CAO RECOMMENDATION:
By motion,appoint Lynn James,Landy Fike,Bill Walter,Tom Swem,Jerry Whitaker and Dave
Kastner to the SLO Downtown Association Board of Directors.
DISCUSSION:
The SLO Downtown Association completed its annual elections in February for the Board of
Directors positions with terms expiring March 31, 1999. In accordance with the association's by
laws,the membership has voted on a slate of candidates to appoint these members for one two-
year term.
The ballots were tabulated by the nominating committee and the election results will be confirmed
at the upcoming March board meeting. New board members require City Council approval before
they can assume their positions on April 1, 1999.
The following board members were elected to serve until March 31,2001.

SUBJECT: Recommendation of Official Names for Three City-Owned Historic Adobes
CAO RECOMMENDATION
Adopt a resolution officially naming three City owned historic adobes as follows: La Loma de la
Nopalera Adobe(1590 Lizzie Street); Rodriguez Adobe (end of Brookpine Drive); Rosa Butron de
Canet de Simmler Adobe(466 Dana Street).
DISCUSSION
Backeround
The City owns several Mexican era adobes, three of which are being restored with the assistance of
a non-profit organization, the Friends of Las Casas de Adobe (FOCA). Under the terms of the
contract between the City and FOCA, the organization was charged with determining the most
historically accurate names for each adobe and submitting those names to the City Council for
approval. Once the official names have been determined, they are to be used for all future
references to the adobes.
FOCA has now completed historical research relating to each adobe and its recommended names
have been reviewed by the Cultural Heritage Committee (CHC). In the case of two adobes, the La
Loma de la Nopalera and Rodriguez, the CHC approved FOCA's recommendations. However,
there was a disagreement between the CHC and FOCA regarding the name for the adobe located at
466 Dana Street.
466 Dana Street Adobe
The adobe located at 466 Dana Street was deeded to the City in 1986 by Mary Gail Black. The
difficulty in providing a name for this adobe arises from a conflict between the historical chain of
ownership and language in the 1986 deed and other personal correspondence where Ms. Black
made it clear that she did not want the name "Simmler" (the name of the original owner's second
husband) attached to the adobe. Instead, she wished it to be referred to as the "Canet Adobe".
Respecting Ms. Black's wishes, FOCA proposed that the adobe be named the "Rosa Butron de
Canet Adobe". (See Attachment 2,CHC minutes for October 27, 1997).
The adobe was originally owned by Rosa Butron de Canet,whose second husband was John Jacob
Simmler. Rosa and John Simmler lived in the adobe from 1874 to 1890. The CHC felt strongly
that the adobe's name should not be simply the "Canet Adobe" because there is already another
adobe in the county so designated. It also believed that "Rosa Butron de Canet de Simmler Adobe"
was the most historically accurate name, since Rosa Butron lived in the adobe both as the widow of
Vincente Canet and the wife of John Simmler. At its October 27, 1997, meeting, the CHC
approved the longer name.

