SUBJECT: Abatement Costs for 663 Church Street

Adopt a resolution confirming a statement of costs to abate a public nuisance at 663 Church
Street.
DISCUSSION
Overview
On March 5, 1996, after conducting a public hearing, the City Council adopted Resolution No.
8514 (1996 Series) declaring the property located at 663 Church Street to be a public nuisance.
In an effort to abate the hazard and keep the costs to the property owner to a minimum, the City
appointed D.T. Yungling and Sons to execute the abatement. Mr. Yungling has been used in
the past and is familiar with the property. See Attachment #1 for a detailed cost breakdown.
The abatement was a three-day process beginning on 4/9/96 and ending 4/11/96 requiring 43.5
hours of labor. Total debris removed was 300 cubic yards weighing 27 tons. Personnel from
the Fire Department supervised the abatement.
Site Description
The site is a rectangular lot located at 663 Church Street, and more particularly described as Lot
8, Block 124, Murray and Church's addition; shown as Assessor's Parcel No. 3-641-3 in the
County of San Luis Obispo. It is 145 feet deep and 50 feet wide, comprising approximately
7,250 square feet. Presently, this lot is zoned R-2 and is developed with an older single-story
residence, and a single-car, detached garage. A title search reveals that Mr. Jackson is the
owner of record and the only resident.
Notice of Statement of Costs
Per Municipal Code Section 8.24.130, a Notice of Statement of Costs was conspicuously posted
on the premises and notice was received by the owner of the property, W. Jackson.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING A STATEMENT OF ABATEMENT COSTS
INCURRED AT 663 CHURCH STREET
WHEREAS, on March 5, 1996, in accordance with applicable provisions of the
Municipal Code, the City Council found the condition of the premises at 663 Church Street to
constitute a public nuisance; and
WHEREAS, the property owner, Mr. Ilmar Jackson, did not abate the property within
the thirty (30) days ordered, and
WHEREAS, the costs incurred by the City in abating the nuisance shall be accounted for
and processed as set forth in Chapter 8.24 of the Municipal Code,
NOW, THEREFORE BE IT RESOLVED, as follows:
SECTION 1. This Council hereby confirms the statement of abatement costs in the
amount of $5,982.38.
SECTION 2. The Director of Finance is directed to send a statement of abatement costs
to Mr. Jackson. He shall be notified that if the statement is not paid within thirty (30) days of
this Resolution, a spacial assessment shall be placed on the land and shall constitute a lien for
the amount of the assessment.

SECTION 3. The City Clerk is directed to send a Notice of Lien to the Tax Collector
of the County of San Luis Obispo for the collection of said lien in accordance with Section
8.24.150 of the Municipal Code,
