Update
CAO RECOMMENDATION
Review status of the URM mitigation program and adopt revised work program.
DISCUSSION
This report provides an update on the progress of the City's unreinforced masonry (URM)
building mitigation program, established by ordinance in 1992. It summarizes the efforts
directed towards the URM issue over the past 5 years, analyzes the results to date, and
recommends a specific work program to accomplish the City Council goal of"establishing
a URM building seismic strengthening program that is not unduly burdensome."
Background on the development of the City's URM program
The adoption of Ordinance No. 1203 in 1992 established the City's current unreinforced
masonry building mitigation program. That ordinance established seismic strengthening
standards for buildings of unreinforced masonry construction and administrative regulations
requiring that all URM buildings be structurally analyzed within an 18-month period
beginning March 4, 1993. In addition, it required that any URM building subject to major
remodel or occupancy change be strengthened to the established standards.
This mitigation program was a compromise resulting from almost ten months of discussions
between staff and the Chamber of Commerce Seismic Task Force, reflecting the City's
obligation to protect the safety of its citizens and recognizing the economic impacts of such
a program There was agreement on the technical standards but not on a comprehensive
mandatory implementation schedule. Staff felt that a mandatory strengthening ordinance
requiring all URM buildings be strengthened before the year 2000 was the best
recommendation because:
■ it was responsive to the City's obligation to protect the health, safety, and welfare of
the people;
■ it was consistent with guidelines established by the State of California Seismic Safety
Commission;
■ it was consistent with strengthening programs implemented in comparable
jurisdictions throughout the State;
■ it satisfied the intent of the Earthquake Hazards Reduction Act of 1986
(Government Code § 8875 et sea); and
■ it would facilitate putting together a program to provide financial assistance to
property owners (Long Beach-type assessment district, for example).

The local business community strongly objected to a mandatory program with a year 2000
deadline, based on the severe economic impact which they felt such a requirement would
impose on businesses. It has been argued repeatedly that many businesses located in URM
buildings are financially tenuous and the imposition of mandatory seismic strengthening
could cause some businesses to fail.
After consideration of all arguments, the City Council chose to defer the imposition of a
mandatory deadline for actual retrofitting;but did adopt administrative regulations requiring
that all URM buildings be structurally analyzed in detail and the results submitted to City
s-aff for review and acceptance. The adopted plan recognized the business community's
c.,ncem about the economic impacts of a specific implementation schedule, while at the
same time establishing basic mandatory features and demonstrating progress in addressing
the hazards.
What is the progress to date?
The original URM building inventory dated January 1, 1990 contained 148 buildings. The
current list of buildings subject to additional requirements under a mitigation program
contains 114 buildings. The reduction in the inventory of"potentially hazardous" buildings
is due to:
1. determination that a building is reinforced,based on additional building plans
or test data submitted to the Chief Building Official (17 buildings);
2. notification from the County that County-owned buildings used for County
government purposes will be subject to the mitigation program adopted by the
Board of Supervisors (5 buildings);
3. demolition of URM buildings to make way for the Downtown Center (4
buildings); and
4. strengthening of URM buildings per City standards (8 buildings).
Building strengthening accomplished since the effective date of the ordinance has been
voluntary and not driven by the mandatory ordinance provisions triggered by occupancy
change or major remodel. Very few URM buildings have been or will be subject to
occupancy change or remodeling in excess of 50% of building replacement value. Reliance
on these provisions to achieve progress in reducing URM hazards will not be effective.
Voluntarily, only 8 URM buildings have been fully strengthened since 1990, including the
City-owned building located at 955 Morro Street. Partial strengthening of 6 URM buildings
has been completed. Building permits for.the complete strengthening of 2 URM buildings
have been issued. One City-owned URM building (recently acquired Mathews property at
344 Higuera) is scheduled for demolition during spring of 1996. At this rate of voluntary
retrofitting, it will take over 86 years to complete mitigation of the URM hazard.
There have been no further developments at the State level that affect the City's URM
mitigation program. There have been no additional regulatory measures or rules passed by

