SUBJECT: RENOVATIONS TO SANTA ROSA PARK MULTI-USE COURT AREA
BY YMCA
CAO RECOMMENDATIONS:
1. By motion, approve and authorize the Mayor to execute an agreement with the San Luis
Obispo County YMCA to improve the Santa Rosa Park multi-use area for use by the
YMCA's Roller Hockey Program.
2. By motion, approve the allocation of$9,000 from the Youth Field Improvement Capital
Improvement Fund to the YMCA for completion of the project.
DISCUSSION:
Background:
und:
Roller hockey is one of the fastest growing sports in the nation (Attachment 1) and interest has
definitely "arrived" on the Central Coast. A program has been established at the Paso Robles
Fairgrounds, Morro Bay has just completed an outdoor rink in one of its parks, Arroyo Grande
has converted outdoor courts, and skating facilities are in various stages of planning in Grover
Beach and Atascadero.
In SLO, during most of 1995, the YMCA worked with the San Luis Coastal Unified School
District on a project to renovate tennis courts at the "old" junior high school for use as a roller
hockey rink for the YMCA's youth program. The program, which serves boys and girls ages 6-
14 years old, does not now have an appropriate or permanent facility. Currently, the program is
offered at Laguna Middle School using a makeshift rink that is set up and taken down on each
game day. The rink is primarily constructed of discarded coffin crate lids. Laguna Middle
School will no longer be available to the program after the spring season due to construction at
the site.
The effort to secure the old San Luis Junior High School site was complicated and delayed by
unexpected and intense neighborhood opposition to the project. Consequently, in January 1996
the YMCA approached the City with a proposed joint venture to modify the existing multi-use
area at Santa Rosa Park for a roller hockey site. The proposal was referred by Council to staff
for review and recommendation.
While the School District eventually approved the old junior high school site (on February 6), the
YMCA prefers to continue to pursue the project with the City. This is because, in the effort to
satisfy the neighbors, the allowed use at the old junior high site became very constrained and only

temporary in nature (up to 2 years). In addition, the YMCA would rather not offer a youth
Program in an atmosphere where it may be uncomfortable to play the games.
Staff believes that the partnership with the YMCA also offers many benefits to the City (as
described later), and therefore an agreement to complete the project is recommended by staff.
erect Concept and Proposed Oner� Ag P meat•
Following Council referral of the YMCA proposal to staff, a task force was established to further
review and refine the proposal. This task force consisted of YMCA representatives Deborah
Quaglino, John Rossetti, and Sandra Maez, and City staff members Rich Colombo, Mike Ramsey
and Linda Fitzgerald. Based on this joint effort, the YMCA is proposing to make the following
improvements to the court area:
• Enclose the court area and skateboard ramp area with eight foot high chainlink
fencing, coated in black vinyl;
• Install two foot high boards along the base of the fence in the court area for roller
hockey purposes;
• Resurface the playing area with a multi-use surfacing material similar to a tennis
court surface, and stripe the basketball courts (presently unstriped);
• Pour two concrete pads for relocation of the skateboard ramp and storage
containers;
• Pave a 3 lh -6 foot walkway around the entire court area.
In order to complete these improvements, a portion of the junipers on the northeast and southeast
corners of the court will be removed, along with a section of concrete curb along the east side of
the court area. Irrigation lines and sprinkler heads affected by project will also need to be
modified.
In terms of the proposed operating agreement, maintenance of the new fencing, boards, and court
surface will be largely the responsibility of the YMCA while the City will continue to maintain
the lights and clean the court surface on a regular schedule. After the City's programs, the City
will allow the YMCA priority use to accommodate roller hockey league play. Currently, the
YMCA offers its program three seasons per year — ten Saturdays in the fall and spring, and on
Tuesday and Thursday evenings during the five week summer season. Practices are also held at
different times during these seasons. Hours of YMCA use will need to be worked around the
current skateboard program, which will have priority as a City program.
Other Project Benefits:
A significant amount of time will be available for use of the courts by other City residents or
teams that play roller hockey. Already, over the last six months, the Parks & Recreation
Department has seen an increase in roller hockey activity on the site because the court dimensions
are similar to a hockey rink. The project will not only serve these users, but may also help
relieve pressure at other city parks where roller hockey is played on surfaces inappropriate for
such use.

