The purpose of this letter is to ask you to uphold the condition requiring Food-4-Less to limit its hours of operation to between 6:00 a.m. and 10:00 p.m. It is not clear whether they are also asking for any modification of delivery hours and/or parking lot maintenance. If so, I also request you to uphold those requirements, that is, that delivery hours are limited to between 7:00 a.m. and 9:00 p.m. and that parking lot maintenance and sweeping shall be limited to between the hours of 7:00 a.m. and 9:00 p.m. All those conditions imposed initially were imposed for good reason, and the reasons for the conditions certainly have not dissipated. The noise and pollution are here. Increasing the number of hours this store is in operation exacerbates those problems. Although Foods-4-Less, prior to opening of its store, indicated it wanted to be a good neighbor, its request to operate the store 24 hours a day does not demonstrate any concern for its neighbors' need for quiet, peaceful nights. When the Council granted the use permit it also established certain conditions to mitigate potential problems and to alleviate residents' concerns. Those potential problems and concerns have not changed since Food 4 Less opened early in 1998: 1. Privacy -- the Higuera Plaza parking lot and Food 4 Less store are directly across South Higuera Street from homes in The Meadows and Los Verdes Park #1. Residents in those homes need respite during night time hours from traffic to and from the plaza, from parking lot noises, and from headlight glare. 2. Security -- We observed the tendency of transients to "hang around" Madonna Plaza when Lucky Stores tried 24 hour operation. Security guards monitored the parking lot; fortunately, there were no private homes in the vicinity. Unfortunately, there are private homes in the vicinity of Food 4 Less and Higuera Plaza. We believe that a 24 hour retail operation at Food 4 Less would attract transients, some of whom stay along the creek with our homes between them and Higuera Plaza. As a result there would be a.greater potential for night time intrusions into The Meadows and Los Verdes Park. Parking lot guards at Food 4 Less or Higuera Plaza would not resolve that problem. 3. Traffic-- It is far too early to determine the traffic impact created by Higuera Plaza. Food 4 Less is only one of the locations planned for development. Not until the entire Higuera Plaza is operational and has had time to develop its customer base would traffic engineers be able to make a reasonably accurate estimate of traffic impact. That will probably be two to three years from now. We ask you to maintain the conditions that you included when you granted the use permit. Please do not revise condition 3 limiting the hours of operation to between 6:00 AM and 10:00 PM. In support of our request, we remind you that the residents of The Meadows, including those who favored granting a use permit to Food 4 Less at 154 Suburban Road, overwhelmingly asked you to limit the hours of operation, for the reasons cited above. We refer you to the survey responses of March, 1996, in which 86% of the respondents requested that hours be held to 6:00 AM - 10:00 PM. Thank you for your consideration. It has been less than one year since this issue was addressed in the original approval for this "warehouse" to operate. We and many of our neighbors (who were opposed to this project to begin with) resent the fact that we must again take time and energy away from our families and work to address this issue in writing and come in person to make an impression. Not long ago we appeared at the council meeting to object to road modifications that were agreed on last August Going to a 24 hour a day operation is far from the "neighborhood grocery" turned "warehouse" we were told would be appropriate for our neighborhood. How often can modifications be requested? We assume that requests of this nature will continue as often as allowed by law since the Food 4 Less print and radio ads all boast"open 24 hours a day." Please give some measure of protection to the quality of our neighborhood by denying this request to operate 24 hours a day. I feel the lateral program and the underground rebate program are a positive way of the City sharing the burden with the properly owners. What I have a hard time with are the doadlines. It seems to me that if I have a building that is structurally inferior (URM) I am rewarded ny having my deadline to install sprinklers cxtcnded until the year 2017, If, on the other hand, my hullding is structurally sound, I am penalized by having to bear the costs of sprinkler Installation much sooner, by the year 2002. 1 understand tho thinking behind the original extension given URM buildings, but in practice the outcomo seems to penalize those owners whose huildings are of better construction, Therefore, I would like to suggest that the deadline for all buildings be the same, that is the year 2017, Should you have any questions Bob. please do not hesitate to give me a call.
