CAO RECOMMENDATION . Adopt a resolution to participate in regional commercial recycling education program. DISCUSSION Background Last year the California bottle bill was modified by SB 332. This bill added several new items to the list of containers which required a deposit. For example, plastic water bottles are now included in the California Redemption Value list of containers. Another change with SB 332 was the inclusion of a block grant program to cities and counties. The funding provided to each jurisdiction is based on population with a minimum amount of$5,000 year. The City's allotment this year is $12,525. This funding must be used on either beverage container recycling or litter control The San Luis Obispo County Integrated Waste Management Authority (IWMA) held a meeting with staff from the member jurisdictions to discuss how to best use these funds. The consensus from the meeting was to establish a commercial (including multi-family housing and schools) recycling education program. The IWMA has confirmed with the California Department of Conservation (DOC) that the proposed program is eligible for funding. In the City during 1999, Commercial garbage accounted for approximately 75% of the total waste generated. It is envisioned that a representative from the newly created program would meet with commercial customers to either start or expand their recycling program. The IWMA would enter into the necessary contracts with the local recycling companies to implement this program. In addition, the IWMA would apply for the fiords and manage the grant. The commercial recycling program was presented to the IWMA Board at the March 8, 2000 meeting. At the meeting, the Board approved the program. Regional funding is expected to be about $70,000 per year. The attached resolution (Attachment '1) is required by the DOC and authorizes the IWMA to act on the City's behalf. FISCAL IMPACT There is no direct fiscal impact associated with the recommended action. ATTACHMENTS C84Attachment 1-Resolution Attachment 1 RESOLUTION No. (2000 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AUTHORIZING THE SAN LUIS OBISPO COUNTY INTEGRATED WASTE MANAGEMENT AUTHORITY TO ACT ON THE CITY'S BEHALF IN SECURING DEPARTMENT OF CONSERVATION FUNDS FOR A REGIONAL COMMERCIAL RECYCLING PROGRAM WHEREAS,the people of the State of California have enacted the California Beverage Container Recycling and Litter Reduction Act that provides funds to cities and counties for beverage container recycling and litter cleanup activities;and WHEREAS,the California Department of Conservation's Division of Recycling has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures for cities and counties or their designees under the program; and WHEREAS,per Section 14581 (a)(4)(E) of the California Beverage Container Recycling and Litter Reduction Act,the eligible participant must submit the Funding Request Form by the due date and time in order to request funds from the Department of Conservation's Division of Recycling. BE IT RESOLVED that the City Council of the City of San Luis Obispo as follows: SECTION 1. The City Council authorizes the San Luis Obispo County Integrated Waste Management Authority to submit the Funding Request form to the Department of Conservation's Division of Recycling on its behalf. SECTION 2. The City Council authorizes and empowers the Manager of the San Luis Obispo County Integrated Waste Management Authority to execute in the name of the City of San Luis Obispo all necessary forms hereto for the purposes of securing payment to implement and carry out the purposes specified in Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act, and provide information regarding this program to the Division upon request. SECTION 3. The City Council authorizes the San Luis Obispo County Integrated Waste Management Authority to be the responsible party to provide records to the Division should an audit be performed.