The project also offers benefits to other City programs. Currently, the multi-use area is the•home
for the Parks & Recreation Department's successful skateboarding program and the Little
Hoopsters basketball program. Other uses have ranged from dog obedience classes to drop-in
basketball play. This joint project will benefit these programs, which is why, for example, the
skateboarding program managers have been in support of the concept since it was introduced.
The improvements also add the potential for a wheelchair basketball program as the enclosed area
will confine the ball to the court.
Impact on Earlier Sinsheimer Concept:
Several months ago, the Council conceptually endorsed the use of property behind the Sinsheimer
baseball field for a roller hockey facility. Such a project will be much more costly and
complicated to develop, and it will therefore take a period of years before it is feasible. The use
of Santa Rosa Park in the interim will provide the YMCA program with the opportunity to grow,
and thus have a greater capacity to proceed on the larger project. If in the meantime a private
rink is built in the City, or the YMCA fords Santa Rosa to adequately meet its youth
programming needs, then the Sinsheimer location can be used for some other park or recreation
use. Therefore, the use of Santa Rosa Park should be thought of as longer-term in nature.
CONCURRENCES:
In early February, the YMCA mailed letters to approximately 25 property owners and hand-
carried letters to about 70 residents living next to the park (Attachment 2). No comments,
positive or negative, have been received by the Parks & Recreation Department or the YMCA.
The Parks & Recreation Commission has reviewed and endorsed the project on two occasions.
At their meeting on February 7, 1996 to project was conceptually approved and on March 6th,
after reviewing more detailed project drawings, the project was approved again. The project was
also reviewed and approved by the Advisory Committee on Joint Recreational Use of School
District Property on February 27, 1996.
Project plans have been submitted by the YMCA to the Community Development Department,
which will conduct its usual review once use of the site is approved. With Council approval of
the agreement, the project will be initiated once CDD review is completed and a permit is issued.
FISCAL IMPACT:
The total estimated cost of the project is approximately $30,000. $9,000 is presently available in
the current Youth Field Improvement Capital Improvement Fund. The Joint Use Committee's
concurrence on this project includes a recommendation that the $9,000 be allocated to the
renovation, since the City also derives a number of benefits from the project_ In addition, the
City shall be responsible for installing the portion of the fencing that surrounds the skateboard
ramp, since this improvement has been requested by managers of the City's skateboard program,
and serves only that program. Funding for the fence is available within existing resources
(<$2,000).

The remainder of the project costs will be borne by the YMCA through community donations and
volunteer assistance. Currently, donations have been made by local businesses and others and total
nearly $13,000 (Attachment 3). These donations were originally made when it was assumed that
permanent "hockey boards" would be used for advertising. However, since such advertising is
not allowed in City parks, once use of the site is assured, the YMCA will propose to its donors
an alternative banner advertising program. Under this program, banners will be hung for each
game day, and then removed at the end of the day. The YMCA believes that this alternative will
be acceptable to most donors, since contributions were made more in the spirit of helping the
program than in anticipation of major advertising benefits.
Since the project applicant is the YMCA, donated labor and volunteers will also be used to
complete the project within available resources. Neighborhood opponents to the old junior high
school have also indicated a willingness to assist in the effort, and may contribute both financially
and in other ways. Thus, the project represents a true partnership involving a public agency, a
non-profit organization and its volunteers, businesses, and private citizens.
No major fiscal impact is foreseen in maintenance of the improved facility, since the YMCA will
be responsible for costs related to their program.
ALTERNATIVES:
Should the Council deny or take no action on the YMCA's request for improving the Santa Rosa
Park multi-use area, then their alternative is to develop the tennis courts at the old San Luis
Junior High School. As mentioned earlier, it is the YMCA's desire to not pursue this alternative
since use will be quite restricted and only temporary. If the project were not to proceed, the City
would lose the benefits resulting from this joint venture, as described earlier.