FOCA was disappointed with this decision, and asked that it be reconsidered by the CHC. To
substantiate its proposal, FOCA provided additional information concerning the deed and Ms.
Black's wishes. After reassurance from the City Attorney (Attachment 3) that including the name
Simmler in the title would not invalidate the deed from Mary Gail Black, the CHC reaffirmed its
earlier decision. (Attachment 4, CHC minutes for January 26, 1998). At this time, FOCA is
willing to accept the CHC recommendation.
1590 Lizzie Street Adobe
FOCA recommends, and the CHC agrees, that the adobe located at 1590 Lizzie Street should be
called the "La Loma de la Nopalera Adobe". (Attachments 5 and 6). In 1842, after the
secularization of the missions, this part of the former mission lands was granted to Francisco
Estevan Quintana by the governor. In a trade with Don Quintana,Maria Concepcion Boronda took
ownership of a comer of the property known as "La Loma de le Nopalara" (the hill of the prickly
pear cactus). At the time of the trade, the property included the original, one-story portion of the
adobe. It remained in Senora Boronda's family until Charles Bowden took ownership in 1902. The
Bowden family dedicated the adobe to the City in 1995. Since the adobe has been popularly known
as "La Loma" for many years, and the property has held the name "La Loma de le Nopalera" since
at least 1842,that is the name being recommended.
Brookpine Drive Adobe
This adobe was built about 1850 on land granted to Jose Maria Villavicencio and his wife Rafael
Rodriguez. After several quick changes of ownership in the early 1850's, it was sold to Solano
Rodriguez, a son-in-law of Senor Villavicencio. The property continued to be sold at least 17 more
times, including, once again, to the Rodriguez family. Finally, it was purchased by the Pacifica
Corporation in 1988 and dedicated to the City two years later as part of the Islay housing
development project. Since the house has been called the "Rodriguez Adobe" for many years, and
since families with the Rodriguez name have held ownership off-and-on since granting of the
original Rancho, FOCA felt that it was the most historically accurate and appropriate name. The
CHC concurs with this recommendation. (Attachments 5 and 6).
CONCURRENCES
The Friends of Las Casas de Adobe (FOCA) and the Cultural Heritage Committee (CHC) concur
with the proposed names.
FISCAL IMPACT
There is no fiscal impact to the proposed action.
ALTERNATIVES
The Council could choose to accept "Rosa Butron de Canet Adobe" as the name for the building at
466 Dana Street. This name was proposed by FOCA as being more in keeping with the desires of
Mary Gail Black when she deeded the property to the City. However, the CHC felt that it was less
historically accurate.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
OFFICIALLY NAMING THREE HISTORIC ADOBES
WHEREAS,the City of San Luis Obispo owns several historic Mexican-era adobes; and
WHEREAS, the City of San Luis Obispo has a contractual relationship with the Friends
of Las Casas de Adobe(FOCA)to assist with the restoration of the adobes; and
WHEREAS, the contract with FOCA requires that it provide the City with proposals for
the most historically accurate names for the adobes; and
WHEREAS, the Cultural Heritage Committee has reviewed and approved FOCAs
recommended names.
NOW,THEREFORE,BE IT RESOLVED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. The adobe located at 466 Dana Street be called the "Rosa Butron de Canet
de Simmler Adobe".
SECTION 2. The adobe located at 1590 Lizzie Street be called the "La Loma de la

Regular Meeting of Monday,October 27, 1997

APPROVAL OF MINUTES: On a motion by Schrage, seconded by Matt Whittlesey,
the minutes of the special and regular meetings held o eptember 22, 1997 were approved as
submitted, on a 7-0 vote.
Committee members thanked Alice Loh for her service on the C and noted that this was
Ms. Loh's last CHC meeting, as she had been appointed to serve on th chitectural Review
Commission. The Committee then held an election to replace Ms. Loh as irperson. On a
motion by Paula Carr, seconded by Loren Nicholson, Steven McMasters w ointed as
Chairperson to fill out Ms. Loh's term of office, which expires March 31, 1 Matt
Whittlesey will continue to serve as Vice-Chairperson until the next election of offi in
April 1998.
DISCUSSION ITEMS
1. Review CHC letter to the City Council regarding Chinatown Preservation and
Cultural Heritage Center; Alice Loh.
Committee members asked Mr. Hook to make several minor changes to the letter for the
Chairperson's signature and then forward it to the City Council.
2. Request by the San Luis Obispo Friends of Las Casa s de Adobe (FOCA) to change the
historic name of the Dana Street adobe to the "Rosa Butr6n de Canet Adobe;" Astrid
Gallager.
Matt Whittlesey, representing FOCA, explained the request. After discussion, on motion by
Paula Carr and seconded by Steven McMasters, Committee members voted 7-0 in favor of
changing the name of the Dana Street Adobe at 466 Dana Street to the Rosa Butr6n de Canet
de Simmler Adobe", finding that: 1) although the property's donor, Mary Gail Black, asked
that the adobe be named the Canet Adobe, there was already a Canet Adobe designated in the
County, so that "Cant Adobe" was not an appropriate historic name; 2) Rosa Butr6n de Canet

de Simmler Adobe was appropriate because Sra. Butron was an early and long time resident of
the adobe as widow of Vincente Canet and wife of John Jacob Simmler.
Committee members noted that although the formal historic name was somewhat long,
informally the property would be called the "Rosa Butr6n Adobe."
3. eview draft table of contents for the City of San Luis Obispo Historic Preservation

Committee embers discussed a draft table of contents for the Historic Preservation Program
Guidelines p ared by Paula Carr, and divided the various sections up among the members.