the State Legislature. The City's technical standards for strengthening buildings (Appendix
1, Uniform Code for Building Conservation, UCBC) are identical to the statewide standards
established by the State of California Building Standards Commission under AB204.
What are the results of the structural analysis reports?
The City of San Luis Obispo Municipal Code requires that all owners of URM buildings
submit a structural analysis of their building to the Building & Safety Division. As a
component of the initial URM mitigation plan established in 1992, this requirement was
conceived as a tool to acquire greater detail as to the scope of the URM hazard and to
provide each property owner with specific information for planning the building's future.
The Building Division has reviewed each individual structural analysis received and prepared
several "matrix" reports summarizing the data collected. As indicated above, there are
currently 114 unreinforced masonry buildings that are subject to the City's mitigation
program The property owners of 102 of these buildings have submitted a structural
analysis. There are 2 property owners that have been granted an extension due to evidence
of progress made. The property owners of 10 URM buildings apparently are refusing to
comply with the requirement to submit a structural analysis. The Building Division and the
City Attorney will initiate further action concerning these 10 property owners by May 1,
1996. However, structural analysis reports on 102 buildings provides a solid core of
information on which to base effective future programs.
As a general conclusion, review of the analyses found that almost all of the city's URM
building inventory will require the same type of strengthening work. The analysis in each
case did not reveal any exceptional or unusual information about the building's structural
design. The UCBC strengthening standards can be considered a basic "recipe" that is
suitable for all of the URM buildings in San Luis .Obispo. A summary of the matrix
information is shown on Attachment A.
Results of the structural analyses indicate that the construction cost to complete URM
strengthening work will range from $158 to $140.29 per square foot, with an average cost
of$16.13 per square foot. The total cost estimate to strengthen the remaining 114 buildings
on the list is $10,630,366.
What financing programs are under consideration or available?
As a local incentive, the City Council adopted a resolution establishing the cost of the
structural analysis as a credit to be applied to building permit and/or Architectural Review
application fees for strengthening (including any remodeling or expansion done at the same
time) or replacing an unreinforced masonry building.
Council also established a grant program with Community Development Block Grant funds

that will cover 25% of the cost of strengthening a URM building, with a maximum of
$25,000. Two property owners of downtown URM buildings have used this program to
complete strengthening requirements.
Staff remains committed to assisting in the formation of an assessment district to provide
long-term construction financing if a sufficient number of URM building owners are
interested. While no guarantee can be made that assessment district financing will be less
expensive than bank financing, its primary value is in providing reasonable, long-term
finc-acing to property owners who might not otherwise qualify due to equity to value ratio
or other credit concerns. With an estimate of the total cost to strengthen all buildings now
available, crucial decisions regarding the formation of an assessment district can be
facilitated.
Efforts to involve the local banking community in a loan pool for strengthening projects
have not been successful.
What are the next steps?
From the structural analysis reports, URM building owners now have an understanding of
the scope of the work required and the corresponding impact on the tenants. The
Northridge earthquake renewed recognition that local efforts must go beyond studies. The
business community supports preservation of the downtown(where 84 unstrengthened URM
buildings are located), but feels that additional financial assistance must be created as an
incentive to encourage seismic strengthening.
Staff intended to return to the City Council with recommendations for the next phase of the
URM mitigation program by the end of the 1995-96 fiscal period and thereby satisfy an
established Council goal. However, the Chamber of Commerce felt that the time frame was
too aggressive and simply would not allow adequate time to achieve consensus before City
Council deliberation (see attachment B). Chamber and City staff subsequently designed a
revised schedule (attachment C) that will allow adequate time for subcommittees of the
Task Force to complete their work in the development of an acceptable program that will
achieve the Council goal.
Summary
There are potentially 13,800 building occupants in San Luis Obispo (based on the maximum
occupant load calculated per the Building Code) that could be subjected to the hazards of
unreinforced masonry building failure during an earthquake. In addition, an unknown
number of occupants in adjacent buildings and pedestrians passing by may be at risk due
to falling debris from URM failures resulting from an earthquake. Strengthened buildings
will save lives and reduce injury, and the building may survive a seismic event with little or
no damage. Strengthened buildings will reduce the economic loss in the downtown area and