As you might know, the paved surface at Santa Rosa Park is presently used for

The YMCA wishes to complete this project with the City in order to provide an

AGREEMENT
THIS AGREEMENT, executed this day of 1996, by
and between San Luis Obispo County YMCA, a non-profit organization,
(hereinafter called YMCA) and the City of San Luis Obispo, a municipal
corporation (hereinafter called CITY) .
WITNESSETH:
WHEREAS, YMCA proposes to improve the multi-use court area at Santa
Rosa Park, and
WHEREAS, City recognizes the need for youth athletic facilities in the
San Luis Obispo community, and
WHEREAS, YMCA provides a community-based roller hockey program for
youth: and
WHEREAS, City does not provide a roller hockey program, and
WHEREAS, City owns, maintains and operates Santa Rosa Park as a
community park, and
WHEREAS, the' City is authorized to grant use of park space for
community recreation purposes when such use does not interfere with City' s
use for said purposes, and
WHEREAS, City has determined that partnerships with community
organizations to provide services to the community are of great benefit;
NOW THEREFORE, in consideration of their mutual promises, obligations
and covenants hereinafter contained, the parties hereto agree as follows :
1. The City shall be the Administrator of such agreement.
2 . That the YMCA shall make the following improvements to the Santa Rosa
Park multi-use court area:
a. Enclose the court area with eight foot high chain link fencing
and access gates;
b. Install two foot high boards along the base of the fence for
roller hockey purposes;
C. Resurface the playing area with a multi-use surfacing material;
d. Remove junipers on the northeast and southeast corners of the
court;
e. Remove 15 feet (minimum) of concrete curb on east side of court
area.
f. Relocate irrigation lines and sprinkler heads affected by
project modifications.
3. Upon completion of said improvements, the City shall make available to
the YMCA the use of the multi-use court area for the purpose of roller
hockey provided that such use does not interfere or impede with the
City' s use for community recreational purposes.
4 . The YMCA shall submit to the City, in writing, a schedule for YMCA use
of the multi-use area ninety (90) days prior to the beginning of each
season. City recreational uses and reservations shall take priority
over YMCA uses. City reserves the right to amend YMCA's schedule if
YMCA's requested usage conflicts with City recreational uses and
reservations. Said amendment shall be made no less than sixty (6o)
days prior to YMCA' s scheduled use for facility. The City reserves
the right to cancel individual use dates in the event of emergency,
hazardous conditions or inclement weather.
5 . The YMCA agrees to defend, indemnify, protect and hold City and its
agents, officers, and employees harmless from and against any and all

claims asserted or liability established for damages or injuries to
any person or property, including injury to YMCA's employers, agents
or officers which arise from or are connected with or are caused or
claimed to be caused by the acts or omissions of YMCA, and its agents,
officers or employees, in performing the work or services herein
during YMCA supervised activities or as a result of making the
improvements specified in section 2 of this agreement, and all
expenses of investigating and defending against the same; provided,
however, that YMCA' s duty to indemnify and hold harmless shall not
include any claims or liability arising from the established sole
active negligence or willful misconduct of the City, its agents,
officers or employees.
6. That the YMCA agrees to the responsibility of repair of fencing,
boards, and court surface resulting from their recreational use. City
agrees to maintain lighting equipment . located on site. Court surface
cleaning will be accomplished by City staff in accordance with their
regular maintenance schedule.
7. No improvements or alterations shall be made on the property by the
YMCA without written permission from the City except as otherwise
provided for in this agreement.
8. Permanent advertising is not allowed in this facility. Use of
temporary advertising signs shall be allowed with approval of the
Parks & Recreation Director and must be removed from view upon
completion of daily activities. Advertising material of alcohol and
tobacco products is not allowed.
9. The YMCA shall provide City with proof of liability insurance in the
amount of $1, 000, 000 with an endorsement naming the City as additional
insured on the policy. Said policy shall be in the City' s possession
10 days prior to the first use date by the YMCA and thereafter on the
first day of the calendar year and shall be valid for the entire year.
10 . The term of this agreement shall commence on
1996, and shall extend for a period of three (3) years . Upon
mutual agreement of both City and YMCA, this agreement may be extended
for additional one year terms. Such mutual agreement to extend shall
be obtained in writing prior to the expiration of the pending term.
IN WITNESS THEREOF, the parties hereto have caused this instrument to
be executed the day and year first above written.
