Underground Utility District No. 13 (Santa Rosa St./Foothill Blvd. area)
CAO RECOMMENDATION
Adopt a resolution granting utility easement to PG & E. within Santa Rosa Park for
Underground Utility District No. 13 (Santa Rosa St./Foothill Blvd. area)
DISCUSSION
The City Council established Underground Utilities District No. 13 which requires the removal
of overhead utility wires along Santa Rosa Street, from Oak St. to Boysen and Foothill Blvd.,
from Santa Rosa to Ferrini Road. Although Pacific Gas & Electric's (PG&E) existing overhead
wires are not within a "formal" written easement, they prefer to secure an easement to protect
their interests for the undergrounding district.
Staff expected that the new conduit would be entirely within the Santa Rosa St. right of way
(State Highway 1), along with Sonic and Pacific Bell. However, PG&E desires the alignment
shown on the exhibit attached to the easement document (attachment 3), which provides a more
efficient and cost effective route for this area. The conduit will connect to existing poles at the
rear of the residential lots on Murray Street, outside of the Underground District.
The easement is approximately 80 feet southeasterly of and generally parallel to Stenner Creek.
There will be additional conduit work within the park to provide underground service to city-
owned park lighting (within the District), but easements are not required for that work.
CONCURRENCES
The City Attorney and Parks & Recreation Director concur with the recommneded action.

Option 1 - Deny an easement, with direction to staff as to an acceptable alignment.

A UTILITY EASENIDVT TO PACIFIC GAS AND ELECTRIC COMPANY W1TBIN
SANTA ROSA PARK FOR UNDERGROUNDING DISTRICT NO. 13
WHEREAS, the City Council has established Undergrounding District No. 13, which
includes Santa Rosa Park and the proposed undergrounding system includes the replacement of
existing Pacific Gas& Electric Company (PG&E) - owned overhead wires within the park in a
new alignment, and
WHEREAS, PG&E has requested an easement to accommodate said installation and for
maintenance of those facilities.
NOW THEREFORE,BE IT RESOLVED that the Mayor is hereby authorized to execute
an easement document to the benefit of PG&E .

EASEMENT
City of San Luis Obispo, a chartered municipal corporation,
hereinafter called first party, hereby grants to PACIFIC GAS AND ELECTRIC
COMPANY, a California corporation, hereinafter called second party, the right from time
to time to construct,reconstruct, install, inspect, maintain, replace, remove, and use facilities
of the type hereinafter specified, together with a right of way therefor, within a strip or
parcel of land or along a route as hereinafter set forth, over and across the lands situate in
the City of San Luis Obispo county
of San Luis Obispo , State of California, described as follows:

Parcel B as shown upon Parcel Map SLO-78-221 filed for record in Book
29 of Parcel Maps at page 7; Lots 4 and 5 of Block 1 of Tract No. 34
as said lots and block are shown upon the map filed for record in
Book 5 of Maps at page 55; and that portion of Block 82 of the City
of San Luis Obispo bounded on the west by California State Highway
05-SLO-01, on the east by the westerly boundary line of said Tract
No. 34, and on the north by said Parcel B of Parcel Map SLO-78-221;
all in the Records of the County of San Luis Obispo.
Said facilities shall consist of:
Such underground conduits, pipes, manholes, service boxes, wires,
cables, and electrical conductors; aboveground marker posts,

Dear Mr. Kenny:
Attached please find the revised version of the easement PG&E is requesting from the
city. Per my conversation with Mike Bertaccini, the tie has been changed to run
along the northerly boundary line of Lot 4 and the reference to"ingress and egress"
has been removed. PG&E will be granted ingress and egress by permit from the city
at the time of construction.
Please review the enclosed document and if it meets with your approval, sign exactly
as indicated on the signature page of the copy marked"PG&E Co. Copy." Have the
signatures notarized and return the signed document in the envelope provided. The
copy marked"Grantors Copy" is for your files.
