McCluskey, Public Works Directorl�7^" ` Prepared By Kenny, Supervising Civil Engineer SUBJECT: 'ght of Way Acquisition for the Orcutt Road Widening Project CAO RECONEWMATION: 1) approve the agreement with Doris Dixon Ahrens to acquire right of way adjacent to 810 .and 830 Orcutt Road 2) authorize the Mayor to execute the agreement DISCUSSION: One of the approved capital improvement projects included in the 1995-97 Financial Plan provides for widening the north side of Orcutt Road between Broad Street and the Southern Pacific tracks by acquiring right of way and constructing curb, gutter, sidewalk, and paving. Public Works has negotiated an agreement with the owner of 810 and 830 Orcutt Road to acquire some of the right of way needed (22 feet wide by 235 feet long) for the widening in accordance with the adopted setback line map. Instead of a cash payment for this right of way, the agreement requires the City to construct the curb, gutter, sidewalk, 4 driveway ramps, paving, and water services required to serve the adjacent parcels. Public Works has determined that the cost of specified improvements are equal to or less than the acquisition land value. Dedicating right of way would normally be a development requirement,but there are no apparent plans to redevelop the adjacent properties in the near future, and there is a pressing public need for both pedestrian and vehicle circulation improvements. Acquiring the remaining right of way along the adjacent comer parcel.at McMillan (22 feet wide by 70 feet long) and completing the widening project will allow for a left-tum pocket at this comer to relieve current traffic congestion along the Orcutt Road corridor. FISCAL IMPACT: The estimated cost of improvements required by the proposed agreement is $ 35,000. $70,000 for right of way acquisition was appropriated in the 1995-97 Financial Plan. (See pages E-7 and E-22). This portion of the money will be used to actually construct the required improvements. GRANTOR shall grant a street widening easement (including incidental purposes) to the CITY for Orcutt Road widening purposes, being 5170 square feet (0.119 acres) , more or less, as shown on the attached Exhibit A. The deed shall not be effective, nor recorded, until approval of this agreement by the City Council. 2. CITY shall be responsible for the cost of installation of standard curb, gutter and sidewalk, street base and paveout; and shall provide all necessary engineering, utility reloca- tions and any incidental drainage improvements, in conjunction with the above-described work. CITY shall also install four (4) driveway ramps (2 at 810 Orcutt Rd. and 2 at 830 Orcutt Rd. ) to accommodate existing onsite driveways. City also shall provide a 2-inch (minimum) water service (including meter box and shutoff valve per City standards) and a 2-inch (minimum) fire sprinkler lateral for 810 Orcutt Road. A fire sprinkler lateral shall also be provided for 830 Orcutt Road. Actual service sizes shall be coordinated with the GRANTOR and the City Fire Department prior to approval of the final construction plans. 3. No conditional use or other restrictions shall be placed on these properties, as a result of this agreement. 4. GRANTOR agrees that full compensation for the easement is received by acceptance of the terms of this agreement. 5. This agreement shall be binding upon, and shall inure to the benefit of, the successors, heirs and assigns of the parties hereto. Orcutt Rd. Widening Agreement (Ahrens) Page Two 6.
