DISCUSSION Backeround Mary Jane Duvall was a secretary to the Mayor at the time that the Mission Plaza was being developed. Upon her passing, she left her entire estate to the City of San Luis Obispo to be used in carrying forward the basic intentions of the Mission Plaza This condition was accepted by the City and the Trust Fund is currently maintained by the Finance Department. The trustee of the Trust Fund offered the City a gift of up to $25,000 ($20,000 for design and production of a sculpture and up to $5,000 for site design and installation)to be used for creation of a sculpture to be placed along the proposed San Luis Obispo Creek Walk. The artwork was required be a free standing, life sized sculpture of an animal or animal grouping, which represents the type of creatures that would be or would have been found along the San Luis Obispo Creek corridor. The terms of the gift also limited the eligibility of the artist to a resident of San Luis Obispo County and established procedures for the request for proposals and selection of the artist, including the selection jury. At its November 11, 1998 meeting, the City Council passed a resolution approving the offer of the gift and all its accompanying terms and conditions. . A request for proposals was developed based on the terms and conditions of the gift and was widely distributed with the assistance of the San Luis Obispo County Arts Council and the San Luis Obispo Art Center. Twelve proposals were received and were reviewed by a selection committee chosen by the trustee. Committee members were Myron Graham, Pierre Rademaker, Robert Reynolds, Linnaea Phillips and David Foote. It was the unanimous decision of the committee that the proposal submitted by Sandra Kay Johnson was of the highest artistic level and most clearly met the requirements imposed by the trust. The Sculpture The artist's concept for the sculpture is a lifesize grouping of creek wildlife and water flow patterns, wrapped around a 36" sphere, symbolizing the continuity of the web of life. The animal grouping includes egrets,ducks, a raccoon, an opossum, a rabbit, a bat, a salamander and a frog. The surface and form invite safe play, touching and discovery. It will be cast in bronze for its stability and low 4-1 Council Agenda Report-Creek Walk Sculpture,Mary Jane Duvall Trust Page 2 maintenance in an active public site, and will be mounted on a concrete base approximately 15" high. The artist offered two potential locations for the sculpture within the Creek Walk design. The Committee felt that the work would be most visible and approachable if it were placed in the semi- circular planter proposed to be built at the end of the new bridge crossing the creek from in front of the Greenery store. (See Attachment 2.) This location places the sculpture near the Children's Museum and the tactile nature of the work invites interaction with viewers, especially children. The selection committee, which included the Creek Walk designer, has offered to explore with the sculptor the possibility of developing a base which will allow the piece to be slowly revolved by hanCONCURRENCES The trustee of the Mary Jane Duvall Trust has given his approval to the sculpture's design. As required by the City's Art in Public Places Policy,the Architectural Review Commission found that the sculpture met the City's requirements for public art at its April 19, 1999, meeting. The Parks and Recreation Commission has also had an opportunity to be apprised of the design. The Art in Public Places Committee of the San Luis Obispo Arts Council has endorsed the design. FISCAL EMPACT The cost of the sculpture is estimated to be $20,000 and will be paid from the Mary Jane Duvall Trust. Up to $5,000 for ground preparation and installation is also available from the trust. Once approval of the design concept has been given by the Council, staff is asking that the CAO be authorized to sign an agreement with the sculptor formalizing the terms of the working relationship with the City. Attachments 1 -Resolution No. 8869 2- Location map for sculpture 3 -Photograph of sculpture maquette 4-Resume of Sandra Kay Johnson The maquette,a full scale drawing and a sketch of the sculpture are available in the Council Office. 4-2 \_ J RESOLUTION NO. 8869 (1998 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ACCEPTING A GIFT FROM THE MARY JANE DUVALL TRUST FUND FOR THE CREATION OF A SCUPTURE ALONG THE SAN LUIS OBISPO CREEK WALK WHEREAS, the Mary Jane Duvall Trust Fund was established to carry forward the basic intentions of the Mission Plaza; and WHEREAS, the trustee believes that a financial gift to the City for the creation of a sculpture to be placed along the San Luis Obispo Creek walk meets the intentions of the trust; and WHEREAS, the trustee has offered the City a gift of up to $25,000 ($20,000 for the design and production of the sculpture and up to $5,000 for site design work and preparation) to create such a sculpture; and WHEREAS, the trustee has established preliminary conditions of the offer of the gift which the City finds to be acceptable. NOW,THEREFORE,BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the City is extremely pleased to accept the offer of a gift of up to $25,000 from the Mary Jane Duvall Trust Fund for the creation of a sculpture to be placed along the San Luis Obispo Creek Walk. SECTION 2. That the City agrees to follow the preliminary conditions of the offer shown in Attachment A to the best of its abilities. Should the City be unable to follow those conditions for any reason, it will work with the trustee to develop mutually agreeable alternatives.
