RE: Naming of the city-owned adobe on Dana Street --' - --
Dear Mr. McMasters,
I understand that the question of an official name for the city-owned adobe at 466 Dana Street
has been discussed at a recent Cultural Heritage Committee (CHC) meeting. However, the
Board of the Friends of Las Casas de Adobe (FOCA) request that the Rem be revisited because
we befieve that we now have information that was not previously available to your Committee.
Our agreement with the City requires FOCA to"determine the most historically accurate name
for each adobe and submit that name to the City Council for approval."' As you know, the
choice of a"most historically accurate name" can be very subjective. When a house is to be
named after a person, R might be appropriate to use the name of the person who built the
house or the person who lived in the building the longest or most recently or to use the name of
some person of notoriety who rived in the house. In this case, after substantial research and
careful consideration, FOCA has chosen to name the building after Rosa Butrbn de Canet.
Rosa Marie Butrdn, bom in Monterey on August 30, 1812 ,was a granddaughter of Manuel
Butn5n who came to California in 1769 with Don Gaspar de Portola. In 1828, at the age of
sbdeen, she married Vicente Canet. In about 1840,they moved to the Rancho San Bernardo
near Morro Bay where, in 1858 Vicente died.The following year, Rosa married John Jacob
Simmler and in the 1860's they moved into San Luis Obispo. She lived in the adobe on Dana
Street for nearly thirty years until her death on December 13, 1890.
The chain of title for the property, unfortunately, does not give us the date of construction of the
adobe nor the name of the person who built R. However members of FOCA have been able to
establish the following chronology:
1861 -Request from Blas Castro to the town of San Luis Obispo for the property is granted.
1865- Blas Castro to J.J. Simmler

1907- Property inherited by Simmlers second wife, Mary LaFranchi.

1935 -W.F. Waterman to daughter Mildred Waterman.
1958- Mildred Waterman to Mary Gail Black.
1986- Mary Gail Black deeded property to the City, with an agreement that she be allowed to
live out her days on the property.
Based on the deed from Mary Gail Black, a copy of which is attached, and on personal
communication from her and her heirs, it is Gear that Ms. Black did not want the names Simmler
or Waterman attached to the adobe. (She did ask that Mildred Waterman's name be included in
any name that is given to the site should it become a City park).
Based on the significance of Rosa Butr6n as an historical figure and in deference to the wishes
of Ms. Black, FOCA has chosen "Rosa Butr6n de Canet Adobe" as the official name for this
important building. A copy of minutes of our meeting of October 13, 1997 is attached showing
our action at item IIE.
I understand that the next step in this process of defining the official name is to confer with the
CHC as the advisory body to the City Council on historical matters. Please consider this letter to
be our application for approval of the name "Rosa Butr6n de Canet Adobe". We look forward to
hearing from you.

Minutes from the meeting October 13, 1997
at the Rosa Butron de Canet Adobe, 466 Dana Street, San Luis Obispo
Present: Luther Bertrando, Carolyn Paige, Carol McPhee Norton, Ann FitzGerald, Betsy
Bertrando, Stephen Macie, Dean Miller, Astrid Gallagher, Matt Whittlesey, Jeanne
Smith, Jennifer Silva, Charles Silva, Diller Ryan, Augie Barre, Pricilla Graham, Mary
Fickes, Myron Graham, James Fickes.
Meeting called to order at 7:00 PM by Matt Whittlesey
T. Minutes of September 8, 1997 were corrected in subject ILEI as per Ann FitzGerald's suggestion.
Minutes approved as corrected.
[IA. Report on the workday at the Rodriquez,Sept.20, 1997. Roofing was completed. Steve suggests
a certificate of appreciation for the volunteers,especially Wes Armstrong and John
Suggest looking into a story by the T-T.
IIB. Astrid reported that insurance has been purchase to cover liability for volunteer workers at a cost
of$3768 per year. She suggests we keep in mind the cost when we schedule workdays to
accomplish as much as possible under coverage. Jim Fickes suggested Astrid inquire as to the
possibility of suspending the insurance during times of inactivity.
IIC. A lengthy discussion on preparations for EI Niflo for the Rosa Butron de Canet Adobe ensued.
Final conclusion was that any preventative measures we take would fall short of their objective. It
was decided that the usual groups associated with each adobe would monitor the effects of the
rains when they start and make modifications as needed.
IID. Jim Fickes report the flag for this group is finished. Further work on mounting is required. The
AIA meeting was informed of the 10:00 AM October 25, 1997 design charette meeting at the
Rodriquez Adobe. Designs will be finished at the Rosa Butron de Canet Adobe with coffee,
sandwiches, and cold drinks offered the participants. It was also announced that the City has
$13,000 available for public art for the Rodriquez Adobe.
11E. Astrid Gallagher moved/Ann Fitzgerald 2nd that the official name of the adobe at 466 Dana street
be the"Rosa Butron de Canet Adobe. Passed unanimously.
IIF. With insurance in hand,Murray Adobe will be available as soon as we sign the contract.
IIG. October 25, 1997 set for workday at the Rosa Butron de Canet Adobe to prepare for November
18, 1997 fund raiser. Addition raffle prizes will be solicited.
IIH. RFP were sent out and one reply received. That reply refused services due to insurance problems.
Now that we have insurance,a notice should go out to all who received the RFP informing them
of this new status.
I1-1. Astrid Gallagher passed out a summary of the quarterly(really semi-annual)report which will be
given to the City. That report will be filed with the minutes.

