CAO RECOMMENDATIONS:
1. Approve project specifications for"Municipal Building Painting-Corporation Yard,
Specification No.400.9631.540.553"
2. Authorize staff to re-advertise for bids
3. Authorize the CAO to award the contract if the lowest responsible bid is within the engineer's estimate
DISCUSSION:
On December 17, 1996 the Council approved advertising for bids on the project titled"Municipal
Building Painting:Corporation Yard and Police Department". On March 6, 1997 the CAO
awarded a contract to the low bidder,Southwest Coatings. After completing the Police Station
portion of the project,on May 7, 1997 Southwest asked to be relieved of its remaining contract
obligations at the Corporation Yard. Suspecting that there were high concentrations of lead in
existing paint at the Corporation Yard,Southwest felt it was not qualified to perform scraping and
disposal of this hazardous material. Believing it was in the interest of both parties to terminate the
contract,on May 15, 1997 the CAO mailed a Notice of Contract Termination to the contractor.
Before Public Works could prepare a new set of specifications for the Corporation Yard work,a
materials testing firm had to examine samples of the existing paint. These tests confirmed the
presence of hazardous concentrations of lead in most of the existing paint coatings. Specifications
have been modified to include this information.
CONCURRENCES:
This project has received a categorical exemption from Community Development Department.

Budget Available 75,600
Estimated Additional Budget Needed
There is$100,600 remaining in the Corporation Yard Improvements budget,$75,600 for painting
(construction)and$25,000 for a prefabricatedtoxic materials storage building(equipment). If
more than$75,600 is needed for painting,additional money will be transferred from the budget
available for the storage building. If additional money is needed later for the storage building,
Public Works will either transfer it from the completed projects account or request an additional
appropriation from the Council.
