DISCUSSION: Background: With the continuous inquiries as to participation in Farmers' Market, the BIA must maintain rules which sustain the event as a promotion for downtown businesses. The original purpose of the event was to promote downtown San Luis Obispo businesses. This purpose must constantly be re-informed through the application of the TNA Rules and Regulations. The Business Improvement Association wishes to strengthen the current TNA Rules and Regulations with the following changes. SECTION 2, Definitions: Business Hours - are consecutive hours of operation for consecutive days during a business week. Minimum hours of operation are five consecutive days for five consecutive hours per day. An example could be Monday - Friday . (10:00 a.m.- 3:00 p.m.). This change is being presented due to the fact that the current rule is extremely vague and open to various forms of interpretation. The BLAfeels that TNA is a privilege for those businesses who devote their time and energies to the continued success of Downtown San Luis Obispo. The purpose of the change is to protect those businesses operating on a consistent basis in the Downtown. Understanding that such a change in the rules and regulations will affect certain businesses already involved in TNA, the TNA Committee has passed a 120 day grace period for all businesses to come up to the standards in the revised rules and regulations. SECTION 7, Entertainment: Rule 7E - Entertainers may be subject to appropriate fees. Entertainers may passively ask for donations, but may not actively solicit money. Entertainment is one of the many areas that makes TNA unique. The BIA asks that entertainers accept donations without heavy solicitation. 7-! ����M���►►►�IINIII�IhII�IN City Or San . .is OBISPO MOGe COUNCIL AGENDA REPORT SECTION 15, Member Barbecues: New 15 -All barbecuers must have a business and full service commercial kitchen within the BIA boundaries. (NOTE: ADDITION OF THIS RULE WILL CHANGE THE LETTER SEQUENCE IN SECTION 15 OF THE ACTUAL REVISED RULES). Barbecuing is a highly demanded trade during TNA. The BIA believes that all restaurants in downtown should be eligible,for the barbecue wait list. 77iis rule would prevent a nonfood related business from barbecuing during TNA. Rule 15H: All LPG and/or open flame devices shall be UL listed or meet NFPA Pamphlet #58 Standards and be approved by the Fire Department prior to the event. All open flame devices shall be separated from the public by a barrier (i.e. cones, pots and flags, etc.) LPG containers shall not be located any closer than fifty (50) feet from barbecues or open flame device and are limited to five gallon maximum size, with no cylinder exchanges being allowed during an event. Each LPG container shall be secured to prevent falling. Both LPG and/or open flame devices shall be provided with an approved/serviced fire extinguisher (minimum 2Al0BC). The Event is limited to no more than (1) LPG per 50(14W)feet in proximity to each other (approximately 4 per event). theFe is a waiting list. All such devices need both appliance and Fire Department approval, and must comply with Fire Department guidelines. Health Department approval is required for restaurant use. 77ie demand for LPG(Propane) is great during TNA. There are member businesses who have been on the waiting list for quite some time. The BIA believes that an LPG opening at TNA should go to the member that is on the top of the waiting list. Rule 15M: A waiting list of members who wish to barbecue or use an LPG device is kept in the BIA office. Any space that becomes available will be reserved for the member at the top of that list. Apgfieants To be placed on the waiting list, a member shall file a TNA application and the member must show that they are qualified in all respects-in BFderto be plaeed on the waiting hs . The BIA would like to require a written, dated application for the TNA committee to have on file. 77iis application would provide the BIA with vital information concerning the eligibility of certain businesses to have a barbecue or LPG device. Rule ISN: Barbecuers and LPG users are required to participate every Thursday unless the event is canceled due to weather. Failure to participate will cause the permit to be reviewed by the committee. The demand for LPG(Propane) is as great as barbecues for TNA. The BL9 would like to treat the LPG users as our barbecuers because of the demand for such materials. SECTION 17 - General Rules For Participants: Rule 17G: BIA participants must have proof of insurance with limits of $500,000 minimum and worker's compensation insurance for all employees. Participants are required to have their insurance carrier notify the BIA staff in writing of their insurance status. The BL4 believes that all employees that work during TNA deserve the right to be compensated in case of injury. CONCURRENCE: The revised rules and regulations have been approved by the Thursday Night Activities/Farmers' Market Committee and BIA Board of Directors. FISCAL IMPACTS: No fiscal impact is represented by these changes. ATTACIII ENTS• Resolution for Revised Rules and Regulations 7.3 RESOLUTION NO. (1996 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING BIA RULES AND REGULATIONS FOR THURSDAY NIGHT ACTIVITIES WHEREAS, the original purpose of Thursday Night Activities was to promote Downtown San Luis Obispo businesses; and WHEREAS, this purpose must be constantly reinforced through the application of Thursday Night Activities Rules and Regulations; and WHEREAS, the Business Improvement Association wishes to strengthen the current Thursday Night Activities Rules and Regulations. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of San Luis Obispo as follows: SECTION 1. Resolution 8335(1994 Series) is hereby rescinded. SECTION 2. That the BIA Rules and Regulations for Thursday Night Activities, attached hereto marked exhibit 'A" and incorporated herein by reference, have been reviewed and are accepted. Recommended changes shall be made from time to time by the BIA Board of Directors for subsequent Council approval.
