DISCUSSION The Performing Arts Center (PAC) is currently planning an advertising campaign for its Grand Opening Festival which begins September 27, 1996. When the PAC office initiated paperwork in April, 1996, for a banner permit, it was informed that both the Marsh Street location and the Higuera Street location had already been reserved. PAC staff contacted both reserving organizations to see if there were any possibility of them relinquishing their reservation or changing dates. Unfortunately, no changes were possible. There is a third location where a banner could be hung downtown which was established by the Business Improvement Association (BIA) for hanging Christmas garlands. It is located on Monterey street just south of the Osos Street intersection (between Kinkos and Ann's). The PAC's Managing Director, Ron Regier, is requesting that they be allowed to use this location for the Grand Opening Festival banner. The BIA has agreed to allow the PAC to use this location if the City will provide an exception to its current banner location policy. The property owners of the buildings from which the hanging cables are strung have also agreed to allow the banner to be hung. When the two current banner sites were selected, careful consideration was given to allowing placement where banners could be safely hung, be easily seen by the community and not create visual degradation to the downtown's attractiveness. The locations on Higuera and Marsh street were chosen because they met these criteria. In addition, by standardizing banner placement the policy prevents the proliferation of banners and banner sites. Staff is asking the Council to allow the PAC to place a banner at the BIA's Monterey Street location, recognizing that in doing so they are requesting an exception to current policy. However, staff believes that it is appropriate to make such an exception in this particular case for several reasons. First, the Grand Opening Festival of the Performing Arts Center erlp Council Agenda Report - Title of Report Page 2 is a sia-nificant community event which has been anticipated for a number of years. Second, the City is a partner in the Performing Arts Center Commission, and thus, in effect, a co- sponsor of the event. Third, since the City has a financial interest in the operation of the PAC, it is in the City's interest to assure that Grand Opening Festival be as successful as possible, which the advertising banner would certainly enhance. CONCURRENCES The BIA and the owners of the property on which the banner cables are mounted are in agreement with hanging the banner at this location. FISCAL IMPACT Allowing an exception to the current banner locations would have no fiscal impact. Since the City is a partner in the construction of the PAC, the PAC would be charged 50% of the normal banner fee in accordance with the Banner Policy. We were informed that both of these locations have been reserved by other groups during the two week period we requested - September 23 through October 7, 1996. Therefore, I would like to request an exception to the City's banner ,policy to allow the Performing Arts Center to hang a Grand Opening banner at the Monterey Street location (between Kinkos and Ann's Clothing). The banner would be displayed during a two week period, beginning September 23 through October 7, 1996. Since the City of San Luis Obispo is one of the three partners overseeing the Performing Arts Center, would we be eligible for a 50% reduction of the permit fee?