Committee members agreed that by the CHC's vember meeting, each member would have
an outline of his or her topic for discussion.
Alice Loh suggested that the updated guidelines inclu detailed descriptions of the historic
districts, including signage, architectural and public are design standards, and landscape
elements.
4. Advisory Body communications: CHC recommendations to he Architectural Review
Commission and City Council.
Alice Loh noted that recent Architectural Review Commission decisio related to historic
preservation did not seem to reflect City policies or CHC recommenda ' ns on historic
preservation. She felt that improved communication was needed between the C and ARC,
and recommended that the CHC have a representative at any ARC or City Co il meeting
when a CHC recommendation or historic preservation matter was on the agenda. a noted
that her appointment to the ARC would help improve communication between the two a isory
bodies.
It was suggested that a joint CHC/ARC meeting would be helpful, and there was general

Subject: 466 Dana Street
You have requested an opinion whether using the name "Rosa Butron de Canet de
Simmler Adobe"would violate the provisions of the Grant Deed by Mary Gail Black.
ANALYSIS
The Grant Deed, dated July 26, 1989, sets forth seven conditions, the last of which
provides:
"7. In the event of failure to comply with any of the covenants and
conditions herein contained, said City, and any successor thereof, shall forfeit
all title to said real property and, in the event of any such forfeiture, title to
said real property shall revert to Grantor."
In the conveyance portion of the deed, the property is referred to as being"...properly
called the Canet Adobe (rather than the "Simmler Adobe" or the "Waterman Adobe"
as it is sometime referred to) ..." . In addition, there is a request "...that Mildred
Waterman's name be included in any name that the City gives to this park area."
While this language is not specifically included in the seven conditions agreed to by
the City, there is an ambiguity as to whether this could potentially constitute a
covenant pursuant to Paragraph 7 of the deed. It seems somewhat doubtful that
naming it "Rosa Butron de Canet de Simmler Adobe" really violates the spirit of the
deed since it includes the name Canet. At the same time, Mary Gail made her wishes
clearly known concerning the use of Mildred Waterman's name, and I think it would
be appropriate to honor her request. Perhaps it could be called the Mildred
Waterman Park or Garden.

Astrid Gallagher, of Heritage Shared, introduced new non-profit historic preservation
corporation in San Luis Obispo County dedicated to public ucation, and invited CHC members
to attend a program entitled "In Search of Chinese San Luis bispo" to be held on Saturday,
February 70, 1998. She also encouraged members to join He ' e Shared and to consider
serving on the new organization's board of directors.
APPROVAL OF MINLMS:
On a motion by Amy Kardel, seconded by Paula Carr, the minutes of the special m ting held
on December 16, 1997 were approved as amended, on a 6-0 vote.
DISCUSSION ITEMS:
1. Request to reconsider the historic name of "Rosa Butr6n de Canet de Simmler
Adobe." (McMasters). (Continued from the November 24 and December 16, 1997
meetings).
Bob Vesseley, member of the Friends of Las Casas de Adobe, introduced the item and turned
the presentation over to Carol McPhee Norton, Ann Cruikshanks, and Ann Fitzgerald to
request that the "de Simmler" name not be used. Ms. Norton explained that she was a close
personal friend of Mary Gail Black, the donor of the adobe on Dana Street. She said that Ms.
Black had told her emphatically not to call the adobe the "Simmler Adobe", but instead, to
refer to it as the Canet Adobe. Ms. Black never explained her reasons for this, but suggested
that it may have been due, in part, to rumors that Mr. Simmler had deprived members of the
Canet Family their inheritance.

