SUBJECT: An amendment to the zoning regulations that specifically distinguishes types of
commercial antennas and broadcasting facilities. Application # GP 105-95
CAO RECOMM]EENDATION
Grant final passage to Ordinance No. 1295, amending the zoning regulations text to specifically
distinguish types of commercial antennas and broadcasting facilities and note that such facilities must
comply with applicable Land Use and Open Space Element policies.
DISCUSSION
Situation
On April 2, 1996, the City Council introduced Ordinance No.1295 to print, approving the
requested zoning text changes in conjunction with approval of a general plan amendment allowing
additional radio facilities to locate on the South Street Hills. Ordinance No. 1295 is now ready
for final passage. The amendment will become effective 30 days after final passage of the
ordinance.
Significant Impacts
The City Council has adopted the initial study of environmental impact (ER 43-95) which
concludes that a Mitigated Negative Declaration will be filed for the project. No significant fiscal
or environmental impacts are anticipated.
Consequences of Not Taking the Recommended Action
If the Council does not give final passage to the ordinance, no amendment will be made to the
zoning regulations regarding antennas.

AN ORDINANCE OF THE SAN LUIS OBISPO CITY COUNCIL
AMENDING THE ZONING TEXT TO SPECIFICALLY DISTINGUISH
TYPES OF COMMERCIAL ANTENNAS AND BROADCASTING FACILITIES
GP/R 105-95
WHEREAS, the Planning Commission and the City Council have held public hearings to
consider the proposed zoning text amendment in accordance with the California Government
Code; and
WHEREAS, the potential environmental impacts of the proposed text amendment have
been evaluated in accordance with the California Environmental Quality Act and the City's
Environmental Guidelines;
NOW, THEREFORE, be it ordained by the Council of the City of San Luis Obispo as
follows:
SECTION 1. Finding_ The proposed amendment to Table 9- Uses allowed by zone in
the zoning regulations is consistent with General Plan amendment GP/R 105-95 enabling the
location of wireless telecommunication facilities inside the three-acre leasehold on South Street
Hills.
SECTION 2. Environmental Determination. The Council finds that the project's initial
study and mitigated Negative Declaration, ER 43-95, hereby incorporated into this ordinance by
reference, adequately address the potential significant environmental impacts of the proposed text
amendment to the Land Use and Open Space Elements and this related text amendment to the zoning
regulations, and reflect the independent judgement of the City Council. The Council hereby adopts
said Negative Declaration.
