AT 3001/3045 JOHNSON AVENUE; JUDSON TERRACE LODGE, APPLICANT. CAO RECOMMENDATION Grant final passage to Ordinance No. 1364 (1999 Series). DISCUSSION On December 13, 1999, the City Council voted 5 -0 to introduce Ordinance No. 1364 to print This ordinance approves a mitigated negative declaration of environmental impact (ER 106 -99), and amends the City's Zoning Regulations map from R -1 (Low- Density Residential) to R-4-S (High- Density Residential with a Special Considerations overlay) to provide for the development of senior frail elderly housing at 3001/3045 Johnson Avenue. The special considerations ( "S ") overlay zone is a tool to guarantee that future development addresses neighborhood compatibility issues such as noise, lighting, parking and aesthetics. In addition, future development will be limited to two stories. The "S" overlay zone also requires an administrative use permit to establish proposed uses on the property. Ordinance No. 1364 is now ready for final passage. A summary of the ordinance, with the official Council vote, will be published at least five (5) days prior to its final passage in the Tribune. This ordinance will go into effect at the expiration of thirty (30) days after its final passage. Environmental Review The City Council approved a Negative Declaration with mitigation measures (ER 106 -99) for the proposed rezone on December 13, 1999. ER 106 -99 addressed potentially significant, but mitigable, impacts to land use compatibility, traffic/circulation, parking, noise, lighting, geologic hazards, drainage and solid waste. Impacts to other environmental areas were determined to be less than significant The Mitigated Negative Declaration concluded that the project will not have a significant adverse impact on the environment. C4 -1 Council Agenda Report R 106 -99 (Ordinance 1364) Page 2 Consequences of Not Taking the Recommended Action If the council does not give final passage to the ordinance, the property's land use and zoning designations would remain R -1 (Low- Density Residential), and the planned senior frail elderly housing project could not be developed. ATTACEN ENTS 1. Ordinance No.1364 JShoah/CC/Ord1364(Second) C4 -2 ORDINANCE NO. 1364 (1999 Series) AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING THE ZONING REGULATIONS MAP TO CHANGE THE DESIGNATION FROM R -1 to R-4-S AT 3001/3045 JOHNSON AVENUE (R 106 -99) WHEREAS, the Planning Commission conducted a public hearing on November 17, 1999, and recommended approval of the amendment to the City's Zoning Map; and WHEREAS, the City Council held a public hearing on December 13, 1999 and has considered testimony of other interested parties, the records of the Planning Commission hearing and action, and the evaluation and recommendation of staff.; and WHEREAS, the City Council finds that the proposed revisions are consistent with the General Plan, the purposes of the Zoning Regulations and other applicable City ordinances; and WHEREAS, the City Council has considered the draft Mitigated Negative Declaration of environmental impact as prepared by staff and reviewed by the Planning Commission; and BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. The City Council finds and determines that the project's Negative Declaration with the recommended mitigation therein adequately addresses the potential significant environmental impacts of the proposed project, and reflects the independent judgment of the City Council. The Council hereby adopts said Negative Declaration and incorporates the following mitigation measures into the project: A Special Considerations ( "S ") overlay zone shall be placed on the property. The "S" overlay zone is a tool to guarantee that the neighborhood compatibility issues are not overlooked. The special consideration overlay will document that any proposed development on the site should be reviewed for neighborhood compatibility and will require an administrative use permit to establish proposed uses on the property. Potential land use compatibility issues will be addressed through project design and incorporation of adequate buffers. 2. Future development on the site shall incorporate facilities for interior and exterior on -site recycling. In addition, site development shall include a solid waste recycling plan for recycling discarded building materials such as concrete, drywall, wood and metals from the construction site. The plans must be submitted for approval by the Community Development Director prior to building permit issuance. 3. Any development on the site shall require architectural review to assure that impacts to views and light/glare are addressed properly. C4 -3 Ordinance No. 1364 (1999 Series) Page 2 SECTION 2. The City Council makes the following findings: 1. R4-S zoning will allow uses that are compatible with existing and allowed land uses in the area. 2. The "S" overlay zoning will document that any proposed development should be reviewed for neighborhood compatibility and require the processing of an administrative use permit to establish any use. Future development shall not exceed two- stories. 3. The proposed zone change will not be detrimental to the health, safety or welfare of persons residing or working in the vicinity because the zone change will result in the property being developed with residential uses. SECTION 3. The Zoning Regulations Map Amendment (R 106 -99) is hereby approved and the property rezoned to High Density Residential with Special Considerations (R -4 -S) as shown on attached Exhibit "A." SECTION 4. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in the Telegram - Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect no sooner than thirty (30) days after its final passage.
