Jonas, Community Development Director "e@ Prepared By: Ronald Whisenand, Development Revievld SUBJECT: Downtown Physical Concept Plan Study Session CAO RECOMN ENDATION: Receive input from members of the former Downtown Physical Concept Plan Design Committee (Committee) with regards to future land use and design considerations for the Court Street block, and direct staff to make changes to the Downtown Physical Concept Plan as appropriate. DISCUSSION Background On September 19, 1995, the Council received the Planning Commission's bi-annual report on the City's Downtown Physical Concept Plan. Following staff's presentation and Council discussion, the City Council voted 3 to 2 to accept and implement the Planning Commission's recommendations which included: 1. Continued discussion with property owners to identify feasible improvement projects for the lower Higuera Street area; 2. Modifying the plan to show the Court Street parking lot redeveloped with a substantial public park/plaza. Mixed-use public buildings would be allowed only if incidental to the park; 3. Adding a footnote to property development standards to indicate that additional setbacks may be required to comply with provision of adopted City plans; and 4. Continued review of all capital improvement projects for consistency with the Downtown Plan and to include Downtown Plan implementation in the Capital Improvement Program. Since that meeting, members of the Committee have raised concerns over changes made in the land uses now planned for the Court Street block. Committee members believe that the block is a "valuable urban resource which would be underutilized if wholly devoted to a park." They have requested this opportunity to address the Council concerning issues surrounding the adopted change in plan direction. SIX In late 1990, the City Council authorized the preparation of a downtown plan and directed the City Administrator to establish a committee of community design professionals (Design Team) who would be willing to do the work on a voluntary basis. To assist the Design Team, representatives were invited from a broad spectrum of the community to meet periodically to present representative viewpoints, offer advice and critique the plan as it developed idea by idea. �����i�►�IIIIIII�II°�°'9��11; city of San lu.i OBISPO COUNCIL AGENDA REPORT The completed design plan was presented to a joint meeting of the Planning Commission and City Council in the spring of 1992. The Council then referred the design plan to the Planning Commission and staff for more detailed analysis and public review prior to bringing the plan back to the Council for final action. The Planning Commission conducted a series of study sessions during the summer and early fall of 1992 with members of the Committee. On October 28, 1992, at a regular meeting of the Planning Commission, staff presented a summary evaluation of the plan concepts. The Commission's review concluded with direction to staff to solicit specific comments from the Architectural Review Commission (ARC), the Cultural Heritage Committee (CHC), the Parks and Recreation Commission (PRC), the City Traffic Engineer, and the public. The comments received from these groups were presented to the Planning Commission one final time along with an environmental analysis of potential impacts of plan adoption and implementation, and with unanimous Commission support, the plan was passed on to the City Council with a recommendation for approval. The plan was ultimately granted a Negative Declaration of Environmental Impact and approved by the City Council on May 4, 1993. As specified in Resolution No 8165 (attached), the City Council directed "appropriate staff and commissions to incorporate relevant components of A Conceptual Physical Plan for the City's Center into all City documents affecting future downtown development." Also as specified in the Resolution, the Planning Commission was to "review the Downtown Plan every two years and submit a report to the City Council on the status of the plan, including any recommended text or graphics revisions to keep the plan current with changes in economics, transportation technology, retailing, community tastes, and any other variables which may affect the vision of the downtown over time." The plan as initially adopted called for redevelopment of the Court Street parking lot site with a mixed-use commercial/residential building and public park/plaza. In addition to other urban design considerations, this concept was similar to ideas suggested in a 1983 Strategic Planning Program prepared by the City that explored ways to promote fiscal self-reliance and stability. One of the methods explored in the strategic plan was to allow private redevelopment of City property such as the Court Street parking lot for commercial land uses. Planning Commission Bi-Annual Review On June 28, 1995, the Planning Commission held a hearing to review the Downtown Plan and determine whether changes in community values warranted plan modification. Among several changes recommended by the Commission, was a proposal to change the mixed-use building and public park/plaza proposed for the Court Street block to a "substantial public park/plaza." The Commission indicated that public buildings, occupied by uses such as child care and public art displays could be included in the project provided they were clearly incidental to the park. /-2 �����i ��lllllllllll°Nu°��UIII city or Sa. _ LUIS OBISp0 ==11MO COUNCIL AGENDA REPORT There was not an extensive amount of discussion by the Commission or the public on the desired change. The Commissioners who initially raised the design alternative stated that a park would compliment Mission Plaza. The five Commissioners who were present and able to act on the matter, agreed with the recommended design change. Committee Comments Members of the Committee have requested Council reconsideration of the change to the Court Street plaza. Committee members believe that the change is not "in character" with the remainder of the plan which was carefully developed to balance park/plaza areas with commercial, office, and residential land uses. A summary of the Committee's concerns is contained in the attached letter dated December 21, 1995. In summary, the Committee raises the following issues for Council consideration: • A park in this location runs counter to the discussion and evaluation given to this area in the preparation of the Downtown Design Plan. The principle of a 'bipolar' open space system was already developed into the plan with Mission Plaza as the "anchor" on one end and the proposed County Courthouse/Public Plaza on the other. In addition, the Committee felt that the area was ideally suited for providing the mixed residential/office/commercial space desired in the downtown core. • The location of a park here will not add significantly to the economic vitality of the downtown. Committee members point out that the economic vitality of the downtown was one of the prime objectives of the plan. Committee members have stated that one of the reasons mixed use redevelopment of the site was proposed in the first place, was to provide additional commerciallo ice/residential space lost with the expansion of Mission Plaza. • A park in this location has not been designated in existing General Plan elements. The Committee believes that General Plan policies support 'commercial"rather than dark" use in this area. • Cost-Benefit to the City of San Luis Obispo. The Committee feels that the original concept would provide a more viable downtown in the long term. ALTERNATIVES 1. Reaffirm Council action of September 19, 1995 to designate the Court Street block for a community park/plaza with complimentary but incidental mixed use public buildings to occupy the site. 2. Direct staff to change the Court Street block back to a "mixed-use building and public park/plaza" as previously contained in the Downtown Physical Concept Plan. 3.
