McCluskey, Public Works Director/ ,) Prepared by: Reinie Gwin, Transportation Technician Y SUBJECT: Public Hearing for the Proposed Program of Projects and Application for the Federal Transit Administration Urbanized Area Assistance CAO RECOMMENDATION: Adopt a resolution authorizing staff to apply for a Federal Transit Administration (FTA) formula grant in the amount of $1,202,300 to be used for operating and capital expenses. BACKGROUND: The City has been receiving FTA formula grants for operating and capital assistance since 1992 when the City was classified as an urbanized area. In applying for these grants, the City has agreed to meet several federal requirements, one of which is publishing and holding public hearings on proposed programs of projects. The program of projects shows projected SLO Transit expenses for fiscal year 1995/96 with a breakdown of FTA participation and local match (Transportation Development Act money) required. The 1995/96 program of projects includes operating assistance, the purchase of three new buses and bus stop improvements for a total cost of$2,171,100 with a federal share of$1,202,300. In November 1995 the City received the FTA Annual Apportionment Notice showing that the City is eligible to apply for formula grant assistance up to $520,478 for fiscal year 1995/ 96. Since the City has not spent all of the previous years apportionments, a carryover of$1,856,123 is available. Some of this carryover money is being used to fund this application. To apply for this grant money, a resolution authorizing the Public Works Director to execute the grant agreement is needed. In authorizing the grant agreement the City agrees to make annual certifications to comply with civil rights, procurement procedures and substance abuse. After this application $1,175,000 will remain as carryover to be used in future grant applications for both operating and capital. FISCAL IMPACT: Because of the uncertainty of federal and state revenue, the current budget is different from the program of projects. When the grant is approved, staff will return to Council with a request to adjust expenditure and revenue budgets so that they conform to the program of projects. Transportation Development Act funds will provide $968,800 "local" match to the grant funds. (1996 Series) A RESOLUTION BY CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO AUTHORIZING THE FILING OF APPLICATIONS WITH THE FEDERAL TRANSIT ADMINISTRATION, ON OPERATING ADMINISTRATION OF THE UNITED STATES DEPARTMENT OF TRANSPORTATION, FOR FEDERAL TRANSPORTATION ASSISTANCE AUTHORIZED BY 49 U.S.C. CHAPTER 53, TITLE 23 UNITED STATES CODE, AND OTHER FEDERAL STATUTES ADMINISTERED BY THE FEDERAL TRANSIT ADMINISTRATION. WHEREAS, the Federal Transportation Administrator has been delegated authority to award Federal financial assistance for a'transportation project; WHEREAS, the grant for Federal financial assistance will impose certain obligations upon the City of San Luis Obispo, and may require the City of San Luis Obispo to provide the local share of the project cost; WHEREAS, the Applicant has or will provide all annual certifications and assurances to the Federal Transit Administration required for the project; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of San Luis Obispo, 1. That City of San Luis Obispo is the Designated Recipient as defined by 49 U.S.C. 5307(a)(2) and that the Director of Public Works is authorized to execute and file an application for Federal assistance on behalf of the City of San Luis Obispo with the Federal Transit Administration for Federal assistance authorized by 49 U.S.C, chapter 53, Title 23, United States Code, or other Federal statutes authorizing a project administered by the Federal Transit Administration. 2. That the Director of Public Works is authorized to execute and file with its applications the annual certifications and assurances and other documents the Federal Transportation Administration requires before awarding a Federal assistance grant. 3.
