CAO RECOMMENDATION (1) Adopt a resolution recommending that the Local Agency Formation Commission approve annexation of about 137 acres of City-owned open space, and amend its sphere of influence for San Luis Obispo as needed. (Attachment#1,with map) (2) Introduce an ordinance to prezone the annexation parcels Conservation Open Space with minimum parcel sizes of 120 and 40 acres (C/OS-120 and C/OS-40), and to remove the Specific Plan overlay zone from the part of the Mamo Family site that is already inside the city limits(Attachment#2). DISCUSSION Situation Over the years, the City has obtained ownership of several parcels intended for permanent open space and protection of natural resources. Some of these parcels are next to, but outside of, the city limits. Annexing these parcels will give the City jurisdiction to enforce rules that protect the resources, visitors, and neighboring property. Also, annexation will save the City property tax payments on the parcels,which come out of the Natural Resources operations budget. Proposed Action The City is worldng to secure an open space greenbelt, to protect its rural and natural setting. Most of the greenbelt is under County land-use jurisdiction. Fee ownership by the City is among the most reliable ways to maintain open land. The City obtains land (or development rights) by purchase, and by dedication in connection with approving developments. The Bishop Peak (Bunnell Ranch)property was recently purchased from a willing seller,as was the Maino Family property on Cerro San Luis. Several years ago,the Lemon Grove property on Cerro San Luis was a dedication from the French family in connection with the subdivision at the southwest end of Hill Street. The entire Bunnell Ranch site is outside the city limits,just west of the City's Ferrini Ranch open space. Most of the Lemon Grove and Maino Family sites are already inside the city limits. The City proposes to annex four parcels, as listed below. They would be zoned Conservation/Open Space, with a 120-acre minimulm parcel size for the Bishop Peak site and a 40-acre minimum for the Cerro San Luis sites.(C/OS-40). Action Deadline: This legislative action is not subject to processing deadlines under State law. Evaluation The annexations will unify the open space areas under the City's jurisdiction, giving the City the authority to enforce rules that protect the resources, visitors, and neighboring property. Having the parcels inside the city limits will also enable the City to retain property tax payments otherwise required on the parcels. The General Plan Land Use Element supports annexation to protect open space (policy 1.13.2). The minimum parcel sizes (shown in the recommended zone abbreviations) are moot on sites where no houses are to be built. However, they reflect the areas of the open space parcels. FISCAL IMPACT One-time LAFCo processing fees amount to about $3,200. Annual property tax savings are expected be in the range of $4,000 to $5,000. ADVISORY BODY REVIEW At a public hearing on April 8, 1998, the Planning Commission recommended approval of the recommended actions on a vote of 6 to 0 (1 absent). There was no public comment directly concerning the agenda item. (A neighbor of the Ferrini open space area at the end of Highland Drive strongly expressed concerns about the behavior of visitors to that area He was referred to the City's Natural Resources Manager and Parks & Recreation Director for help in resolving the problems.) The Planning Commission had previously recommended removal of the SP overlay zone from the Maino site. ALTERNATIVES 1. Not approve the annexation and zoning. 2. Continue consideration with direction to staff. (1998 Series) A RESOLUTION OF RECOMMENDATION BY THE SAN LUIS OBISPO CITY COUNCIL REQUESTING THAT THE LOCAL AGENCY FORMATION COMMISSION APPROVE ANNEXATION NO. 53 THE OPEN SPACE ANNEXATION (ANNX 10-98) WHEREAS, the Planning Commission and City Council have held hearings on the proposed annexation on April 8, 1998,and May 19, 1998 respectively; and WHEREAS, the proposed annexation is categorically exempt from environmental review, pursuant to the California Environmental Quality Act Guidelines Section15307(actions to protect the environment) and 15325 (acquisition of open space); and WHEREAS, on recommendation of the Planning Commission and as a result of its deliberations, the Council has approved an amendment of the Zoning Map by prezoning the annexation property to Conservation Open Space(C/OS); and . WHEREAS, City Council approval is a prerequisite for the San Luis Obispo County Local Agency Formation Commission (LAFCo) to initiate formal annexation proceedings; and WHEREAS, the territory to be annexed is uninhabited, and a description of the boundaries of the territory is set forth in attached Exhibit B; and WHEREAS, this proposal is consistent with the sphere of influence adopted by the Local Agency Formation Commission of San Luis Obispo County for the City of San Luis Obispo; BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1: Findings. 1. Annexation is appropriate since annexation sites' eastern sides are contiguous with the city limits. 2. Annexation of the sites is a logical addition to the City for uniform jurisdiction over City-owned open space, due to the sites' location and absence of development. 3. The proposed annexation will promote the health, safety, and welfare of persons living or working in the vicinity of the annexation area. 3-3 OF ' . Resolution No. Page 2 SECTION 2: Annexation Area Described. The annexation shall consist of that area, covering approximately 137 acres on the east side of Bishop Peak and the east side of Cerro San Luis, as shown on the site location map attached as Exhibit A and legally described in attached Exhibit B. SECTION 3: Council Recommendation. The City Council recommends that the Local Agency Formation Commission of San Luis Obispo County approve the proposed annexation. SECTION 4: Implementation. The City Clerk shall forward a copy of this resolution and prezoning actions, the Categorical Exemption of environmental impact, and all pertinent supporting documents to the Local Agency Formation Commission. (1998 Series) AN ORDINANCE OF TBE SAN LUIS OBISPO CITY COUNCIL ADOPTING ZONING FOR THE BISPOP PEAK AND CERRO SAN LUIS OPEN SPACE ANNEXATION AND AMENDING THE ZONING FOR ASSOCIATED PROPERTY(R 10-98) WHEREAS, the City Council conducted a public hearing on May 19, 1998, and has considered testimony of interested parties, the records of the Planning Commission hearing and action, and the evaluation and recommendation of staff; and WHEREAS, the action is categorically exempt from environmental review as part of an open space acquisition. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Findings. That this Council, after consideration of the proposed zoning, and the Planning Commission's recommendations, staff recommendations,public testimony, and reports thereon makes the following findings: A. The proposed C/OS zone is consistent with the General Plan. B. The proposed C/OS zone is consistent with the intended uses and locations of the zone as described in the Zoning Regulations. C. The proposed C/OS zone will be compatible with surrounding land uses. D. The"Specific Plan"overlay zone to be removed serves no purpose. SECTION 2. Adoption of Zone. The open space annexation and the open space parcel already within the city limits shall be zoned as shown on the attached Exhibit A. SECTION 3. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in the Telegram-Tribune, a newspaper published and circulated in this City.
