Subject: Building Code and Nuisance Violation Enforcement at 55,61,and 73 Broad Street("The Villages
of San Luis Obispo")
Dear Mayor Settle:
Thank you for your phone conversation with me on November 16,2000, regarding Westpac Investment
Inc.'s ongoing code and nuisance violations at their 55,61 and 73 Broad Street commercial restaurant and
housing facilities campus,known as The Villages,as well as the City's violation enforcement difficulties.
Thank you also for acknowledging that we have been extremely reasonable in raising the issues associated
with these ongoing code and nuisance violations,in numerous letters to the City Planning Department,the
City Code Enforcement personnel and you during the last year and more. As you requested,below is a
summary of the existing violations as well as the mitigations that we request to remedy these violations
We request that you and the City Council direct the responsible City departments to enforce the City
ordinances that citizens depend on for protection of our property rights,public health,safety and welfare,
within this next month If the City departments cannot enforce the ordinances and effect appropriate
remedies,we respectfully request that you and the City Council consider a revocation hearing for the use
permit at 55,61 and 73 Broad Streets.
Commercial Kitchen Facility at 73 Broad Street
Problem: This kitchen is being used to service all three multi-story buildings on The Villages campus. It
is located against the creekside and fronts our bedrooms at Serrano Sircle. Apparently,this area appeared
in the City approved plans as an office,not as a kitchen.
Several violations are occurring associated with the current use of this commercial kitchen. They are:
• The latches door which faces our bedrooms and the creek is left open and industrial kitchen
noises,including dishes clattering,dish washers running,exhaust fans running,stafftallang loudly
over the equipment noises during meal preparation occur from around 6 AM till after 10:30 PM,
seven days a week This use noise is sufficient to wake our residents early and prevent our going
to sleep at a decent hour.
• The emergency exit door that is located next to the kitchen door is left propped open by a mop
bucket or broom most of the time. The area in front of the emergency exit is populated with
kitchen food racks,delivery carts,the 73 Broad staff break table and chairs,trash boxes,and other
debris.
• Kitchen equipment,such as large pots,racks and other items are regularly cleaned in the
emergency exit area This area.fronts the creek and our bedrooms. The cleaning detergents,water
and other debris are regularly washed into the riparian area and the staff routinely yells among
themselves to be heard over the outdoor scrubbing of kitchen equipment
• Kitchen staff have been observed throwing garbage into the creek more than once.
• Kitchen debris is ending up in the creek—including food and paper copies of the 73 Broad Street
printed menus for the week

• Delivery to and from this kitchen,because of the rear door being used as the delivery entrance,
invohres trucks and carts being regularly double-parked in the fire lane neat to 73 Broad Street
• Delivery to and from this kitchen also involves trucks and carts being unable to maneuver in the
narrow fire lane and results in drivers regularly backing into the area running backup bells and
horns for several minutes as they negotiate the narrow lanes between 61 and 73 Broad Street.
• The 200 Ib. refrigeration condensers,designed for being mounted on roofs,were instead installed
on the ground next to the back kitchen door. The noise cycling on and off from these condensers
trespasses our property line and,many times this past year,has kept several of us up late into the
night,as well as wakening us from sound sleeps.
• Because of an earlier letter to you,the City staff accepted mitigation from Westpac to build a
mechanical equipment building around these condensers,rather than install them on the roof as
designed The WestPacdesigned mechanical equipment building is not working—the door to the
mechanical equipment building must remain open at all times because the condensers are not
getting the proper air circulation. It is our understanding that because of the new mechanical
equipment building the condensers became too hot and shut down,thereby shutting down the
refrigeration for the kitchen at 73 Broad and creating a potential health hazard. We understand
that this has happened more than once and refrigeration and air conditioning specialists have
advised Westpac that the condensers are not designed to be placed inside buildings,but are
designed to be placed on the roofs,to ensure appropriate levels of air circulation around them and
prevent overheating.
• Exhaust fan noise—several fans associated with the kitchen and laundry facilities at 73 Broad
Street,including a new fan placed on the mechanical equipment building that was erected to
answer the fan noise violations created by the condensers,are responsible for the ongoing noise
violations.
Solution:
Listed below are the mitigations we request associated with the kitchen at 73 Broad Street
• The refrigeration condensers be relocated to the roof of 73 Broad Street,as designed.
• The emergency door for 73 Broad Street be kept closed and alarmed and not used as a secondary
delivery door for the staff at 73 Broad Street
• The staff rest area be relocated to the interior of the building,so that the emergency exit is not
impeded and the temptation to throw debris into the creek is eliminated.
• The kitchen door be closed at all times,unless there is an emergency.
• No equipment will be cleaned,washed down or maintained in the emergency exit area or near the
riparian areas at any time. All cleaning and maintenance associated with 73 Broad Street be
handled imernally to the building.
• The building exhaust fans,including the kitchen and laundry fans,be moved to the roof of 73
Broad Street.
• All deliveries to 73 Broad Street,including those for the kitchen,occur at the northwest entrance
of the building,accessed by the driveway between 73 Broad Street and 55 Broad Street
• All Westpac staff,including their vendors and contractors be regularly advised to conduct
business in a manner that does not violate City noise ordinances and the riparian area.
General Noise Violations
Problem: New roof-mounted mechanical equipment at 61 Broad Street operates 24 hours a day,7 days a
week,creating noise violations that trespass our property lines affecting our bedrooms and living areas.
Solution: Install an acoustical parapet around the mechanical equipment at 61 Broad Street that will
absorb and shield the sound
Problem: WestPac Delivery Cart Noises.
There are several problems with noise from the golf-cart sized delivery carts used by Westpac:

1. The carts have back up horns installed and the area around 61 and 73 Broad in which these carts
are used is so narrow that the cart operators routinely drive these carts in reverse all over the
campus rather than try to maneuver in the narrow spaces of the driveways,cart paths and parking
lots.
2. The carts drivers have been provided with hand operated clown horns to alert pedestrians,
however the cart drivers routinely use these clown horns for horsing around and their own
amusement
3. The carts are often used in conjunction with a towed trailer that has a metal tailgate,which,when
the staff opens to load or unload the trailer,they drop the metal gate to the ground with a loud
bang. The staff uses this towed trailer at all hours of the day and night
Solation: Several solutions can be easily implemented to resolve the noise violations associated with
the operation of the delivery carts.
1. Disconnect the back up horns on the delivery carts. This is a practice that is used with similar
carts at Cal Poly. The visibility available with these karts is 360 degrees and it should be easy for
the drivers to watch where they are going,especially since they are already in the general practice
of driving these carts in reverse.
2. Remove the hand operated clown horns from the cart drivers.
3. Acoustically treat the delivery cart trailer so that it doesn't violate the noise ordinance and create
loud bangs when the tailgate is lowered.
Traffic and Pathways Design and Use Contributing to Noise Violations
Problem: The existing emergency access wooden bridge between 61 Broad Street and the new building of
73 Broad Street is routinely used for commercial deliveries at 61 Broad Street that include carpet cleaning
trucks,plumbing maintenance trucks linen and laundry delivery trucks,package delivery services trircks,
the Post Office delivery truck,and the Westpac delivery carts. Each time a vehicle of any size crosses the
wooden bridge it creates a noise that sounds like"nearby thunder"as described by a visitor to one of our
homes in Serrano Sircle.
Solution: Pave the wooden bridge with asphalt to deaden the noise.
Problem: Vehicle access to 61 Broad Street is poorly designed It routinely creates noise violations and
safety hazards.
1. Pedestrian sidewalks among the three buildings—including a sidewalk which does not appear on
the development plans submitted to the City and is located between 61 Broad Street and the
wooden bridge —are routinely used by the Westpac delivery carts as a vehicle cart path
2. Commercial vehicles entering the small parking lot behind 61 Broad Sued and next to our
bedrooms routinely create loud noise going over the wooden bridge that is the only access route
for these vehicles to this parking lot This parking lot is so small that commercial vehicles
routinely cannot maneuver to get out of the parking lot and resort to backing out in reverse over
the bridge and out the fire lane.In addition,commercial vehicles in this area have impeded fire
and emergency vehicles and personnel answering emergency calls to 61 Broad Street on at least
two occasions.
Solution:
1. Restrict the WestPac delivery cart operations to the asphalted driveways,fire lanes and parking
lots.
2. Restrict the WestPac delivery carts to use an existing bridge between the 61 Broad Street and 55
Broad Street buildings to access the northwest doors of 61 Broad Street for all pickups and

