HomeMy WebLinkAboutItem 6f - Appropriation of CUPA and ISA Funds for Expenditures Related to their Activities Item 6f Department: Fire Cost Center: 8503 For Agenda of: 10/20/2026 Placement: Consent Estimated Time: N/A FROM: Randy Harris, Fire Chief Prepared By: Nicole Vert, Business Analyst SUBJECT: APPROPRIATION OF CUPA AND ISA FUNDS FROM PREVIOUS YEARS FOR EXPENDITURES DIRECTLY RELATED TO THEIR ACTIVITIES RECOMMENDATION 1. Appropriate up to $71,000 for the Fire Department to use Certified Unified Program Agency (CUPA) Enforcement Funds for expenses directly related to CUPA activities; and 2. Appropriate up to $11,493.88 from the Instructional Service Agreement (ISA) between the Fire Department and Alan Hancock Community College for training related expenditures. POLICY CONTEXT The recommended actions are consistent with the City of San Luis Obispo’s Charter, which provides that the Council has sole responsibility for adopting the City budget and may amend or supplement the budget at any time after its adoption. After budget adoption, all supplemental appropriations from fund balance or working capital require Council approval. The California Health and Safety Code Section 25404.1.1(i) provides that “all administrative penalties collected shall be paid to the CUPA (described more fully below) that imposed the penalty and shall be deposited into a special account that shall be expended to fund the activities of the CUPA in enforcing this chapter.” Section 2.4 of the Instructional Service Agreement (ISA) with Alan Hancock Community College entered into in July 2024 for mutual training be nefits states “Agency shall use 100% of the money received as compensation for services under this contract for the purpose of providing the direct cost of instruction and training to the students enrolled in its courses.”” (Attachement B) Page 97 of 210 Item 6f DISCUSSION CUPA In 1993, Senate Bill 1082 (Health and Safety Code Chapter 6.11) required the Secretary of the California Environmental Protection Agency (Cal/EPA) to establish a “unified hazardous waste and hazardous materials management” regulatory program (Unified Program). Counties in California were required to apply for CUPA certification by January 1, 1996. San Luis Obispo County complied and established the CUPA program in 1996. CUPA programs consolidate permitting, inspections, reporting and enforcement for six environmental and hazardous materials programs. These six programs are Hazardous Materials Business Plans, Hazardous Materials Management Plans/Hazardous Materials Inventory Statement, Underground Storage Tanks, Hazardous Waste Generator and Hazardous Waste Treatment, Aboveground Petroleum Storage Act, and California Accidental Release Prevention. The City is a participating member of the CUPA program and staffs an inspector to manage and carryout the program within the city. The inspector performs annual on-site inspections, issues permits, documents conditions, and verifies compliance. The program charges fees to the organizations being inspected and permitted to offset the cost of administering the program. Fines are assessed when noncompliance is found. Fines from noncompliance are not budgeted as this activity is unpredictable. The City has established a special fund for the collection of penalties. Funds in this account may be used for limited purposes directly related to CUPA activities, including, but not limited to, equipment and training. This fiscal year, it is recommended that the funds be appropriated for a replacement vehicle, out of town training, and equipment necessary for the CUPA inspector. ISA Community Colleges and public safety departments in California have the ability to enter Instructional Service Agreements with each other to create and track training specific to the industry that benefits both parties. Under this agreement certain categories of regular Fire Department training qualify for State reimbursement. Some of this training also qualifies for college credit. When employees participate in training that meets the college’s instructional requirements, they receive college credit and are counted as students in the college’s instructional program. The college oversees academic requirements and reports eligible training to the State, while the Fire Department provides training facilities and personnel with the expertise to deliver the instruction. The Department tracks employee participation in eligible training, and the college submits the required information to the State at the end of each semester. Both the college and the Department may receive reimbursement for eligible instructional costs. This reimbursement must be used to support the training program and cover the costs of providing the training. The City of San Luis Obispo Fire Department established an ISA with Alan Hancock Page 98 of 210 Item 6f College in July 2024. In FY 2025-26 the Fire Department received $11,493.88 from this agreement. The payments from the Spring semester arrives at the end of the fiscal year and cannot be expended prior to the end of the year. The funds have not been included in the budgeting process due delayed timing of the agreement and reimbursement amounts varying depending on qualifying training activities. To spend the revenue, department needs Council to appropriate the funds. The funds will be used for equipment used by the department for training activities that wears out from repeated use. Previous Council or Advisory Body Action On