Deny the request for waiver of fees
DISCUSSION
The San Luis Obispo Child Development Center is proposing to establish a new facility on County
land off of Bishop Street between General Hospital and the County Probation Department. The
Center is a non-profit program that has been providing child care and child abuse prevention,
intervention, and treatment services to County residents. The Center is currently renting space on
Southwood Drive which they will lose in September of this year. They would like to begin the
permitting process soon, in order to construct and occupy their new facility behind General Hospital
by the September deadline.
The project will involve both discretionary land use and building permit approvals. Day care
centers are identified as a conditionally permitted use within the R-1 Single Family Residential
zoning district which is applied to the property. In addition, the site and modular building
improvements will require Architectural Review by the City's Architectural Review Commission
(ARC). Finally, the development is classified as a "project" by the California Environmental
Quality Act(CEQA) and will require the preparation of an environmental analysis by the City.
Planning Fees
The discretionary land use and environmental fees described above total $1,648. Based on the
City's Cost of Service Study of 1995, the total cost to the City for processing these discretionary
approvals is $6,600. In establishing the planning fee schedule, the Council choose to recover only
25% of the City's processing costs with planning fees. Waiver of these fees would therefore cost
the City's General Fund $1,648 that would normally be paid to accomplish the City's 25% cost
recovery goal.
Building Fees
The applicants propose to construct approximately 6,200 square feet of building area. Based on the
size, type, and value of construction, the building permit fees would total $36,000. The fees can be
"broken down" into Building Permit Fees - $1,725, Plan Check Fees - $1,570, and Development
Impact Fees - $32,700. These fees are established to cover staff time to review and issue the
building permit, inspect the construction project, and pay for impacts that the development will have

on water, wastewater, and traffic. Waiver of these fees would fail to recover these City costs as is
the policy of the City Council.
Past Council Actions Reeardiniz Fee Waivers
It has been past practice of the City Council to limit waiver of fees by non-profit agencies. The City
Clerk's office does not maintain separate records of.past fee waivers. However, in the past 5-10
years,planning staff is aware of only two instances where a non-profit group was granted a planning
fee waiver. The first, was the waiver of architectural review fees for the Housing Authority
pursuant to Council policy for affordable housing incentives. The second,was for the waiver of the
administrative use permit fee for use of a City adobe for meeting purposes. The adobe use permit
fee was waived because the non-profit group involved has a formally recognized City partnership to
restore three City-owned adobes, and the meetings are for that purpose. Staff is unaware of any
Council approval of a requested fee waiver for building permit fees.
The City has a policy to recover costs involved in the City permit process. Historically, this has
applied to applications made by private, public, and non-profit groups. There are numerous non-
profit agencies and groups performing equally worthwhile activities in the City. Waiving the
processing fees for one could set a precedent for other requests thereby having a cumulative
financial impact on City resources. Finally, it should be noted that the City provides extensive
financial assistance to non-profit groups through annual allocation of special City grant funding and
Community Development Block Grant awards.
FISCAL IMPACT
As stated above, approval of the waiver will have a direct fiscal impact of $37,650 on the City's
General, Water, and Sewer Funds. If the fees are waived, $13,000 would be lost in Water Impact
Fees, $5,400 in Wastewater Impact Fees, and $12,400 in Traffic Impact Fees. The larger fiscal
impact question is one of the cumulative drain on City financial resources should similar requests
by other non-profit groups be supported.
ALTERNATIVES
Approve the waiver of all or a part of the land use, environmental, building permit/plan check, and
impact fees for the San Luis Obispo Child Development Center. Should the Council wish to take
this course of action, staff suggests waiving the discretionary planning and environmental fees of
$1,648.