property, from the Board of Trustees for$30.56 An adobe house was built, which is located at 466
Dana Street, and there the children would visit Rosa. She and J. J. Simmler never had children.
Josd Agustin Cand managed to keep -the property he inherited from his father. On 21
November 1888,he died. His wife, Valentina, filed for the distribution of a portion of the estate of
Vicente Canet on 19 March 1894. The wishes he expressed in his will were met and the division
of the estate was made in open court on 15 December 1897. (The record of the division of the
property is included in the Probate Court file . )57
Rosa Maria inherited 480 acres of land from her father's estate in addition to the portion of the
Rancho San Bernardo which she inherited from Vicente Cand. She and Simmler traveled to
Monterey County in December 1861 and again in April-1861 in connection with the inheritance
from her father. Luiz Castro was already using the land and bought it from Rosa for $600, or
$125 per acre.5s
J. J. Simmler sold a portion of the Rancho San Bernardo to David P. Mallagh in 1860.
Acreage was sold to Domingo Pujol in 1862, and Esteban Quintana bought a portion. In 1869, H.
Y. Stanley bought that section of the rancho on which the adobe was located, and on 2 October
1880, it was deeded to Pietro Righetti.S9 Pietro (Peter) Righetti's family made it their home for
many years.
Rosa Maria de Simmler became ill in 1888. Subsequently, her granddaughter, Margarita
Soto de NarviLez (Narvaiez), and Margarita's daughter, Marcelina, traveled from their Morro Bay
rancho to help her. They stayed with her for two years, until Rosa died on 13 December 1890.
The San Luis Obispo Tribune carried her obituary in their Sunday morning issue of 14
December 1890. It read:
Simmler — at her residence - in this city, on Dana St. Saturday, Dec. 13th, 1890, after a
prolonged illness Rosa M. C. Simmler, beloved wife of J. J. Simmler. Funeral will take
place at 8:45 am. Monday Dec. 15th, 1890, thence to the Catholic Church, where a Solemn
High Mass of requiem will be celebrated for the repose of her soul, commencing at 9 o'clock
a.m. Funeral cortege from the church at 10 a.m. Friends and relatives are invited to attend.
According to her death certificate, Rosa Maria Simmler was 80 years, 3 months and 13 days
old at the time of her death.60 However, her headstone at the San Luis Obispo Catholic Cemetery
reads:

Died Dec. 13, 1890.
At the age of 81 yrs.
Rest in Peace.

S. To maintain the structures• utility services and yard area on
the described property. Said maintenance shall include structural roof
repair as needed, yard maintenance including thinning and trimming of
trees and shrubbery substantially as the yard 1s now, and keeping the

water and sewer services operable. Nothing provided for herein should be
construed as preventing Grantor from calling an electrician, plumber or
other service repairman In an emergency, In which event the City will be
responsible for said emergency service bill. Except as provided herein.
City will be responsible for any necessary repairs to said structure
unless the necessity Is denied by the City within ten (10) days of
receiving written notice that said repair or maintenance is required.
4. To be responsible for all real property taxes and assessments
Imposed upon said property from the date of this deed.
a. To allow ingress and egress over the driveway along the
southwesterly 12' of conveyed property to provide access from Dana Street
to the residences at 460 Dana and 462 Dana Street. Grantor's adjoining
property generally described as San Luis Obispo County Assessor's Parcel
No. 02-401-11.
6. To disallow the public use of said property during the lifetime
of Grantor.
7. In the event of failure to comply with any of the covenants and
conditions herein contained, said City, and any successor thereof, shall
forfeit all title to said real property and, in the event of any such
forfeiture• title to said real property shall revert to Grantor.

This- single story structure is deeply set back from the street. It has
a broadly pitched roof and slightly extending eaves. The front porch

SIGNIFICANCE

One of the few adobes constructed in the 1800's that still stands today in
San Luis Obispo is the Simmler-Waterman Adobe. Probably built in the
1876's or 1870's, it served for years as the home of John Jacob Simmler
who probably constructed the adobe residence. A native of Malhausen, France,
and college professor of painting, Simmler came to San Luis Obispo in 1852
at the age of twenty-six. He was an early pioneer, a hotel keeper and
merchant, a "police judge" in 1876 and most notably a postmaster in 1874, .
a position which he held until 1890.

