CITY COUNCIL POLICIES AND PROCEDURES On October 25, 2011, as part of its discussion of revisions to the Council Policies and Procedures Manual, Council voted to change its regular meeting time from 7:00 p.m. to 5:00 p.m. While that revision is reflected in the legislative draft of the manual included with the staff report for item B3, the ordinance that is necessary to effectuate the time change was inadvertently omitted from the staff report and agenda packet previously distributed. Introduce by title only an ordinance amending Chapter 2.04 of the San Luis Obispo Municipal Code to change regular council meeting start times from 7:00 p.m. to 5:00 p.m. 2. Adopt a resolution amending the City Council Policies and Procedures. DISCUSSION At a special meeting held on October 25, 2011, Council reviewed and provided direction to staff to amend the Council's Policies and Procedures Manual. The Manual covers a wide variety of matters including: procedures for scheduling special meetings, procedures for placing items on the agenda, meeting protocols and voting procedures, salary and benefits of Council Members, filling Council vacancies, applicability and penalties associated with the Brown Act, guidelines for staff regarding timely response to Council inquiries and roles of Council advisory body liaisons. The Manual represents a best management practice for governance. Having the Manual promotes fairness in that everyone has access to the "rules of the road" when it comes to City Council operations. Moreover, the Manual promotes transparency since it outlines how the City will implement the Brown Act, make documents available to the public and manage City Council meetings. The legislative draft of the Manual highlighting the recommendations for changes by Council is included as Attachment 1 and reflects staff s revisions to implement the Council's direction to modify several provisions of the manual. One of the changes directed by Council was to change the start time of regular City Council meetings from the current 7:00 p.m. start time to an earlier 5:00 p.m. start time in an effort to encourage greater public participation in Council meetings. Pursuant to City Charter Section 502, that modification to the regular meeting start time must be made by ordinance. Accordingly, included with this report is an ordinance amending Section 2.04.010 of the City's Municipal Code to provide for the new start time. If introduced at the January 3, 2011 Council meeting, the ordinance could be finally adopted on January 17, 2011 and the new meeting time would become effective prior to the Council's February 21, 2011 meeting. FISCAL IMPACT There is no fiscal impact anticipated by the adoption of the revised Council Policies and Procedures Manual. (2012 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING SAN LUIS OBISPO MUNICIPAL CODE CHAPTER 2.04 (COUNCIL MEETING) TO MODIFY REGULAR MEETING START TIMES WHEREAS, at a special meeting of the City Council held on October 25, 2011, the Council reviewed its Council Policies and Procedures and provided direction to revise certain provisions of that manual; and WHEREAS, Council desires to change its regular meeting start time from seven p.m. (7:00 p.m.) to five p.m. (5:00 p.m.); and WHEREAS, San Luis Obispo Charter Section 502 requires that the Council shall provide by ordinance for the time and place of holding its meetings. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Section 2.04.010 of Chapter 2.04 (COUNCIL MEETINGS) of the San Luis Obispo Municipal Code is hereby amended to read as follows: 2.04.010 Time — Place. The regular meetings of the council shall be held at the City Hall, 990 Palm Street, in the city, on the first and third Tuesdays of each month at the hour of five p.m (5:00 p.m.). In the event that a regular meeting of the council falls on a legal holiday, then the regular meeting shall be held at the same place and time on the next succeeding working day. (Prior code § 2100) SECTION 2. Ordinance Number 677 (1976 Series) is hereby rescinded and superseded to the extent inconsistent herewith. SECTION 3. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in The Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect at the expiration of thirty (30) days after its final passage.
