due to the existence of 2 separate circuits. 2. Delete Santa Rosa Park. However, staff was directed by a prior Council to include the park and staff feels the expenditure of the estimated $25,000 is justified due to the enhanced park atmosphere that will result. FISCAL IMPACT: Current Rule 20A Funds Available (1995) (approximate) 855,000 1996 allocation (approx.) 230.000 Total available funds (approx.) $ 1,085,000 Allocated Rule 20A funds committed for Dist. 12 50,000 Balance available for Dist. 13 (approx.) $ 1,035,000 Estimate of cost for Dist. 13 $ 870,000 Less Rule 20A funding - 855.000 City cost $ 15,000 Approximately 80 hours of staff time is expected to complete this project. (1996 Series) AN ORDINANCE OF THE CITY OF SAN LIIIS OBISPO AMENDING SECTION 13.12.040 OF THE SAN LIIIS OBISPO MUNICIPAL CODE TO ESTABLISH UNDERGROUND DISTRICT 13. WHEREAS, the City of San Luis Obispo wants to improve the image and appearance of the City by placing all overhead utilities (for electri- city, telephone and Cable TV) underground in various highly visible land use zones; and WHEREAS, the City's adopted management policies focus on major entryways, streets scheduled for widening and large new developments as prime locations for placing overhead utilities underground; and WHEREAS, Santa Rosa Street (State Highway 1) , Foothill Boulevard and Santa Rosa Park are highly visible land use zones, and/or gateways to the City; and WHEREAS, this district is the City's next highest priority of proposed underground conversion projects. NOW THEREFORE BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. The following subsection 13 of Section 13. 12. 040 of the San Luis Obispo Municipal Code is hereby amended to establish Underground District 13: 1113 . (see attached boundary description, "Exhibit A") " "Property owners shall be ready to receive service by July 15, 1997. " "Overhead electric wire facilities shall be removed from public property by October 15, 1997. "Overhead telephone and cable television facilities shall be removed by December 15, 1997. This ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage in the Telegram-Tribune, a newspaper published and circulated in the City and shall go into effect at the expiration of thirty (30) days after its final passage. It was my thought that it would be beneficial for the Council to actually see examples of how the proposed setbacks might apply in different situations before the meeting.
