CAO RECOMMENDATION: Introduce an ordinance to print amending the site's C-S-S zoning to eliminate the previously ap- proved master list of allowed and conditionally allowed uses and adding "wildlife impacts as a result of human activity' as an issue to address as part of the site's Special Consideration zoning. DISCUSSION Data Summary Applicant: Sansone Company, Inc. Representative: Garth Kornreich, Architect Zoning: Service-Commercial with Special Consideration (C-S-S) General Plan Land Use Designation: Services and Manufacturing Environmental Status: On January 4, 1996 the Council approved a Negative Declaration for the rezoning of the propertyfrom Manufacturing to Service-Commercial with Special Consideration. This environmental determination adequately addresses the current request. Project Action Deadline: Legislative actions not subject to processing deadlines. Site Description The 3.93 acre site is located on Orcutt Road near Broad Street and is currently vacant and occa- sionally used as a horse pasture. Acacia and Sydney creeks generally follow the eastern and western property lines. Surrounding uses include services and manufacturing to the north, resi- dential to the south, and vacant land to the east and west(see Attachment 3). Project Description The applicant is proposing to amend the site's C-S-S zoning to eliminate the previously estab- lished master list of allowed and conditionally allowed uses. The applicant is interested in pur- suing a C-S allowed use on the property that is currently not an allowed or conditionally allowed use on the master list. At present, the master list allows uses such as grocery stores, liquor, and specialized foods which are no longer permitted in the C-S zone. Additionally, the master list 2-1 Council Agenda Report-Sansone Rezone Page 2 allows over 30 uses by right (without requiring approval of an administrative use permit). If the proposed amendment to the site's zoning is approved, the Special Consideration zone would re- quire (at the minimum) approval of an Administrative Use Permit for any C-S use proposed on the property. Advisory Body Recommendation On July 28, 1999, the Planning Commission reviewed this request and unanimously recom- mended approval of the zoning amendment to the City Council. General Plan Consistency The proposed amendment to the site's C-S-S zoning is consistent with the Services and Manu- facturing land use designation in the General Plan which calls for "activities such as business services, wholesaling, building contractors, utility company yards, auto repair, printing, food manufacturing, and other light manufacturing, and retail sales of large items, bulk quantities, and items often stored outdoors (vehicles, building materials, plants). Areas reserved for these uses may also accommodate convenience restaurants and other activities primarily serving area work- ers." This proposal will align the uses allowed on the property with this General Plan purpose. Further, the proposed amendment to the site's zoning corrects a current inconsistency because the established master list allows the retail sales of groceries, liquor, and specialized foods which is no longer consistent with the Services and Manufacturing land use designation. Analysis of Zoning Amendment In 1996, the City Council approved the rezoning of the subject property from Manufacturing (M) to Service-Commercial with Special Consideration (C-S-S). The Special Consideration zone was established on this site and the adjoining property to the west to ensure that a specific com- mercial development plan of the properties adequately addresses traffic, circulation, creek pres- ervation, and downstream drainage impacts. As part of the rezoning, a list of allowed and condi- tionally allowed uses was established for the site in conjunction with a specific development proposal for the site. The development proposal was never pursued and now the property has changed ownership. The new property owner is now requesting that the established list of allowed and conditionally allowed uses be removed from the site's zoning. The purpose of this is twofold. One, site spe- cific use lists are very difficult to keep track of for staff as well as the general public. Second, the commercial project envisioned with the established list of uses is no longer planned, therefore, it seems more appropriate to go back to evaluating each newly proposed use consistent with the total list of allowed C-S uses as well as to how it addresses traffic, circulation, creek preserva- tion,and downstream drainage impacts. 2s2 Council Agenda Report-Sansone Rezone Page 3 In staff's review of the previous actions on the property, wildlife impacts were raised as a poten- tial issue. To address this issue, the list of allowed and conditionally allowed uses approved as part of the rezoning included general criteria to minimize adverse impacts on wildlife resulting from human activity near the creek. Because the proposed list is now.proposed to be eliminated, staff recommends that wildlife impacts be added as an issue to be addressed as part of the Special Consideration zoning to ensure this potential impact is addressed in conjunction with any devel- opment proposal. Environmental Review In 1995, an environmental initial study was prepared for the site's rezoning from Manufacturing to Service-Commercial with Special Consideration. The initial study identified no potentially significant environmental impacts as a result of the rezoning. Further, the initial study identified the establishment of a master list of permitted and conditionally permitted uses as an acceptable alterative to reviewing each use as it is proposed in conjunction with the site's Special Consid- eration zoning. Because the proposed amendment to the site's C-S-S zoning requires adminis- trative use permit approval for any C-S allowed use before it can be established, no further envi- ronmental review for the zoning amendment is required. CONCURRENCES No other departments object to eliminating the master list of allowed and conditionally allowed uses at the site. Project specific requirements form other departments will be incorporated as conditions of future Architectural Review Commission and/or Administrative Use Permit ap- provals. ALTERNATIVES 1. Deny the proposed zoning amendment if the Council finds the amendment is inconsistent with the General Plan. 2. Continue review with direction to the applicant and staff. Attachments 1. (1999 Series) AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING THE ZONING REGULATIONS TO ELIMINATE THE PREVIOUSLY APPROVED MASTER LIST OF ALLOWED AND CONDITIONALLY ALLOWED USES AND TO ADD "WILDLIFE IMPACTS AS A RESULT