CITY HALL -COUNCIL HEARING ROOM -990 PALM STREET SAN LUIS OBISPO, CALIFORNIA ROLL CALL: Council Members Present: Council Members Kathy Smith, Dave Romero, Bill Roalman, Vice Mayor Dodie Williams and Mayor Allen Settle City Staff Present: John Dunn, City Administrative Officer; Ken Hampian,Assistant City Administrative Officer; Diane Reynolds, City Clerk Secretary; Cindy Clemens, Assistant City Attorney; Arnold Jonas, Community Development Director; John Mandeville, Long-Range Planning Manager; Neil Havlik, Natural Resources Manager, Glen Matteson, Associate Planner PUBLIC COMMENT PERIOD There were no public comments. Mayor Settle stepped down due to a conflict of interest,and asked Vice Mayor Williams to conduct the meeting. STUDY SESSION 1. CREEK SETBACK ORDINANCE (File No. 596) Council considered a Creek Setback Ordinance. Glen Matteson.Associate Planner, provided an overview of the proposed Creek Setback Ordinance. Vice Mayor Williams opened Council discussion. John Mandeville. Long-Range Planning Manager, explained the current Administrative Policy. Neil Havlik. Natural Resources Manager, presented a map detailing the various sizes of the creeks in and around the City. Cindy Clemens, recommended that Council consider the questions surrounding the exception process and the "findings." Amold Jonas. Community Development Director, answered Council questions regarding the flexibility of the exception process of the proposed ordinance. John Dunn. City Administrative Officer,stated there is need for a clear statement to the community about the importance of protecting the creeks, for flood protection, and for a flexible ordinance because the Administrative Policy is too weak and vulnerable. Vice Mayor Williams asked for comments from the public. - -a i City Council Meeting Page 2 Tuesday, May 14, 1996 -4:00 p.m. No one spoke. Vice Mayor Williams returned discussion to the Council. Council discussed concerns regarding distance of setback on various parcels and in expansion areas, and the need for flexibility in the exception process of the proposed ordinance. After discussion, staff was directed to: 1) Revise the standard setback to more closely resemble the current administrative creek setback policy, requiring a 20-foot setback within the city limits; 2) recognize the mitigation measure contained in the Land Use Element EIR by requiring a larger setback for certain creeks, as areas outside the existing city limits are annexed and subsequently developed. Focus the application of a larger setback on the larger creeks; 3) revise the exception provisions of the ordinance to eliminate the averaging provisions and to incorporate some of the application and findings recommendations presented in the"Streamlined"version of the ordinance presented to the Council; 4) require setbacks within the Central Commercial zoning district, recognizing that most of this area is built out with no setback, and that most new development would be eligible to request an exception. Specify the recommended dimension of the setback, if 20 feet is not desirable. Staff directed to provide a readable creeks map, which will still be readable after copied. (General Consensus) COMMUNICATIONS Comm. 1. Vice Mayor Williams shared her experience with the Chumash Challenge, involving workshops and team-building. 5:30 P.M. Mayor Settle adjourned to closed session. 7:00 P.M. There being no further business to come before the City Council, Mayor Settle adjourned the meeting to Tuesday, May 21, 1996,at 6:30 p.m. in the Personnel Conference Room at City Hall.