CLR1. Council Member Schwartz submitted a report regarding the activities of
the Economic Vitality Commission. He noted that the load fund to aid businesses
seeking start up assistance was in good standing; an interesting copy of the
Economic Strategy Report of the City of E/Paso de Robles is now available to
Council Members;and to date the EVC has not achieved full sponsorship from all
cities in the county.
CLR2. Vice Mayor Romero reported on the activities of the California Men's
Colony Citizen's Advisory Committee. He stated that the rate of increase of new
prison inmates has dropped and that this will affect the need to build new
facilities;it is not certain how this will impact CMC. The committee also
discussed the hazards of early morning visitors to CMC who park on Highway 1
prior to opening time, and reopening the snack bar that accommodates visitors
outside the prison fence.
CLR3. Council Member Marx reported that the Equal Opportunity Commission is
holding a national conference this week at the Embassy Suites. She praised the
EOC as a foremost nationwide community action agency dealing with issues of
child care.

RECOMMENDATION: 1) Adopt a resolution to approve a negative declaration
of environmental impact. 2) Adopt a resolution recommending that the Local
Agency Formation Commission approve annexation of about 14 acres in the
west part of the Margarita Area. 3) Introduce to print an ordinance to prezone
the annexation area Conservation/Open Space with minimum parcel sizes that
would prevent subdivision. 4) Approve, and authorize the Mayor to sign, a pre-
annexation agreement with the land owner. 5) Direct staff to work with the
County to prepare an agreement for exchange of property taxes that recognizes
the eventual residential use of the property.

vesting tentative tract map to take effect on the effective date of the planned
development rezoning as recommended by the Planning Commission.
FINAL ACTION: Staff directed to meet with developer to consider modifications
based on the Council's input(5:0). There was general agreement that no
homeowners association be established if all goals can be addressed through an
open space easement
3. AMENDMENT TO THE BICYCLE TRANSPORTATION PLAN
(MCCLUSKEY/208-02 - 30 Min.)
RECOMMENDATION: 1) Adopt a resolution denying a request to amend the
City's Bicycle Transportation Plan to change the designation of the 1300 block of
Santa Rosa Street (between Pacific and Pismo Streets) from Class 11 Bicycle
Lanes to a Class 111 Bicycle Route; and 2) remove the existing bicycle lanes
along both sides of the 1300 block of Santa Rosa Street and install curb parking
along its east side (about eight spaces).

Comm1. Vice Mayor Romero raised a concem regarding the safety of the
pedestrian crosswalk on Higuera Street between Morro and Chorro Streets and
requested that staff be directed to investigate the reinstallation of a traffic signal
at that location.
ACTION: Council directed staff to prepare and bring back a report on
alternatives to improve pedestrian safety in heavily used crosswalks,
without addressing speck crosswalks. Altematives should not only
include traffic signals, but other strategies and technologies. Following
receipt of this report, the Council may direct staff to address certain
specific locations.
Comm2. Vice Mayor Romero summarized his memo regarding inappropriate
trees planted in parkways, and the liability and damage due to roots. He asked
Council to direct staff to initiate a program to remove inappropriate trees in the
Laguna Lake area and plant the proper species.
ACTION: Council directed staff and the Tree Committee to investigate the
tree root problem.
Comm3. Council Member Marx reported that the San Luis Obispo Council of
Governments recently agreed to sponsor action to designate that portion of
Route 1 through San Luis Obispo County between the City of San Luis Obispo
and the Monterey County line as a National Scenic Byway or All American
Roadway.
Comm4. Council Member Marx requested that the City Attorney provide legal
opinions on 1) City subsidies of rent for various groups, and 2) the effects of
SB50(schools exempt from CEQA provisions).
Comms. City Clerk Price submitted a tentative schedule for upcoming Council
issues.
Comm6. CAO Dunn reported that the Bishop Peak Trail Dedication is Friday,
March 5, at 2 p.m.

RECOMMENDATION: 1) Adopt a resolution to approve a negative declaration
of environmental impact. 2) Adopt a resolution recommending that the Local
Agency Formation Commission approve annexation of about 14 acres in the
west part of the Margarita Area. 3) Introduce to print an ordinance to prezone
the annexation area Conservation/Open Space with minimum parcel sizes that
would prevent subdivision. 4) Approve, and authorize the Mayor to sign, a pre-
annexation agreement with the land owner. 5) Direct staff to work with the
County to prepare an agreement for exchange of property taxes that recognizes
the eventual residential use of the property.

RECOMMENDATION: 1) Introduce to print an ordinance approving a mitigated

conditions, a planned development and planned development rezoning, as

vesting tentative tract map to take effect on the effective date of the planned
development rezoning as recommended by the Planning Commission.
3. AMENDMENT TO THE BICYCLE TRANSPORTATION PLAN.

RECOMMENDATION: 1) Adopt a resolution denying a request to amend the
City's Bicycle Transportation Plan to change the designation of the 1300 block of
Santa Rosa Street (between Pacific and Pismo Streets) from Class //Bicycle
Lanes to a Class /// Bicycle Route; and 2) remove the existing bicycle lanes
along both sides of the 1300 block of Santa Rosa Street and install curb parking
along its east side (about eight spaces).
