McCluskey, Public Worts Direc Prepared By: Jerry Kenny, Supervising Civil Engineer i SUBJECT': Request by Pacific Bell to purchase an exclusive utility easement within the Iaguna Lake Golf Course property. CAO RECOMMENDATION: Adopt a resolution granting an exclusive utility easement to Pacific Bell. DISCUSSION: Pacific Bell has requested that the City grant an exclusive easement on the Laguna Lake Golf Course property in order to install an enclosure to house equipment and a fibre optic cable to accommodate increased requests for telephone service and provide for digital capabilities in the immediate area and beyond. The easement would be 12 ft wide by 15 ft long, contiguous with the Los Osos Valley Rd. R/W (within the golf course property) and adjacent to the "Laguna Green" condominiums at the comer of Prefumo Canyon Road. They offered monetary consideration of $ 2,000.00 for their exclusive use of the area. This is $ 11.11 per sq. ft., which in staffs opinion is a fair value, particularly since it would only be an easement. The Universal Enclosure Cabinet (VE) is about 6 ft. by 6 ft. by 5 ft. high (above grade) and will be screened by existing large trees and would not disrupt or interfere with operations at the golf course. Furthermore, this is a superior location, rather than placing it within the R/W, where it would be allowed, but would be more visible. (See attachment 4) CONCURRENCES: The Parks and Recreation Director and City Attorney concur with the recommendation. FISCAL IMPACT: Minor revenue generated by sale of the easement. (1996 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO GRANTING A UTILITY EASEMENT TO PACIFIC BELL AT THE LAGUNA LAKE GOLF COURSE. WHEREAS, Pacific Bell has requested the purchase of an exclusive Utility easement to install an enclosure for fibre optic cable and related equipment at the Laguna Lake Golf Course property, and WHEREAS, Pacific Bell has offered two thousand ($ 2, 000.00) dollars for purchase of this easement, and WHEREAS, it has been determined that this easement will not conflict with activities and uses at the golf course. NOW THEREFORE BE IT RESOLVED that the City Council hereby authorizes the Mayor to execute an easement for the above purpose upon payment of two thousand ($ 21000. 00) dollars. The easement would be 12 feet by 15 feet and located in the most Northeasterly comer of the property adjacent to Los Osos Valley Road (please see attached). We believe this to be a location that is out of the way and one that will not be used by the golf course. I have spoken with Mr. Paul LaSage of the Parks and Recreation Department and Mr. Paul Taylor at the Golf Course and they both concur. A Universal Enclosure (UE) Cabinet will be placed on the easement. The UE cabinet will house equipment and a fiber optic cable that will provide for the increased requests for telephone service and provide for digital capabilities for the immediate area and beyond. The selection of this location is based on our existing cable size and design requirements. Due to the type of electronic equipment housed in the UE cabinet, we prefer to place it on an exclusive easement to provide protection from relocation and damage. Therefore Pacific Bell will pay a monetary consideration of$2,000.00 for the easement site. Enclosed with the Grant of Easement is a sketch of the location and some information on the UE cabinet Please have the Grant of Easement stamped ORIGINAL executed as soon as possible and return to me in the enclosed envelope.
