CAO RECOMMENDATION
Adopt a resolution denying the proposed General Plan amendments and Zone Reclassification.
DISCUSSION
The applicant has requested that the City Council amend the General Plan Land Use and Open
Space Elements in order to allow development of a recreational facility in the Calle Joaquin
Hillside Planning Area. On July 23`x, the Council determined that the site was not appropriate
for the requested land use changes and directed staff to return with a formal resolution for denial.
The resolution is attached.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO
DENYING AMENDMENTS TO THE GENERAL PLAN LAND USE ELEMENT AND
OPEN SPACE ELEMENT MAPS, THE ZONING MAP, AND THE LAND USE
ELEMENT TEXT TO ALLOW DEVELOPMENT OF A 1.6-ACRE SITE ON CALLE
JOAQUIN, SOUTH OF LOS OSOS VALLEY ROAD (GP/R 7-96)
WHEREAS, the Planning Commission and the City Council have held public hearings
in accordance with the California Government Code and Municipal Code Chapter 17.62 to
consider amending the General Plan Land Use Element map from Open Space to Tourist
Commercial for a 1.6-acre site, and to consider amending the General Plan Open Space Element
Greenbelt map to remove the site from "greenbelt" status, and to consider amending the General
Plan Land Use Element text to allow further development in the Calle Joaquin Hillside Planning
Area (GP/R 7-96); and
WHEREAS, the potential environmental impacts of the proposed General Plan and Zoning
amendments (GP/R 7-96) have been evaluated in accordance with the California Environmental
Quality Act and the City's Environmental Guidelines in initial study ER 7-96;
BE IT RESOLVED, by the City Council of the City of San Luis Obispo as follows:
SECTION 1. Finding . That this Council, after consideration of the requested
amendments to the General Plan Land Use Element and Open Space Element Maps, the Zoning
Map, and the Land Use Element text that would allow development of a 1.6 acre site for
recreational purposes and the Planning Commission's recommendations, staff recommendations,
public testimony, and reports thereof, makes the following findings:
1. The site is inappropriate for use as a recreational facility as proposed by the
applicant in the project application and as modified during the City review and hearing process;
and
2. Development and operation of the proposed recreational project is compromised
by the site being within, and subject to the regulation of, two separate governmental jurisdictions.
Required permitting and regulatory processes could be complicated, and subject to conflicting
requirements and error.
SECTION 2. Denial. The request for amendment to the General Plan and Zoning
Regulations (GP/R 7-96) is hereby denied.

SUBJECT: Franks General Plan Amendment / Zone Reclassification
(GP/R 7-96; 1695 Calle Joaquin)
Dear Mayor Settle:
We are formally requesting a withdrawal of the above cited project
applications. After substantial review and consideration of the issues
surrounding our proposal, we believe that the best course of action is
to request withdrawal of the existing proposal. We will wish to
resubmit a revised project designed to address the concerns of the
Council.
The focus of our revisions and the resubmitted applications will be to
resolve the issues related to dual jurisdictions. We believe that a proposal
to annex to the City, in combination with minor project revisions, would
best meet concerns expressed during these hearings. We will initiate
discussions immediately regarding a minor annexation with both City
and County staff with the goal of resubmitting in the near future. To this
end, we would request that the Council consider this proposal and offer
some thoughts on our proposed direction here today.
We firmly believe that the fundamental project offers substantial recreational
merit for local residents while providing a significant offer of Open Space
in the right locale
