SUBJECT: Joint Use Committee Bylaws
CAO RECOMMENDATIONS:
1) Introduce to print an Ordinance amending the Joint Recreational Use of
School District Property Committee's (JUC) enabling Ordinance to change
the name of the committee to Advisory Committee on Joint Use of
Recreational Facilities and amend the committee's purpose
2) Adopt the Resolution amending the JUC bylaws to reflect the same
changes
DISCUSSION
The City has recognized the Advisory Committee on Joint Recreational Use of School District
Property as an advisory body for nearly 20 years. The original purpose of the JUC was
overseeing the joint use agreement between the City and San Luis Coastal Unified School
District for community use of school district property. The scope has included the lease
agreement for Sinsheimer Park and the facilities built there by the City, as well as joint use sites
at C.L. Smith Elementary School, Teach Elementary School, Sinsheimer Elementary School,
Pacheco Elementary School, Hawthorne Elementary School, and Laguna Middle School.
In the past five years, the JUC has become more active in addressing uses on school sites as well
as supporting interest in additional areas where joint use agreements can come into place such as,
the County, Cal Poly and Cuesta College. User groups are finding it more difficult to access
fields so developing partnerships with other agencies has become necessary. The committee's
concerns about field development and improvements support a wide range of interests
throughout the community. In watching over these new relationships, the role of the Joint Use
Committee has grown beyond its initial purpose and is fulfilling a real need.
The amended bylaws reflect an expanded purpose to show the Committee's involvement in
recommending joint use agreements with other agencies outside of the school district. A name
change to Advisory Committee on Joint Use of Recreational Facilities is being proposed, as the
name of the committee should reflect the enhanced scope of the work involved. Since the bylaw
changes affect the enabling ordinance of the JUC, an ordinance amending the municipal code is
being presented to Council for action.
A clarification to the membership section has been added to define term lengths of Committee
members as recommended by the City Clerk and approved by the JUC. Otherwise, no significant

changes are proposed for the membership requirements. A staff member from the San Luis
Coastal Unified School District shall continue to serve as a liaison to the NC. A minor change,
also at the suggestion of the City Clerk, is being made to the subsection on Committees.
Upon adoption of the bylaws by Council, a copy is to be forwarded to the SLCUSD Board of
Trustees for their concurrence.
FISCAL IMPACT
Approval of the amended Ordinance and bylaws is not anticipated to have any fiscal impact to
the City.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AMENDING CHAPTER 2.52 OF THE SAN LUIS OBISPO MUNICIPAL CODE,
REGARDING PURPOSE AND MEMBERSHIP OF THE ADVISORY COMMITTEE ON
JOINT USE OF RECREATIONAL FACILITIES
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. That certain amendments are hereby made to Chapter 2.52 of the San Luis
Obispo Municipal Code, to read as follows:
SECTION 2.52.010 ESTABLISHED
There is hereby established the Joint Use of Recreational Facilities Committee of
the City.
SECTION 2.52.020 PURPOSE
It is the purpose of the Joint Use of Recreational Facilities Committee to advise
the Council regarding:
A. Policy for operation of San Luis Coastal Unified School District
(SLCUSD)joint use recreational facilities;
B. Priorities for granting use of school district facilities;
C. Planning for balanced integration of recreational property being
developed;
D. Recommend to the Council on joint use agreements between the city and
other agencies for joint use of facilities.
SECTION 2.52.030 MEMBERSHIP
The Joint Use of Recreational Facilities Committee shall consist of seven
members; provided, that one member shall be appointed by the council from the Parks and
Recreation Commission.
SECTION 2.52.040 TERMS OF OFFICE
A. Members shall be appointed by the Council for terms of two years which shall
commence immediately upon appointment by the Council. Commissioners
shall serve at the pleasure of the Council and may be reappointed; provided,
that no appointee shall serve more than four consecutive full terms (eight
years). Appointment for a partial term of office following an unscheduled
vacancy shall not preclude the appointee from serving four consecutive full
terms following completion of the partial term, provided the partial term is
less than one year. Commissioners who have served for six or more
consecutive years at the time the ordinance codified in this chapter becomes

effective shall be eligible for reappointment to no more than one additional
term.
B. Vacancies shall be filled for unexpired terms.
C. Such elements of the Council adopted Handbook for Advisory Bodies as apply
to the joint use of recreational facilities committee shall be incorporated herein
by reference.
SECTION 2. A summary of this ordinance, approved by the City Attorney, together
with the names of the Council members voting for and against it, shall be published at least five
days prior to its final passage, in the Tribune, a newspaper published and circulated in this City.
This ordinance will go into effect at the expiration of thirty (30) days after its final passage.