Pursuant to our recent conversation,attached please find a copy of the estimated fees for the proposed CDC
facility.You will note that Mr.Hanula based the valuation on a 7,200 square foot building.As the project is
in the design development phase and therefore continues to evolve, it may be important to communicate
that we have recently reduced the building to 6,200 s.f. One assumes that this may impact the estimated
fees.
For your information,the proposed site has recently been surveyed,the site/grading plan is being revised to
reflect the topography and we are in constant contact with the building manufacturer to refine the foot print
and floor plan. We are also working closely with the San Luis Obispo County General Services staff to
analyze the infratstructure/utility aspect of the project.
As you know, we have a very compressed time frame in which to accomplish a variety of programming,
design, permitting and construction tasks. We appreciate your efforts to date and want to thank you in
advance for your considerate preparation of the staff report to accompany our request for the fee waiver.

EOC refers young children and their families who are in need of a therapeutic child
development program because of severe abuse and trauma. This program is funded by
the State Department of Education and Office of Child Abuse Prevention. The quality
and success of CDC is demonstrated by its quality services offered to our community
since 1971.
The waiver of the fees enables the program to have the facilities in place by September
1999. As you are aware child care programs are always fundraising to pay the bills
month to month. The City has always been a key supporter of this project. Now is a
chance for CDC to have a permanent home.
As a nonprofit, EOC works closely with other nonprofits toward our mutual success and
partnership. Children from low income families who have experienced extreme trauma
will continue to be served because of the City's generosity. What's marvelous is that this
is another example of a city-county-nonprofit-community collaboration.

REQUEST FOR WAIVER OF CITY OF SAN LUIS OBISPO FEES
BACKGROUND
The San Luis Obispo Child Development Center has been providing child care and child abuse
prevention, intervention, and treatment services for City of San Luis Obispo families since 1971.
We have been funded and supported by the City of San Luis Obispo Grants-in-Aid program for the
past 18 years. The Center is a non-profit charitable program contracted directly with the California
Department of Education and is one of two child abuse intervention programs in our county funded
by the Office of Child Abuse Prevention. We have an excellent reputation in the community and
are supported by service and employee organizations (including United Way), our own fundraising
efforts (Singing Valentine Cookie-Grams) and donations in addition to our government funding
sources. Annually, our program serves an average of 85 children and 80 parents and is funded at
approximately$450,000. 85% of the children and families served are City of San Luis Obispo
residents. Our government funding sources specify that funding must be used only for direct
services and may not be used for capital expenses.
While we are totally regulated by the state, our unique relationship as a child development/child
care program for children with severe abuse trauma, gives us access to state resources that would
ordinarily not be available to a non-profit.
OUR PROBLEM
The Center is losing its rented facility on September 6, 1999. We have done an extensive search
and there is no facility available for us to rent in the City of San Luis Obispo which can be licensed
to provide center-based services for children. We have been approved for a no-interest state loan
to purchase modular buildings to house our program. These funds are only available to us and
must be used for modular buildings. The state requires that the buildings be placed on public tan
and an arrangement with the County of San Luis Obispo to lease us land behind General Hospital
for$1.00 per year is currently in process. The State of California will own the buildings until our
loan with them is paid. Our state loan will barely cover the cost of the buildings which means we
will have to secure additional funding (grants, loans, etc.). First Bank of San Luis Obispo will be
assisting us with this part of the project. The state will not release 13y of the funding until we have
a uermit aooroved by the City. Our new building will allow us to expand our program to meet the
need in the community (we currently have over 175 children on our waiting list) as funding
becomes available. We need funding to no directly to the children's oroaram, so every cost we
can defray will heir). We need to be in our new facility by September 6, 1999 so our timeline is
very short.
OUR REQUEST
We would like to request a waiver of City planning and building fees to help us create this new
home for our program. This is a unique project which will be a wonderful opportunity for a State,
City, County, non-profit and community partnership to help children and families. With state and
other funding sources emphasizing collaboration, this project will exemplify what can be
accomplished if we all work together.
We plan to incorporate a beautiful sculpture dedicated to children, which will be donated by local
artist, Jim Jacobson, as part of our entryway. The City will be acknowledged as a major partner in
this project on a plaque in the entryway.
We hope that you will help us to make our dream of a facility for our most vulnerable children ano
families a reality. 3_8
The San Luis Obispo Childevelopment Center is a non-profit cob- _unity program providing child
abuse prevention,intervention,and treatment services to children and families in San Luis Obispo
County since 1971. The Center's program is unique not only in SLO County but also in the State. We
are the only children's programs under the California State Department of Education providing a
combination of child development and mental health services. The Center serves an average of 80
parents and 85 children annually.
Our Center receives support from the Office of Child Abuse Prevention and Department of Education
Child Development Division,City and County of San Luis Obispo,United Way,Central Coast Funds
for Children,private contnbutions,and fund raising activities.
Families are referred to the Center by: Child Protective Services,County Health Department,Mental
Health,the Suspected Abuse Response Team,public schools,physicians and other mental health
providers. Services are provided at no cost to families,however parents must be willing to avail
themselves of the services listed below.
Our Center is open five days a week all year round from 7:00 a m.to 6:00 p.m.and offers the following:

