HomeMy WebLinkAbout08/20/1996, C-14 - MEMORANDUM OF AGREEMENT WITH THE SAN LUIS OBISPO POLICE STAFF OFFICERS' ASSOCIATION FOR THE PERIOD OF JULY 1, 1996, THROUGH JUNE 30, 1998 council 8/20/96 j acEnba izEpoRt ��- CITY OF SAN LUIS OBISPO FROM: Ann Slate, Director of Personnel q SUBJECT: Memorandum of Agreement with the San Luis Obispo Police Staff Officers' Association for the period of July 1, 1996, through June 30, 1998 CAO RECOMMENDATION Adopt a resolution approving the Memorandum of Agreement DISCUSSION The Memorandum of Agreement (MOA) between the City and the San Luis Obispo Police Staff Officers' Association (POA) expired on June 30, 1996 after a period of 2 years. After receiving direction from the City Council in June of this year, the City entered into negotiations with the POA to develop a successor agreement. The City's negotiators were Ann Slate, Personnel Director, and Ken Hampian, Assistant City Administrative Officer. The Association's negotiating team consisted of Sergeant Jim English, Sergeant Bud Silva, and Lieutenant Gary Orback of the Police Department. A tentative agreement has been reached which was ratified by the Association membership. The agreement reflects and strengthens the continued cooperation between the Association and the City to address issues of mutual concern in a productive manner. The following is a summary of the significant changes and cost items included in the agreement: Terms of the Agreement: Len the Two (2) years, July 1, 1996-June 30, 1998 S Year 1 - 2.5% salary increase for sergeants; 3.5% for lieutenants and captains. This increase will take effect in September of 1996. Year 2 - 3% salary increase for sergeants; 3.5% for lieutenants and captains. Overtime: The City recognizes that patrol sergeants are non-exempt from the provisions of the Fair Labor Standards Act (FLSA) which entitle them to overtime. Sergeants shall receive overtime compensation in the same manner as police officers except that they will shift adjust hour for hour for time spent on administrative assignments. e/f/-/ Council Agenda Report - Memorandum of Agreement with the City and SLOPSOA Page 2 The non-exempt sergeants will no longer receive 64 hours of annual administrative leave. FISCAL EMPACT The cost of this agreement is approximately $27,000 in actual costs for Year 1 (although the delayed effective date of the salary increases translates into an annualized cost of$35,000 which is compounded in year 2) and $39,000 for Year 2 for a total of$74,000. Funding is available in the existing fund balances for FY 96-97. Funds will be appropriated in FY 97-98 as part of the next two year financial planning process in accordance with the agreement. ALTERNATIVES Do not approve the resolution and direct staff to negotiate a difference successor agreement. This alternative is not recommended as the agreement is consistent with the Council's previous direction and the City's employer-employee relations policies. Attachments Resolution PLEASE NOTE. (1996 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO POLICE STAFF OFFICERS' ASSOCIATION FOR THE PERIOD OF JULY 19 1996 - JUNE 309 1998 BE rr RESOLVED, that the City Council of the City of San Luis Obispo hereby resolves as follows: SECTION 1. The Memorandum of Agreement between the City of San Luis Obispo and the San Luis Obispo Police Staff Officers' Associations (SLOPSOA), attached hereto as Exhibit and incorporated herein by this reference, is hereby adopted and ratified. SECTION 2. The Finance Director shall adjust the Personnel Services appropriation accounts to reflect the negotiated compensation changes. SECTION 3. The City Clerk shall furnish a copy of this resolution and a copy of the ' executed Memorandum of Agreement approved by it to: Jim English, San Luis Obispo Police Staff Officers' Association, and Ann Slate, Personnel Director.
