Approve Contract with Spiess Construction Co., Inc. in the amount of S 73,378.00 for the Water
Reclamation Facility Digester #1 Repair and authorize the Mayor to execute the contract.
DLSCUSSION
Cleaning and repair of the digesters at the Water Reclamation Facility is a routine project
completed approximately every 5 years. The harsh environment at the facility necessitates routine
maintenance programs to prevent the need for major facility replacements. The City has already
completed a contract to remove the sludge from the digester and clean it. This project will
replace the interior coating and make necessary equipment repairs and replacements.
FISCAL IMPACT
A total of $120,000 in the sewer fund (Wastewater Reclamation Facility, Major Equipment
Maintenance) was approved for the cleaning and repair of Digester No. 1 as part of the 1995-95
budget (Appendix B, Capital Improvement Plan , page 63). The project was divided into three
phases: $30,000 to empty and clean the digester (contracted awarded previously), $40,000 to
purchase replacement equipment (purchases completed); $50,000 to coat the interior and repair
and replace the necessary equipment. The engineer's estimate for this project at the time of
bidding was $58,000.
On May 7th bids were opened for the repair project. Bids were over the engineers estimate and
with contingencies, $30,000 over the budget. Staff will not be awarding either of the alternate
bid items as these are not vital to plant operation. As indicated in the previous staff report to
advertise the project, staff recommends the additional $30,000 necessary for the project be taken
from the Water Reclamation Facility, Major Equipment Maintenance capital improvement
account This will postpone the overhaul of the cogeneration plant and the cleaning and repair
of digester #2. The cogeneration project was to be deferred anyway due to changes in Air
Pollution Control Regulations and is being reevaluated. Digester #1 is one year behind when it
was originally planned. Delaying Digester 42 one year to 1997-'98 will therefore not present a
problem.

THIS AGREENENT, made on this day of , 19_, by and between the City of San Luis
Obispo,San Luis Obispo County,California,hereinafter called the Owner,and Spiess Construction Conu m ,Inc.,
hereinafter called the Contractor.
WITNESSETM
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1,SCOPE OF WORK: The Contractor shall perform everything required to be performed,shall provide
and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and transportation
services required to complete all the work of construction of Water Reclamation Facility Digester No 1 Repair.
Specification No. 96-67B in strict accordance with the plans and specifications therefor, including any and all
Addenda,adopted by the Owner, in strict compliance with the Contract Documents hereinafter enumerated.
It is agreed that said labor,materials,tools,equipment,and services shall be Furnished and said work performed and
completed under the direction and supervision and subject to the approval of the Owner or its authorized
representatives.
ARTICLE A CONTRACT PRICE. The owner shall pay the Contractor as full consideration for the faithful
performance of this Contract, subject to any additions or deductions as provided in the Contract Documents, the

Payments are to be made to the Contractor in accordance with and subject to the provisions embodied in the
documents made a part of this Contract:
Should any dispute arise respecting the true value of any work omitted,or of any extra work which the Contractor
may be required to do, or respecting the size of any payment to the Contractor, during the performance of this
Contract, said dispute shall be decided by the Owner and its decision shall be final,and conclusive.
ARTICLE M COMPONENT PARTS OF THIS CONTRACT: The Contract consists of the following documents,
all of which are as fully a part thereof as if herein set out in full, if not attached, as if hereto attached:
1. Notice to Contractors and information for bidders.
2. Contract General Conditions and Technical Specifications.

ARTICLE IV. It is further expressly agreed by and between the parties hereto that should there be any conflict
between the terms of this instrument and the bid or proposal of said Contractor, then this instrument shall control
and nothing herein shall be considered as an acceptance of the said terns of said proposal conflicting herewith.