Ms. Norton pointed out that Ms. Black made a significant contribution to the City, and that her
wishes should be respected. Moreover, the Friends of Las Casas de Adobe had assumed
primary responsibility for the adobe and that it was their members' preference not to include
Simmler's name in the adobe's historic name. She felt that the adobe's Mexican heritage was
not reflected in the use of Simmler's name.
Committee member Nicholson said he was pleased with the idea of naming the adobe after a
woman and said he wouldn't mind naming the grounds after a woman as well - Waterman
Park. What really concerns him is that in Rosa's day, it was typical for a married woman to
add the names of her husband(s) to her name, joining them with "de Canet, de Simmler" and
so on. Her obituary listed her name as "Simmler", and the CHC's recommended adobe name
reflects both her maiden name, Butr6n, and the names of her two husbands. By deleting "de
Simmler" from her name, we would be, in effect, rewriting Rosa's history and not accurately
reflecting the City's mixed heritage.
Ms. Norton said the Canet family is a large one, and recently, some Canet family members
had donated funds to the adobe because they were so pleased to have Canet in the adobe's
name. She felt that there could be negative reaction if Simmler's name were included.
Committee member Carr cited a 1906 document which referred to the "Simmler Home Place",
a 1931 reference to the "Simmler or Butr6n Adobe", and a 1983 Historic Resources Inventory
submitted to the State of California by the City referring to it as the Simmler-Waterman
Adobe. She noted that people of Mexican/Spanish descent were not the only ones who built
and lived in adobes, and could not understand why Ms. Black felt the adobe was "properly
called the Canet adobe", since Canet never lived at the adobe, and Mr. Simmler outlived his
wife - Canet's widow — by 16 years. There is already a "Canet Adobe" located in the Chorro
Valley. The only connection to Canet is that the adobe may have been built with widow
Rosa's inheritance from Canet. Simmler's connection with the adobe was direct - the
preponderance of evidence shows Simmler had a long and important connection with the adobe
and with Rosa. If her children had no trouble with using the Simmler name in her obituary,
why should the City not use the name in honoring her now?
Amy Kardel thanked members of FOCA for addressing this issue and for their role in
supporting the adobes. She felt that the recommended name "Rosa Butr6n de Canet de
Simmler" was consistent with the "spirit" of Mary Gail Black's donation, since the City is not
naming the adobe after Simmler, but after a woman whose true name included Simmler.
Bob Pavlik agreed with Committee member Kardel. He felt that regardless of how some might
view Simmler as a person, the CHC should base historic names on facts and not on rumors or
personal preference. The adobe's recommended name reflects the ethnic complexity of its era.

Loren Nicholson felt that the CHC's action should be historically accurate, and wondered what
Rosa Butr6n would've thought about her name being changed. She would probably say "give
me my true name. I lived through the Mexican and California periods and my name reflects
that."
Chairperson McMasters agreed with previous comments and felt that the CHC's October
action was appropriate, recommending that the City Council approve the full historic name
including "de Simmler", with the shorter "Rosa Butr6n Adobe" on the historic plaque. He
asked staff whether the CHC needed to take any additional action on this item.
Mr. Hook explained that unless the Committee wanted to..change its October action, no
additional action was needed. Staff would forward the C, IC's recommendation to the City
Council with minutes and historic documentation for final Council action on the adobe's
historic name.
Committee members agreed with that approach.
Mr. McMasters thanked the FOCA members for attending.

Committee members reviewed a revised Draft Table o Contents and confirmed assignments.
It was agreed that members would meet with staff to get all available resources to draft their
portions of the guidelines. Using the January 26, 98 draft Table of Contents, members took
the following sections:

Ms. George,
In accordance with our responsibilities, the Board of the Friends of Las Casas de Adobe(FOCA)has
agreed on a recommendation for the names for the two remaining City adobes.You'll recall that the
name for the Rosa Butron de Canet de Simmler Adobe was approved by the Cultural Heritage
Committee last year. Following are the recommendations of the Board and a brief review of the
information we used in each decision:
La Loma de la Nopalera Adobe.
During the Spanish period, the property around the adobe was part of the mission lands. In 1842, after
secularization of the missions,the property, then referred to as"La Vena"or°La Vino, was granted to
Francisco Estevan Quintana by Governor Micheltorena. Shortly thereafter, Maria Concepcion Boronda
took ownership of a comer of°La Vina' in a trade with Don Quintana.The comer that she acquired was
known as"La Loma de le Nopalera°.(the hill of the prickly pear cactus)'.At the time of the trade,the
property included the original, one-story portion of the adobe. Senora Boronda and her husband Oliver
Deleissegues added a second story sometime before 1846 and moved int. In 1851, after the death of Mr.
Deleissegues, Senora Boronda Deleissegues married Don Jose Maria Munoz who became the mayor of
San Luis Obispo and a judge in the 1860's. Judge Munoz died in 1874 and one of Maria Concepcion's
sons began dividing up the property. In 1902, Charles Bowden took ownership of the portion containing
the adobe3 and it remained in the Bowden family until dedicated to the City in 1995.
Since the adobe has been popularly known as La Loma for many years and the property has held the
name La Loma de le Nopalera since at least 1842, the FOCA Board felt it was the most appropriate and
historically accurate name for the adobe.
Rodriguez Adobe.
This adobe which dates from about 1850 was built on land known as the Rancho Corral de Piedra which
was granted to Jose Maria Villavioencio and his wife Rafael Rodriguez in 18414. In December of 1851,
Henry Amos Tefft, a state assemblyman and judge takes ownerships but he dies a year later and the
property goes to his wife, Maria Josepha Dana. She sells the property to Pollard who quickly sells it to
Solano Rodriguez, a son4n-law of Vliavicencio. Ownership passes through Roth, Dahlman, Goldtree
and Hollister before a survey of the property in 1867 discovers that the house is not actually on the
Rancho Corral de Piedra. The land containing the house is re-patented to Israel Levy6 and it goes
through a series of 13 different owners including,again, the Rodriguez family until it was purchased in
1988 by the Pacifica Corporation. Pacifica developed the property and in 1998, dedicated the adobe
and a small piece of land to the City.

Co 'ttee voted 7-0, finding that the proposed building demolitions or relocations at 1616 and

2. Consideration of ting the following properties to the Contributing Properties
List: 368, 369, 375, 3 3959 3989 4519 4539 476, 482 and 487 Chorro Street.
Chairman McMasters opened the blic hearing. Mary Russell, 398 Chorro Street, said she
supported historic listing for her pro as long as she could modify the landscaping to be
more drought tolerant and add a front alio wall, in keeping with the house's original
architectural theme. Committee members a unanimously that the landscape changes and
patio wall she described would not pose any pro b in terns of historic listing and would not
require any special City review. Christina Muller, Chorro Street, also supported historic
listing for her property and asked whether it might q ify for the Master List of Historic
Resources. Committee members encouraged Ms. Mulle to work with staff to provide
additional historic documentation which might meet the eligi ' ity criteria for Master List
properties.
Committee members then considered each property's photograph and his 'c documentation
individually and on a motion by Committee member Schrage, seconded by Co 'ttee member
McDonald, the Committee nominated the following properties to the Contributin roperties
list: 368, 369, 395, 398, 451, 453, 476, 482 and 487 Chorro Street. Committee tubers
indicated that 391 Chorro Street was Potentially Contributing, due to changes in the on inal
windows.
DISCUSSION ITEMS
3. Review a recommendation by the Friends of Las Casas de Adobe to change the historic
name of the Bowden/La Loma Adobe to "La Loma de la Nopalera Adobe"; and
confirming the name of the historic "Rodriguez Adobe."
Astrid Gallagher explained that the Friends of Las Casas de Adobe (FOCA) were under an
agreement with the City to restore, preserve, and operate the City's three historic adobes, and
as part of that responsibility, FOCA has also been asked to research and recommend
appropriate historic names for each adobe. She indicated that the two suggested names had
been carefully researched by FOCA members and asked the CHC to endorse the names.
On a motion by Paula Carr, seconded by Bob Schrage, the Committee endorsed the historic
names "La Loma de la Nopalera Adobe" and the "Rodriguez Adobe."
