SUBJECT: ACQUISITION OF TEMPORARY EASEMENTS AND PROPOSAL FOR
ENVIRONMENTAL MONITORING FOR THE SANTA ROSA STREET
BRIDGE RECONSTRUCTION PROJECT, SPECIFICATION NO. 93-44F &
9344G.
CAO RECOMMENDATION:
1. By resolution,accept right of way agreements for temporary construction easements needed for the
bridge replacementat Santa Rosa Street.
2. Authorize the Director of Public Works to sign the right of way agreements on behalf of the City.
3. Direct finance to issue checks to the individuals in accordance with the right of way agreements.
4. Approve the Request for Proposals for Environmental Monitoring and authorize staff to distribute the
request
5. Authorize the CAO to award the contract for Environmental Monitoring not to exceed$40,000.
6. Appropriate $8,000 from the unappropriated balance of the General Fund and $32,000 in grant
revenue and move it the Santa Rosa Street Bridge construction account for environmental monitoring.
DISCUSSION:
In December of 1996,the Council approved an agreement with Quincy Engineering for the design of the
Santa Rosa Street bridge. That work included right of way acquisition. At that time, the Council
authorized funding for the acquisition of temporary construction easements. The right of way agent has
made these acquisitions in conformance with Federal laws for such work. One acquisition is still
outstanding;however,the property owner indicates they do not have any problems with the agreement
and expect to get it to us shortly.
The proposed bridge project does not include acquiring any additional property,but rather the purchase of
temporary construction easements to facilitate construction, allow for stream diversions through the
construction site and complete mitigation planting as required by the Army Corps of Engineers.
In addition to planting to offset the impacts of construction,there will be the need for the City to hire
consultants to monitor construction activities and practices. The monitors will insure that steps are taken
to comply with the permits received from regulating agencies and to watch for archeological material
during excavation.
Construction of the bridge is planned for this summer. We anticipate that plans and specifications will be
before the Council for approval the second meeting in May.

FISCAL IMPACT:
This project is funded in part through the Federal Highway Administration Highway Bridge
Rehabilitation and Reconstruction program. The project will receive 80%reimbursement for the right of
way expenses and environmental monitoring.
Funds Budgeted for Acquisition: Acquisition Costs:

* The final document for a portion of this property has not been signed. The portion has been valued at
$500. The need for the additional acquisition at this property was not known until the final Army Corps
of Engineers permit was issued requiring mitigation planting on the area adjacent to the project site.
Environmental Monitoring:
No funds have been budgeted for Environmental Monitoring as this is a relatively new requirement of the
regulatory agencies. Staff estimates the cost will be between $30,000 and $40,000 depending on the
duration of creek work. The City portion would be$6,000 to$8,000.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO
ACCEPTING RIGHT OF WAY AGREEMENTS AND CERTIFICATES
OF ACCEPTANCE FOR EASEMENT DEEDS NEEDED ON THE
SANTA ROSA STREET BRIDGE AT SAN LUIS CREEK
BRIDGE REPLACEMENT PROJECT
SPECIFICATION NO.93-44
WHEREAS,the City proposes to replace the Santa Rosa Street bridge at San Luis Obispo Creek,
and
WHEREAS, replacing the Santa Rosa Street bridge requires the acquisition of temporary
construction easements over private property;and
WHEREAS,the City has successfully negotiated right of way agreements and easement deeds
with the property owners;
NOW THEREFORE BE IT RESOLVED that the City Council of the City of San Luis Obispo,
California hereby accepts Exhibits 1, 2, 3, 4, 5, 6, 7, 8, 9 as temporary construction easements for the
completion of the Santa Rosa Street Bridge reconstruction project. .
