Jonas, Community Development Director (;o Prepared By: Glen Matteson,Associate Planner SUBJECT: Adoption of resolution approving the Fuller Road Area Annexation CAO RECOMMENDATION Adopt a resolution approving the Fuller Road Area Annexation. DISCUSSION The City Council initiated this annexation (attached map) in May 1997, to bring into the city the rest of the Edna-Islay Specific Plan area and to consolidate several anticipated individual annexation requests. In May 1998, Council approved a package of items supporting this annexation. Since then, several actions necessary for the annexation have been completed, including a tax-sharing agreement with the County and a hearing and approval by LAFCo. The Council conducted a required "protest hearing"on January 19, 1999. No protests were filed. This is the final procedural step needed to complete the City's part in the annexation process. CONCURRENCES Concerns of City departments and other agencies have been addressed in previous actions. ALTERNATIVES The recommendation is the only action that is consistent with previous Council actions. FISCAL IMPACT As outlined in previous reports, no significant cost or revenue changes will result from the recommended action. Both costs and revenues are expected to increase roughly in proportion with further development in the annexation area Attachments Draft resolution approving the annexation Vicinity map C4-1 RESOLUTION NO. (1999 Series) A RESOLUTION OF THE SAN LUIS OBISPO CITY COUNCIL ORDERING TERRITORY DESIGNATED AS THE FULLER ROAD AREA ANNEXED TO THE CITY OF SAN LUIS OBISPO (SEQUENTIAL NO. 53; CITY FILE NO. ANNX 70-97) WHEREAS, the Local Agency Formation Commission of San Luis Obispo County on December 17, 1998, conducted a public hearing and adopted Resolution No. 98-30, making determinations and approving the proposed annexation to the City of San Luis Obispo of territory described in the attached Exhibit A and by this reference incorporated herein; and WHEREAS, the terms and conditions of annexation as approved by the Local Agency Formation Commission were as follows: the City was required to hold a protest hearing; and WHEREAS, the reasons for this proposed annexation are: to make the territory subject to City land use regulations and to make the territory eligible for services provided by the City; and WHEREAS,the regular County assessment roll is utilized by this City; and WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness of this City; and WHEREAS, the City Council on May 5, 1998, by Resolution No. 8797, approved a Negative Declaration for the proposed annexation, pursuant to the California Environmental Quality Act and Guidelines;and WHEREAS, the City Council, by Ordinance No. 1337, has prezoned the territory consistent with the General Plan;and WHEREAS, the City, by City Council Resolution No. 8864, has accepted a negotiated exchange of property tax revenues for the territory with the County of San Luis Obispo,pursuant to Revenue and Taxation Code Section 99(b);and WHEREAS, a public hearing on this annexation was called for and held by this Council at the place and time noticed therefore on January 19, 1999, and this Council finds and determines that the value of written protests filed and not withdrawn is less than 25.percent of the registered voters residing within the territory to be annexed and less than 25 percent of the number of owners of land owning less than 25 percent of the assessed value of land within the territory; C4-2 Resolution No. Page 2 NOW, THEREFORE, BE IT RESOLVED that the Council of the City of San Luis Obispo hereby orders the territory described in Exhibit A annexed, and directs the City Clerk to transmit certified copies of this resolution with applicable fees required by Section 54902.5 of the Government Code to the executive officer of the Local Agenqy Formation Commission of San Luis Obispo County.