OF HUMAN ACTIVITY" AS AN ISSUE TO ADDRESS AS PART OF THE SITE'S SPECIAL CONSIDERATION ZONING AT 791 ORCUTT ROAD (R 62-99) WHEREAS, the Planning Commission conducted a public .hearing on July 28, 1999, and recommended approval of the amendment to the site's zoning; and WHEREAS,the City Council has held a public hearing on August 17, 1999 and has considered testimony of other interested parties,the records of the Planning Commission hearing and action, and the evaluation and recommendation of staff, and WHEREAS, the City Council finds that the proposed revisions are consistent with the General Plan,the purposes of the Zoning Regulations and other applicable City ordinances; and WHEREAS,the City Council has considered the Negative Declaration approved by Council for the site's previous rezoning for its adequacy in evaluating this request;and BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. The elimination of the site's master list of allowed and conditionally allowed uses and the addition of"wildlife impacts as a result of human activity" as an issue to be addressed as part of the site's Special Consideration zoning(R 62-99) is hereby approved. SECTION 4. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in the Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect at the expiration of the thirty (30)days after its final passage. SUMMARY RECOMMENDATION Recommend that the City Council amend the site's GS-S zoning to:. (1)eliminate the master list of allowed and conditionally allowed uses, and (2) add "wildlife impacts as a result of human activity"as an issue to address as part of the.site's Special Consideration zoning. BACKGROUND This item was continued from the Planning Commission meeting of July 14, 1999 without discussion. The following report is the same as the one before the Commission on July 14, 1999. Situation The Planning Commission reviews zoning amendments and makes a recommendation to the City Council,which takes a final action onsuch requests. On January 4, 1996 the City Council approved. the rezoning of the subject property from Manufacturing (M) to Service-Commercial with Special Consideration (C-S-S). The Special Consideration zone was established on this.site and the adjoining property to the west to ensure that development of the properties adequately addresses traffic, circulation, creek preservation, and downstream drainage impacts. As part of the rezoning, a list of allowed and conditionally allowed uses was established for the site. The list identifies "allowed uses", "uses allowed with Director's approval by letter", "uses allowed by administrative use permit", "uses allowed by Planning Commission use permit", and "uses not allowed" in lieu of requiring use permit approval for any use (as required by the Special Consideration zone). The list also includes the following general criteria to minimize impacts on wildlife resulting from human activity near the creek: 1. No outdoor speakers or amplified music is allowed in conjunction with any use established 2. Outdoor activities such as sales, storage, repair, or play areas shall be limited in size and oriented toward Broad Street and away from the creep subject to administrative use permit approval. .2-9 R 62-99,Sansone Rezone Page 2 3. Outdoor dining and seating shall be limited to an area similar in size and configuration to the one shown on the attached conceptual site plan. The rezoning (which included the master list of allowed and conditionally allowed uses) was approved in conjunction with a specific commercial development envisioned for the site as well as the adjoining property to the west (see Attachment 2). The commercial development envisioned with the rezoning is no longer planned, therefore,the list of allowed and conditionally allowed uses (see Attachment 3) specifically approved for the site is no longer needed or desired. EVALUATION Section 17.70 of the San Luis Obispo Municipal Code provides for amendments to the Zoning Regulations. Any amendment to the Zoning Regulations must conform to the City's General Plan. If the Planning Commission denies an amendment, the action is final unless appealed. If the Planning Commission recommends approval of an amendment, Commission action shall be in the form of a recommendation to the City Council with findings for approval. When the list was originally developed in 1994, it was developed specifically for some highly visible properties on Broad Street. When the subject property was proposed for rezoning a year later, the same list of allowed and conditionally allowed uses was applied to this property. According to the parties involved in the Broad Street rezoning, there was not specific request of the owners to exclude contractors yards. The contractors yard use was eliminated because it was not included as a use in their planned commercial development. At staff's request, the applicant is now requesting that the established list of allowed and conditionally allowed uses be removed from the site's zoning. The purpose of this is twofold. Commissioner Senn refrained from participation due to a potential conflict of interest. Planner Mandeville presented the staff report and recommended forwarding a recommendation that the City Council amend the site's C-S-S zoning to (1) eliminate the master list of allowed and conditionally allowed uses and (2) add "wildlife impacts as a result of human activity" as an issue to address as part of the site's Special Consideration zoning. Commissioner Loh questioned how wildlife will be monitored. Planner Mandeville stated monitoring will include review of uses and their potential impacts to wildlife, such as noise. Commissioner Loh commented that downstream drainage impacts included in the staff report are very important. There were no further comments/questions and the public comment session was opened. PUBLIC COMMENT: Garth Cornright architect representing the applicant, agrees with staff s recommendation for amending the C-S-S zone. He noted the master list of approved uses was approved for a specific project on this site and the adjacent site, but the project was never realized and was abandoned. The master list is no longer relevant to the site nor desired by the owner/applicant or the city. This is a win-win situation for both the city and the applicant. Seeing no further speakers come forward, the public comment session was closed. COMMISSION COMMENT: Commissioner Whittlesey moved to recommend that the City Council 1 amend the site's zoning to eliminate the master list and the conditionally allowed uses and(2)to add "wildlife impacts as a result of human activity"as an issue to address as part of the site's Special Consideration zoning..