help preserve the architectural integrity of the downtown in the event of a major
earthquake. Adoption of the revised timeline and action steps for development of a seismic
retrofit program for LRM buildings as shown in attachment C will allow for adequate time,
cooperation, and effort in creating an effective seismic retrofit program for URM buildings.
FISCAL IMPACT
There is no cost associated with the adoption of a revised workplan.
CONCURRENCES
The City staff working group, consisting of the CAO,Assistant CAO, Finance Director, City
Attorney, Community Development Director, and the Chief Building Official, concur with
the recommendation. The Chairman of the Chamber of Commerce Seismic Task Force
concurs with the recommendation.

Re: Seismic Issue Time Frame
Dear John:
The Chamber of Commerce has viewed the Seismic Safety as a major issue
for both the City and business community and have advocated reaching a
reasonable solution.
As you are aware, the Chamber of Commerce developed a committee in the
spring of 1989 to work with City Staff on the very difficult issue of Seismic
Safety. The Seismic Task Force, as the committee became known, was
divided into two subcommittee's; one focused on the technical standards
and the second committee focused on the administration and
implementation of a seismic program.
During the next 2.5 years City Staff & the Task Force spent countless hours
of meetings and research, two workshops, seminars from outside groups
and individuals to reach consensus on Ordinance #1203 which established
technical seismic standards, mandatory seismic analysis, conditions
mandating seismic retrofit and credits for analysis expenditures.
The information from the seismic analysis was viewed as an
initial step which would not only define the scope of the retrofit TEN YU S
problem, but also provide several additional benefits such as:

• quantifies the extent of earthquake risk
• eliminates property owner's fear of an unknown cost
• identifies cost of potential retrofit requirements
• financing opportunities can be explored
• lease negotiations can be clarified
• impacts on tenants can be assessed
• sale of property provides buyers and sellers retrofitting cost
The Ordinance required all property owners to submit their analysis
within 18 months or September 4, 1994. During this time period the Task
Force had regular monthly meetings discussing seismic issues and
advocated property owners to comply with the Ordinance requirements.
September 4, 1994 came and a substantial number of property owners had
not completed the analysis. We continued our regular meetings and
personally called every property owner that had not submitted an
analysis to determine why.
Budgetary constraints, limited staff and slow property owner response
time slowed the review process. Because of our strong position in support
the seismic analysis, we believed that the review and consolidation .of the
analysis data into a matrix was critical before developing a solution to the
seismic issue.
On February 7, 1996 the Task Force had it's first meeting of 1996. Six and
one-half years since the first meeting. We received the consolidation of
the analysis data into a matrix for the first time, an outline of a proposed
Unreinforced Masonry Mitigation Program and a goal of mid-March for a
complete Council draft of program. This morning, March 7, we received a
memorandum outlining a specific time frame for taking the seismic issue
to the City Council on June 4, 1996.
After six and one-half of working in good faith with Staff toward a solution
to the retrofit issue, it is totally unacceptable to compress the most difficult
decisions and solutions of a seismic mitigation program into less than 90
days. The organization structure of the Chamber of Commerce alone would
not allow proper development of a program within this time.
My committee is made up of volunteers that are solution oriented and are
concerned about the City of San Luis Obispo. But we need the opportunity
and time to meet with staff to develop the issues that are important to the
business community. Therefore, I respectfully request you forward to the

City Council our request that the timeline be moved forward into 1997
thereby providing us that opportunity.