a An environment which fosters the constructive release and expression of feelings.
a Activities which enhance the child's social skills and cooperative behavior.
a Activities and adult role models which foster self-control and responsible behavior.

a Opportunities for problem solving decision making,and making appropriate choices.
a Constructive carry-over from school(homework and study skills).
o Activities designed to assist in the formation of positive and meaningful relationships with
adults and peers.
a Opportunities to respect themselves and others.
a 80%of the child's daily nutritional needs.
FOR PARENTS:
a Family counseling.
o Parent education and support
a Networking with/for community services and programs.
FOR FAMILIES:
a A warm and homelike environment—a feeling of family,community,and belonging. An opportunity to
experience acceptance,make positive changes,and heal from trauma
FOR COMMUNITY:
o To advocate and educate.
Early intervention and prevention services for these families will result in cost savings in the
future. Children who receive services will not be seen later on in the juvenile court system or in
our prison system. Healthy families create healthy communities.

Dear Mayor Settle,
The San Luis Obispo Child Development Center would like to respond to the staff
report regarding our request for waiver of City building fees for our new Center. We
hope that you will support our request for the fee waiver at the May 4, 1999,
meeting. This is a wonderful opportunity for a collaborative partnership to HELP
OUR COMMUNITY'S CHILDREN.
Please consider the following:
1) Our program is a STATE FUNDED AND REGULATED (California State
Department of Education) non-profit program. The buildings will be owned by the
STATE DEPARTMENT OF EDUCATION until we pay back our no-interest loan.
The buildings will be on COUNTY PROPERTY (leased for $1.00 per year). This

2) We are borrowing the funds to purchase DSA approved modular buildings from
the State Department of Education. No other program or non-profit can obtain
these funds. We do not have funds to pay fees. All of our other funds must go to
services for the children and families. We can pay a mortgage to the state, but
not fees!
3) WE SERVE CITY RESIDENTS! 85% of the children and families we are currently
serving are low income CITY RESIDENTS. Our waiting list has 145 children and
their families and 98% are CITY RESIDENTS.

4) We bring over $450,000 annually in services to the City of San Luis Obispo's
most vulnerable children and families which will be lost if we cannotget our
building done in time.
5) WE NEED TO REQUEST YOUR ASSISTANCE TO GRANT US AN EARLY
GRADING PERMIT! The ARC is backed up until 6/21/99 and OUR GRADING
MUST BE COMPLETED BY 6/21/99 in order to get our facility done in time.
(OUR TIMELINE IS ATTACHED.) PLEASE HELP US WITH THIS!!! We must
EXPEDITE THE PERMIT PROCESS AS WE CANNOT HAVE ANY DAYS OF
NONOPERATION
6) We have had contracts through City Grants-In-Aid for over 18 years and are one
of the highest funded programs. We were notified of the loss of our rented facility
too late to apply for Community Development Block Grant funds.
7) This is an opportunity for the City to make a POSITIVE STATEMENT OF
COMMITMENT FOR CHILDREN so that a Littleton, Colorado will never happen
here. THAT'S what our prevention and intervention program is all about! The
fees you waive will return to the City many times over as we prevent crime,
violence, and victimization by helping our children and families to lead more
positive and productive lives.
8) We hope you will consider our request ON ITS OWN MERIT and not based on
the possibility of future requests by other agencies.
