DISCUSSION In closed session on April 4,the City Council authorized staff to begin negotiations with SLOPSOA and to develop a successor agreement to replace the current MOA which expires June 30,2000. The City's bargaining team of Ann Slate and Karen Jenny met with the SLOPSOA team on May 5, 2000. A tentative agreement was reached at that initial session and was approved in concept by the City Council on June 6,2000. The agreement includes: Salary Increases: Year 1 2%, effective 7/00 2.5% 1/01 Year 2 2% 7/01 2.5% 1/02 In addition, Captains and Lieutenants will receive an additional 1%per year effective in July as an equity/market adjustment. Sick leave payouts at retirement: 20%after 25 years of service with City of San Luis Obispo 25%after 30 years of service with City of San Luis Obispo This extends the current benefit of 101/o after ten years and 15%after 20 years. Holiday: One additional holiday will be granted for a total of 13 holidays. Currently, all other employee groups except the POA have 13 holidays. Department heads received a 13'holiday this year as well. C5-1 Council Agenda Report—SLOPSOA Memorandum of Agreement Page 2 Holiday nay: Employees will receive holiday pay in lieu of time off for half of their total holiday allotment. They will receive a total of 13 days or 104 hours. Of that, 52 hours would be paid to them semi- monthly, as holiday pay in each paycheck. The remaining 52 hours could be taken as time off or cashed out quarterly. Potentially, an employee could receive pay for all of his holiday leave, the full 104 hours. This is what is currently available to Fire Department safety employees. They are already eligible to cash out 40 hours of administrative leave and 40 hours of vacation leave for a total of 80 hours. They are willing to discontinue the cash out of 40 hours of administrative leave in lieu of holiday pay(52 hours in pay and 52 either leave or cash out for a total of 104 hours). Overtime: Language in the MOA will be modified to provide the sergeants who are eligible for overtime the same shift adjustment provisions that are currently in place for the police officers. Reopen : Should the City and POA in their negotiations, which are currently underway, agree to any modifications to the PERS Police Retirement Plan, the City would agree to meet and confer with SLOPSOA (which is actually required by state law). Any enhancements to the retirement plan that SLOPSOA may receive would be cost neutral to the City with the employees bearing any and all costs,including both short-and long-term costs. FISCAL II"ACT Total compensation for SLOPSOA is currently$1,226,400 per year. The package as described above costs approximately $57,000 in year one and $46,000 in year two. Funding required to support FY 2000-2001 will be included as a part of the recommended 2000-01 budget. The second year costs will be included in the two year financial plan for 2001-02. ALTERNATIVES Because the MOA complies with previous Council direction and demonstrates the City's and SLOPSOA's willingness and ability to craft a mutually satisfactory agreement in a.timely and collaborative manner,no alternatives are presented for Council consideration. (2000 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO POLICE STAFF OFFICERS' ASSOCIATION FOR THE PERIOD OF JULY 19 2000—JUNE 30,2002 BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The Memorandum of Agreement between the City of San Luis Obispo and the San Luis Obispo Police Staff Officers' Association(SLOPSOA), attached hereto as exhibit "A"and incorporated herein by this reference, is hereby adopted and ratified. SECTION 2. The Finance Director shall adjust the Personnel Services appropriation accounts to reflect the negotiated compensation changes. SECTION 3. The City Clerk shall finish a copy of this resolution and a copy of the executed Memorandum of Agreement approved by it to: Joe Hazouri, SLOPSOA President and Ann Slate,Director of Human Resources.
