CAO RECOMMENDATION Concur with the Community Development Director's determination to allow the KSBY proposal to determine the date of the Planning Commission's fourth hearing period for the introduction of Land Use Element amendments. DISCUSSION On February 16th, 1996 the City Council was sent a letter from KSBY describing their desire to relocate their offices from the present Hill Street location to 1772 Calle Joaquin, the site of the former Loco Ranchero Restaurant. On February 20th, the Council referred the letter to staff for review and recommendation. Earlier, staff discussed the reolcation with KSBY and informed them that the move would require an amendment to the Land Use Element's (LUE's) current land use designation of the property as well as a rezoning. The Municipal Code (17.80.050) directs that the Planning Commission may introduce amendments to the LUE in January, May, and September, with one additional "floating" time per calendar year to be determined by the Community Development Director. KSBY has indicated that their opportunity to move to the Calle Joaquin property is dependent on proceeding as quickly as possible. They have indicated that waiting until May to begin Planning Commission consideration could render the relocation infeasible. KSBY has therefore requested that the Community Development Director allow their request to determine the time of the "floating" LUE amendment introduction. The Community Development Director has determined that KSBY's proposal would be an appropriate use of the "floating" LUE introduction. The item is being brought to the Council's attention for their concurrence with the Community Development Director's decision. FISCAL IMPACTS Private applicant requests for General Plan amendments are processed on a fee basis. The fee covers a portion of the costs for staff time and resources needed to process the amendment request. ALTERNATIVES The Council may direct that the proposed LUE amendment would not be an appropriate use of the "floating" amendment date for calendar year 1996. ATTACE51ENTS: 1. Due to timing imperatives, KSBY is requesting that the City use the annual "floating request" for the needed General Plan amendment so their application can be processed without having to await the next "batch" of amendments. I am asking that the City Council refer this request to staff, and direct staff to return with a recommendation concerning their request on the March 5, 1996 Council meeting. The staffs recommendation would relate only to the General Plan amendment process ("floating request"). The actual processing of the General Plan, amendment, zone change, and project applications would follow the usual course through the Planning Commission, ARC, and Council. This relocation has 2 positive effects for the community:. 1. It enables KSBY to relocate from its current location in a primarily residential neighborhood on Hill Street. 2. The relocation provides a more functional and attractive utilization of the former restaurant building. On December 31, 1996 it is imperative that we have a new location for our signals and technical equipment. Our separation from KES'3W N in Salinas, from where we currently receive our signal, will be completed.