deliveries. They should not use the small parking lot between 61 Broad Street and our property
line for pickups and deliveries.
3. Restrict all commercial deliveries for 61 Broad Street to be received at either 55 or 73 Broad
Street,or delivered to 61 Broad Street via the parking lot on the northwest corner of The Villages
campus,facing Palomar and Ramona Streets. No commercial vehicles,including buses and vans,
should be allowed into the parking lot between 61 Broad Street and our property.
4. Signage on the wooden bridge that provides the only access to the back parking lot between 61
Broad Street and our property should state that no commercial vehicles are allowed to cross the
wooden bridge or enter the paridng lot.
5. The small parking lot between 61 Broad Street and our property should be used only for short-
term,handicapped or resident paridng. It should be so designated by signage and it should be
enforced.
Garbage and Recycling Collection Violations
Problem:. There are several garbage and recycling violations occurring at The Villages. They include:
I. At 73 Broad Street,garbage bins are routinely blocking the fire lane.
2. There is no recycling occurring at 73 Broad Street—the garbage is routinely mixed in all the
garbage bins.
3. Garbage is being thrown into the riparian area.
4. Often,garbage is stacked loosely against the building and garbage bins for days at a time,being
loaded into the bins only the night before collection is to occur.
5. Delivery carts that are used to haul food as well as dirty and clean laundry,are routinely used to
haul bagged trash from all three multi-story residential buildings to be dumped into the garbage
bins associated with 73 Broad Street
6. Garbage truck personnel servicing-the three buildings are collecting the garbage from the bins at
73 Broad Street at least twice a week and routinely cannot muscle any one of the bins into the
gated enclosure that had been designed to hold one bin,apparently because the gated area to the
enclosure is too narrow.
T Garbage trucks collecting the garbage from the bins at 73 Broad Street during the early morning
hours cannot turn around in the too-narrow fire lane and routinely must back out of the area after
collection. This prooess takes a few minutes every time the pick-ups are made with backup horns
blaring the entire time.
Solution: Relocate the garbage bins for all the buildings in The Villages campus to the existing common
garbage collection facility located in The Villages parking lot that faces Palomar and Ramona. There is
plenty of space in this parking lot for bins to be designated for each building,and each aspect of collection-
-recycling,garbage and green debris. Also,there is space for the garbage,recycling and green waste
trucks to maneuver during collection without having to resort to backing up. The last benefit to this.
location is that the waste collection trucks will not be blocking the fire lanes,if they use the
Palomar/Ramona parking lot garbage facility for collection.
Ughting Violations
Problem: The new lighting design at 61 and 73 Broad Street has created extensive glare,light trespass and
barsh illumination. The tight pollution trespasses our properly lines and it is not an exaggeration to state
that we can read books at night in our bedrooms using only the trespassing light from 61 and 73 Broad
Street In addition,it is our understanding that the ill-advised adjustments to the lighting design that are in

Westpac development group on the appropriate lighting solution. We expect the plan and specification to

and implemented in a short time frame at WestPac's cost.

My name is Fred Castro and I own Higuera Motors with my uncle.We have 4 mechanics working now.
sometimes 5.We bought the shop from Ferdinan Khun in March of 1999. He was there for 12 years.
We do smog and safety checks and all types of repair on foreign and domestic cars and trucks.
When we bough the shop all of the customers came in the front of the building.This is still the same now
because the lifts in the shop are facing to the back so that the cars enter from Higuera St. and leave out
the back door.This works good because when the car is finished it can be moved into the back going in
one direction and the owner can drive out onto Higuera St.When a car is finished fast sometimes the
customers back out of the building.Mr.Rogoff said this is no good. I know it is not the safe way to do it.
Chu space is narrow but long.The front and rear doors are used everyday and are very important for
our business.We have some cars on jacks when we work on front ends and rear ends.Some time wait.

until the job is done.We can drive past the cars to get in and out.
Mr. Rogoff said you want to close the front door.We cannot tum the cars around in the shop.There is
not room for turning.We have many tool boxes, smog test machine,air conditioning machine,welder,
drums for recycling oil,radiator flush machine, brake machine,press machine,parts and jacks that take
up a lot of the shop.
Mr. Rogoff said that he is trying to have the customers come in from the back and go out the front.This
is o.k.We can tum our lifts around to face the front. But it would not work to back out or tum around
with many cars in the shop.They can go out thew door like Mr. Rogoff says.We will tell our cus-
tomers no more parking in front. Now you g to the back and park.We also don't want to close the
door because we need the doors open to lett the exhaust from the cars that are running.
I saw the drawing of the new building. It looks very nice.We would have a nice building when it is
done.
My father owns A and D Automotive on Higuera St. He has only one way in and the same way out.This
does not work good for him. He has to back up the cars into the shop to work on them.Then he needs
to move 4 or 5 cars out of the way to get the car out.That's why he is moving to another place.
I don't want to move. Please let me keep two doors in my shop. Mr_ Rogoff said a meeting will be at
City Hall on Tuesday at 7:00 and 1 should come. I will be at this meeting.

