SUBJECT: Final Acceptance of public improvements for Tract 2100 and Minor Subdivision
92-127,a 13 residential lots development (Poinsettia St.,north of Tank Farm Rd.)
CAO RECOMMENDATION:
Adopt resolution accepting the public improvements for Tract 2100 and MS 92-127
DISCUSSION:
The final map for Tract 2100 was approved on December 3, 1996 per Resolution No. 8605 (1996
Series) and the Parcel Map for the adjacent property under Minor Subdivision 92-127 was
approved by the Community Development Director on December 6, 1996. The required tentative
map improvements per Resolution No. 8013 (1992 Series) (See Attachment 3) and Director's
Action No. 93-05 (DA) (See Attachment 4) for the minor subdivision have been satisfactorily
completed and the subdivider has requested acceptance of the public improvements by the City, in
accordance with the subdivision agreement.(See Attachments 4& 5)
The only public improvements for this subdivision are water services and standard frontage
improvements,since the standard street improvements and mains were previously installed,under a
previous subdivision. (Tract No. 929 - Units 1 & 2) Conditions 2 and 3 of the DA required
modificationto the existing private detention basin,which were assumed by the Marigold Shopping
Center developer(Tract 2133). Those improvements have been substantially completed and will be
completed prior to acceptance of that tract. That developer has also assumed the maintenance
responsibilities of the Santa Lucia Hills Homeowners Association(HOA)under an agreement with
the HOA.
Condition 10 of Resolution No. 8013 (1992 Series) and Condition 5 of the DA required the
subdivider to pursue annexation of the lots to the Master HOA. Annexation has been completed.
Condition 7 of the DA required landscaping of the pedestrian access easement to the Marigold
Shopping Center. It has been completed and will be maintained by the Marigold Shopping
Center's developer
ALTERNATIVES:
Option 1: Deny acceptance of the public improvements if the Council finds that any
conditions have not been satisfactorily met.
FISCAL IMPACT:
Normal maintenance of standard water services.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ACCEPTING THE PUBLIC IMPROVEMENTS FOR TRACT 2100 AND
MINOR SUBDIVISION NO.92-127
WHEREAS,the City Council and the Community Development Director(CDD)made
certain findings concerning Tract No. 2100 and Minor Subdivision No. 92-127(MS 92-127),as
contained in Resolution No. 8013 (1992 Series)and Director's Action No. 93-05,respectively,and
WHEREAS,the City Council approved the final map for said Tract 2100 per Resolution
No.8605(1996 Series)and the CDD approved the parcel map for MS 92-127 per Director's Action
No. 96-04,subject to completion of standard subdivision improvements,and
WHEREAS,the subdivider has satisfactorily completed the public improvements for the
said subdivisions,in accordance with City standards and specifications and has requested that the
City accept the public improvements for maintenance and operation.
NOW THEREFORE,the City Council hereby accepts the public improvements for Tract
No.2100 and MS 92-127. The Faithful Performance surety is hereby reduced to ten(10)percent,
in accordance with the subdivision agreement. The Labor&Materials surety shall be held for the
period prescribed in Section 66499.7 of the California Government Code(Subdivision Map Act).