October 22, 1996 Council approved the County’s request for the City to be a Participating Agency in the CUPA program. Public Engagement This item is a consent item for the October 20, 2026, City Council meeting and will follow all required postings and notifications. The public will have an opportunity to comment on this item at or before the meeting. ENVIRONMENTAL REVIEW The California Environmental Quality Act (CEQA) does not apply to the recommended action in this report, because the action does not constitute a “Project” under CEQA guidelines Sec. 15378. FISCAL IMPACT Budgeted: No Budget Year: 2026-27 Funding Identified: Yes Fiscal Analysis: Funding Sources Total Budget Available Current Funding Request Remaining Balance Annual Ongoing Cost General Fund $11,493.88 $11,493.88 $0 $0 State Federal Fees Other: CUPA Enforcement fund $73,896 $71,000 $2,896 0 Total $85,389.88 $82,493.88 $2,896 $0 The CUPA fines fund currently has a balance of $73,896. As the CUPA inspector performs normal duties within the job, expenses arise that range from office supplies to travel or education. The enforcement fines can be used in a narrow scope of supporting Page 99 of 210 Item 6f those activities and provide relief to City funds. The department is requesting to use up to, but not more than $71,000 this fiscal year for a replacement vehicle, equipment, and out of town training. The Fire Department received $11,493.88 in ISA reimbursement funds during FY 2025 - 26. This money is now in fund balance and staff’s recommendation is to appropriate the funding. As equipment is used for training purposes it wears out and is damaged. These funds will be used in accordance with the contract to replace training related equipment throughout the fiscal year. ALTERNATIVES 1. Council could deny the budget appropriation requests. Denial will delay purchases of equipment related to and necessary to complete training and CUPA related duties. or Company) may be required by law to provide to you certain written notices or disclosures. Described below are the terms and conditions for providing to you such notices and disclosures electronically through your DocuSign, Inc. (DocuSign) Express user account. Please read the information below carefully and thoroughly, and if you can access this information electronically to your satisfaction and agree to these terms and conditions, please confirm your agreement by clicking the 'I agree' button at the bottom of this document. Getting paper copies At any time, you may request from us a paper copy of any record provided or made available electronically to you by us. For such copies, as long as you are an authorized user of the DocuSign system you will have the ability to download and print any documents we send to you through your DocuSign user account for a limited period of time (usually 30 days) after such documents are first sent to you. After such time, if you wish for us to send you paper copies of any such documents from our office to you, you will be charged a $0.00 per-page fee. You may request delivery of such paper copies from us by following the procedure described below. Withdrawing your consent If you decide to receive notices and disclosures from us electronically, you may at any time change your mind and tell us that thereafter you want to receive required notices and disclosures only in paper format. How you must inform us of your decision to receive future notices and disclosure in paper format and withdraw your consent to receive notices and disclosures electronically is described below. Consequences of changing your mind If you elect to receive required notices and disclosures only in paper format, it will slow the speed at which we can complete certain steps in transactions with you and delivering services to you because we will need first to send the required notices or disclosures to you in paper format, and then wait until we receive back from you your acknowledgment of your receipt of such paper notices or disclosures. To indicate to us that you are changing your mind, you must withdraw your consent using the DocuSign 'Withdraw Consent' form on the signing page of your DocuSign account. This will indicate to us that you have withdrawn your consent to receive required notices and disclosures electronically from us and you will no longer be able to use your DocuSign Express user account to receive required notices and consents electronically from us or to sign electronically documents from us. All notices and disclosures will be sent to you electronically Unless you tell us otherwise in accordance with the procedures described herein, we will provide electronically to you through your DocuSign user account all required notices, disclosures, authorizations, acknowledgements, and other documents that are required to be provided or made available to you during the course of our relationship with you. To reduce the chance of you inadvertently not receiving any notice or disclosure, we prefer to provide all of the required notices and disclosures to you by the same method and to the same address that you have given us. Thus, you can receive all the disclosures and notices electronically or in paper format through the paper mail delivery system. If you do not agree with this process, please let us know as described below. Please also see the paragraph immediately above that describes the consequences of your electing not to receive delivery of the notices and disclosures electronically from us.