2.52.020 Purpose.

RESOLUTION NO. (2000 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
TO AMEND THE BYLAWS OF THE ADVISORY COMMITTEE ON JOINT USE OF
RECREATIONAL FACILITIES.
WHEREAS, on October 27, 1981, the City established the Joint Recreational Use Committee
and;
WHEREAS, on June 27, 2000 and October 24, 2000, the Joint Recreational Use Committee
unanimously agreed to amend their bylaws and;
WHEREAS, pursuant to Article XII, Section 1204 of the City Charter, each advisory body
shall present changes to their bylaws to the Council for approval .
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. The name of the Committee shall now be known as the Advisory Committee
on Joint Use of Recreational Facilities.
SECTION 2. That Sections I, 11, III, IV, and VI of the Bylaws of the Joint Use of
Recreational Facilities Committee be amended as follows:
I. PURPOSE
1. The Advisory Committee on Joint Use of Recreational Facilities [The Committee]
provides recommendations to the City Council of the City of San Luis Obispo and the
San Luis Coastal Unified School District Board of Trustees regarding those facilities that
have been mutually designated as Joint Use Facilities; and for the operation of the
recreational facilities, priority for use of the facilities, and development of new
recreational facilities in Sinsheimer Park.
2. The Committee provides recommendations to the City Council on Joint Use Agreements
between the City and other appropriate agencies for the Joint Use of Facilities.
3. The Committee provides recommendations for the expenditure of those funds designated
by the City Council for the improvement of joint use recreational facilities.

H. STAFF
The Committee is staffed by the Director of Parks & Recreation, the Recreation Manager I, a
minute taker designated by the Manager, and the Parks Maintenance Supervisor. A staff member
from the San Luis Coastal Unified School District shall serve as a liaison to the Committee.
III. MEMBERSHIP
Membership in the committee consists of seven (7) members appointed by majority vote of
the City Council and School Board. Terms are from one to four years, dictated by the principle that
no more than two terms on any committee will expire each year. One member shall be a
representative of the Parks and Recreation Commission. The terms shall commence on April 1 of
each year. No appointee shall serve on the joint use committee for more than two (2) consecutive,
full terms (8 years).
A mid-term appointment to a vacant seat shall not preclude the appointee from serving two
additional consecutive full terms, provided that the initial, partial term served is less than one (1)
year.
IV. OFFICERS
In April, at its regular meeting, the membership shall elect a chairperson, vice chairperson
and such other officers as may be needed.
The term of office of the chairperson and vice chairperson shall be one (1) year, commencing

A Subcommittee may be appointed, as needed, by the chairperson. A quorum of a
subcommittee shall consist of a majority membership of that subcommittee.

I. PURPOSE

committee, provided that seven (7)days prior notice is given to each member.
In any event, meetings shall always be held within the jurisdictional limits of the City of San
Luis Obispo, shall be open and public meetings and notice shall be given of the meetings to any
requesting party at least twenty-four (24)hours prior to the meeting.
A quorum shall consist of a majority of the members currently serving. All meetings shall be

conducted according to parliamentary procedure and shall be governed in accordance with city
practices, customs, policies and Roberts Rules of Order, newly revised.
VI. COMMIT'T'EES
A Subcommittee may be appointed, as needed, by the chairperson. A quorum of a
subcommittee shall consist of a majority membership of that subcommittee.
VII. AMENDMENTS
Prior to May 1 in each odd numbered year, these bylaws shall be reviewed by the Committee.
Any proposed changes shall be submitted to the City Council and the School Board for approval. If
no changes are proposed, a report of the review shall be submitted.
These bylaws may be amended by the majority vote of the committee members present at a
regular meeting, provided that a quorum is present. Members shall receive the proposed
amendments at least ten (10) days prior to the meeting in which amendment is proposed.
IN WITNESS WHEREOF, we, the undersigned, being the Chairperson and Vice Chair of
the Advisory Committee on Joint Use of Recreational Facilities, do certify that the Restated Bylaws
set forth above constitute the bylaws of the said committee adopted on