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
GRANTING APPROVAL OF TENTATIVE TRACT NO. 2100
LOCATED AT 3935 POINSETTIA STREET
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Findings. That this council, after
consideration of the tentative map of Tract 2100 and the Planning
Commission's recommendations, staff recommendations, and reports
thereof, makes the following findings:
1. The design of the tentative map and the proposed
improvements, as conditioned, are consistent with the
general plan and specific plan for the £dna-Islay area.
2 . The site is physically suited for the type and density of
development allowed in an R-1-PD-SP zone.
3 : The design of the subdivision and the proposed improvements
are not likely to cause serious health problems, substantial
environmental damage or substantially and unavoidably injure
fish or wildlife or their habitat.
4 . The design of the subdivision or the type of improvements
will not conflict with easements for access through (or use
of the property within) the proposed subdivision.
5. An environmental impact report was adopted by the City
Council for the Edna-Islay Specific Plan. In accordance
with State law, the Community Development Director has
determined that no further environmental study is necessary.
SECTION 2 . Conditions. The approval of the tentative map
for Tract 2100 be subject to the following conditions:
1. Development of the subdivision must be in accordance with
the Edna-Islay Specific Plan.
2 . when construction of the subdivision is complete, Poinsettia
Street improvements must be in a "like new" condition, or
shall be repaired or replaced to the satisfaction of the
City Engineer. Because of the new improvements, and water,
sewer, and utility services to be installed with .this
subdivision, a one inch blanket pavement may be required to
the satisfaction of the City Engineer.

3 . The offer of dedication of portions of Bougainvillea and
Columbine will remain valid until such time as the street
dedications are accepted or alternative access is provided
for the adjacent county area, to the satisfaction of the
Community Development Director and Public Works Director.
4 . The subdivider shall provide for dedication of a public
Csewer main easement through lot 9 or lot 10, to the
` satisfaction of the City Engineer and Utilities Engineer, to
allow for a possible future sewer main connection from
Industrial Way to Poinsettia Street.
5. vehicular access rights along the Industrial Way frontage
must be dedicated to the City.
6. All boundary monuments, lot corners and centerline
intersections, and other survey points, must be tied to the
City's control network. At least two control points shall
be used and a tabulation of the coordinates shall be
submitted with the final map. A 5-1/411-diameter computer
floppy disk, containing the appropriate data for use in
autocad for Geographic Information System (GIS) purposes, is
also required to be submitted to the City Engineer.
7 . Lots shall be designed to drain to Poinsettia Street, unless
other arrangements are made with adjacent properties,
acceptable to the City Engineer. Consideration for added
detention basin flows should be addressed or other
provisions must be made in accordance with the Edna-Islay
Specific Plan.
B . The masonry wall along Industrial Way shall be extended to
the tract boundary.
9 . The subdivider shall inform future lot buyers of the
possibility of building permit delay based on the city' s
water shortage. Such notification shall be made a part of
the recorded documentation for each lot.
10. The subdivider shall consult with the existing homeowners
association, encompassing the adjacent residential property,
and ask to amend the existing covenants, conditions, and
restrictions (CC&R' s) in force for the adjacent residential
development, by attaching this subdivision to the other
subdivisions governed by the homeowners ' association created
by these CC&R' s. If approved, these amended CC&R' s shall be
approved by the Community Development Director and
administered by the homeowners ' association. If the request

is rejected by the Homeowner's Association, proof of such
rejection must be provided to the Community Development
Director.
11. The subdivider shall pay any applicable storm drainage fees
adopted by the City council, which are anticipated to be
adopted on or about July, 1992 .
12 . If the offer to dedicate the extension of Bougainvillea
Street is not accepted by the City, and the extension
thereby abandoned, then a common driveway agreement shall be
submitted to the Community Development Director for review,
approval, and recordation, allowing use of the accessway to
lot 10 (alternative design) to be shared by the residents of
lots 8 and 9 .
13 . The subdivider shall install a 6 foot high fence along the
easterly property line of lot � to assure a degree of
privacy to adjoining property owners.