I have been in the used appliance repair and sales business in San Luis Obispo for the past 4 years.
In May of 1999 I relocated to the back of 2958 So. Higuera St. behind the Second Hand store.
Since Mr. Rogoff has purchased the property, he gave me the opportunity to move my business to
the front side of the building at 2978 So. Higuera St. I have been located here for the last 10 months. Since
moving to a frontage location it is apparent that it has been the best thing I ever did. My business doubled in
the first two months of the move. I now have a visible location with signage and a small but real showroom.
I understand that Mr. Rogoff, as a condition of his remodeling plans, may be required to close off
the garage door that I presently use for access to my business. Should this happen, it will be impossible for
me to continue to be in business. I rely on the garage door access in order to move appliances in and out of
my shop since I have no access from the rear of the building. I have a lift gate on the back of my truck and
need to have access to the front of the shop to load and unload appliances for drop off and delivery.
I have used the space between the building and the bike lane because it is convenient. I know that
the condition is not the best, but it is difficult for myself and customers to park in the back of the property
while Mr. Rogoff has demolition and extensive clean-up going on. There have been trucks and tractors
moving in and out of the property almost every week loading trash in dumpsters and dump trucks. There is
a lot of dust and dirt kicked up by this work and I don't want to get in the way of the clean-up.
Once the new parking lot is put in and with the right signage, my customers will be able to park on
the side of the building and walk around to my shop without a problem. I will also be able to park my truck
in a designated spot in the back.
I have invested a considerable amount of money in this move and really can't afford nor do I want to
move again. I would like to stay in this location and understand that there will be no parking in front of my
shop for my truck or my customers. I will abide by the no parking restriction in the front of the building and
make sure my customers do not block the bike lane or park on the side walk Mr. Rogoff has informed me
that this will be a condition of our lease agreement and failure to follow the no parking restriction will be
cause to terminate my rental agreement.

As you know,in the automotive sales business there are times when a dealer acquires used cars that are in need of
many different types of repairs in order for us to have them in " sales ready condition". This reconditioning can
consist of any or all of the following
A current smog certificate prior to offer of sale as mandated by the State of California.
A safety check of the foot and parking brakes, steering, windshield wipers, hom, lights, turn signals, seat belts,
door locks,window controls and horn.
Everything from tune-ups and minor repairs such as valve cover gasket replacement to major repairs such as en-
nine and transmission replacement,and the typical timing belts, c.v. joints and catalytic converter replacement.
Windshield repair or replacement
Paint-less dent removal and or touch up paint
Stereo repair or replacement
Upholstery repair or replacement
Detailing
When we are in need of any of the above services it requires two people to drop off a car (one to drive the repair
vehicle and a car and driver to transport the first driver back) at each shop to have a particular repair preformed.
Then another car and driver to pick up the repair car. Quite a logistic nightmare for a small business operator.
Your concept of having a center with auto related rental spaces for these small shops in one convenient center is
a great idea. We would be able to drop off a car and have all repairs and services done at one location and not
have the need to move our cars across town from shop to shop wasting gas and manpower.

Attached are three maps that will be part of the presentation for the Council Meeting on
November 21, 2000. They separate the project to more clearly identify that work which is being
recommended at this time and that which could be part of future phases.
• This first shows the demands and the location of existing facilities including the Water
Reclamation Facility and the abandon Unocal pipeline
• The second shows the project that is being proposed for approval at this time. The
pipelines are being constructed with the capacity to serve the additional customers that
might be added should those pipelines shown on the next map be constructed at a later
date. The pumping and storage facilities will be constructed so that they could be
expanded in the future.
• The third shows the project that could be constructed with additional phases to serve the
Sinsheimer area and the Downtown and Cal Poly areas.
Councilman Romero suggested that we circulate these additional maps to clarify the proposed
action.

At the Downtown Association meeting of 11/14/00 the Board expressed concern about the
reopening of Osos Street in time for the Christmas Parade.
Sixty-three people attended the Strategic Plan meeting on November 8`h, not as high as
anticipated. There was a repetitive theme throughout the meeting and focus groups of design and
look—not economic needs. .Consultants felt that people needed to express their concerns, but
hopefully move the discussion toward economics and away from parking during interviews and
second town meetings. The Strategic.Plan Survey was mailed to 500 businesses with a 10%
return rate. That was a good rate, but the project was expensive and it was hoped that the
response would have been greater.
The new Downtown Magazine is looking great. It debuted on November 20`h and is being
mailed to all single families in the city.
The Prado Day Center fund raising campaign letter is ready for mailing. It is hoped that the
campaign will raise$30,000-40,000. An inspection for facility maintenance will be done to
identify needs. The spare change program has ground to a halt with six jars in the community.
The $oard spent time brainstorming a promotion effort.
The Mardi Gras Committee reviewed new actions: The Tuesday parade and intolerance of
alcohol during the event were discussed. Guidelines for City portable restroom use were
questioned.

mitigation funds. Diesel fuel (700,000 gallons) was burned to clean up 135,000 gallons of
spilled fuel at Avila Beach.
The air quality mitigation funds to offset this air pollution were disbursed as listed in the
attached.
