CAO RECOMMENDATION Approve the attached resolution requesting that the Local Agency Formation Commission(LAFCo)approve a minor annexation of a portion of Suburban Road. DISCUSSION On January 16, 1996, the City Council reviewed and approved a tentative subdivision map for the TK Annexation site on South Higuera Street between Suburban Road and Tank Farm Road. At that meeting,the Council directed staff to process an annexation request to include that portion of Suburban Road bordering the TK Annexation site. As approved,the TK Annexation includes only that portion of Suburban Road dedicated for purposes of road widening. After further consideration, the Public Works Department and County Engineering staff concluded that the boundaries of the annexation should be amended to include the full width of Suburban Road along the.TK frontage. Otherwise, this stretch of Suburban Road will be subject to two different jurisdictions. The City would have jurisdiction over the 10-foot strip offered for dedication to accommodate road widening, and the County would have jurisdiction over the remaining width. This could result in confusion during emergency response and duplicate permitting for maintenance work. If supported by the City Council, LAFCo staff have indicated their willingness to process an amendment to the annexation boundary. CONCURRENCES City Public Works and County Engineering Departments concur with the proposed annexation. FISCAL IMPACT Normal street maintenance (paving and sweeping) of this portion of Suburban Road would become the responsibility of the City. ALTERNATIVE Do not approve the resolution. In this case, most of the street section would remain in the County. Attachment Draft resolution RESOLUTION NO. (1996 Series) A RESOLUTION BY THE SAN LUIS OBISPO CITY COUNCIL REQUESTING THAT THE LOCAL AGENCY FORMATION COMMISSION APPROVE ANNEXATION OF A PORTION OF SUBURBAN ROAD (City File No: ANNX 17-96) WHEREAS, the City of San Luis Obispo desires to initiate proceedings pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, commencing with Section 56,000 of the California Government Code, for the annexation; and WHEREAS, notice of intent to adopt this resolution of application has been given to each interested and each subject agency; and WHEREAS, the territory proposed to be annexed is uninhabited right-of-way, and a description of the boundaries of the territory is set forth in Exhibits A and B attached hereto and by this reference incorporated herein; and WHEREAS, this proposal is consistent with San Luis Obispo's sphere of influence; and WHEREAS, the potential environmental impacts of annexation have been evaluated in accordance with the California Environmental Quality Act (CEQA) and the City Environmental Guidelines; and WHEREAS, the proposed annexation is compatible with the City's General Plan; BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1: Findings. 1. Annexation of that portion of Suburban Road bordering the TK Annexation site is appropriate to avoid duplicate permitting for maintenance work and to minimize confusion during emergency responses. SECTION 2: Environmental Determination. 1. Annexation of that portion of Suburban Road bordering the TK Annexation site is categorically exempt from the California Environmental Quality Act under Section 15319. SECTION 3: Annexation Area Described. The Suburban Road Annexation shall consist of that right-of-way area shown in the vicinity map attached as Exhibit A and described in the legal description in attached Exhibit B. SECTION 4: Council Recommendation The City Council hereby requests that LAFCo approve the annexation. SECTION 5: Implementation The City Clerk shall forward a copy of this resolution and all pertinent supporting documents to LAFCo.