AN ACTION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF THE
CITY OF SAN LUIS OBISPO GRANTING APPROVAL OF TENTATIVE
MAP FOR MINOR SUBDIVISION NO. MS 62-93
(SLO 92-127) LOCATED AT 3963 POINSETTIA STREET
BE IT RESOLVED by the Community Development Director of the City of San Luis
Obispo, as follows:
SECTION 1. Findings. That the Community Development Director, after
consideration of the tentative map of Minor Subdivision MS 62-93 (SLO 92-127) and the
staff recommendations and reports thereon, makes the following findings:
1. The design of the proposed subdivision and proposed improvements are
consistent with the general plan and Edna/Islay Specific Plan.
2. The site is physically suited for the type and density of development allowed in the
R-1-SP zone.
3. The design of the subdivision and the proposed improvements are not likely to
cause serious health problems, substantial environmental damage or substantially
and unavoidably injure fish or wildlife or their habitat.
4. The design of the subdivision or the type of improvement will not conflict with
easements for access through, or use of property within, the proposed subdivision.
5. The Council concurs with the determination of the Community Development
Director that the proposed subdivision is exempt from environmental review
requirements.
SECTION 2. Conditions. That the approval of the tentative map for Minor
Subdivision MS 62-93 (SLO 92-127) be subject to the following conditions:
1. Subdivider shall submit a final map to the city for review, approval and recordation.
The map shall be prepared by, or under the supervision of, a registered civil
engineer or licensed land surveyor.

2. Approval of this tentative map shall confer a vested right to proceed with
development in accordance with the ordinances, policies and standards described
in Section 66474.2 of the Subdivision Map Act.
3. The subdivider shall expand the existing detention basin to compensate for the
proposed reduction in capacity via the retaining wall and earth fill on a portion of
Lot 3. A hydraulic analysis of the proposed detention basin modifications,
prepared by a registered civil engineer, shall be submitted to the City Engineer for.
review and approval.
4. Subdivider shall obtain approval for the modification of the detention basin from the
owner of the off-site basin expansion area and the easement grantee (Santa Lucia
Hills Homeowners Association), prior to recording the parcel map for this
subdivision. If the approvals are not obtained, the area occupied by the easement
shall be excluded from this subdivision and the final map shall show two lots, to
the approval of the City Engineer and Community Development Director.
5. The subdivider shall consult with the existing homeowners association,
encompassing the adjacent residential property, and ask to amend the existing
covenants, conditions, and restrictions (CC&R's) in force for the adjacent
residential development, by attaching this subdivision to the other subdivisions
governed by the homeowners association created by those CC&R's. If approved,
the amended CC&R's shall be approved by the Community Development Director
and administered by the homeowners' association. If the request is rejected by
the homeowners association, proof of such rejection must be provided to the
Community Development Director.
6. Modification of the detention basin shall include reconstruction of an all-weather
access road, to the approval of the City Engineer.
7. Subdivider shall dedicate an easement across the remainder parcel for pedestrian
access to the proposed shopping center, and for.landscape installation and
maintenance. Subdivider shall install a six-foot wide sidewalk and appropriate
landscaping, and shall provide for perpetual maintenance, to the approval of the
Community Development Director and City Engineer.
8. All boundary monuments, lot corners and centerline intersections, BC's, EC's, etc.,
shall be tied to the City's control network. At least two control points shall be used
and a tabulation of the coordinates shall be submitted with the final map or parcel
map. A 5-1/4" diameter computer floppy disk, containing the appropriate data for
use in autocad for Geographic Information System (GIS) purposes, is also required
to be submitted to the City Engineer.

9. Subdivider shall provide individual electrical, cable television, and natural gas
services and metering for each unit to the approval of affected public utility
agencies and the City Engineer.
10. Subdivider shall provide individual water services and sewer connections for each
lot, to the approval of the City Engineer.
11. The subdivider shall dedicate a 6-foot wide public utility easement and a 10-foot
wide street tree easement along the Poinsettia Street frontage, to the satisfaction
of the City Engineer.
12. Street trees are required to be planted per City Standards (the number of trees is
determined by one tree per 35 linear feet of street frontage, or any portion thereof).
Species: To be determined by City Arborist.
13. Subdivider shall pay sewer lift station fee of $171.50 prior to recordation of the
parcel map.
14. The City may be adopting traffic impact fees sometime in mid-1993. If adopted,
all applicable traffic impact fees shall be paid prior to the issuance of any building
permit.
