Approve contract with Maino Construction Company in the amount of $107,000 for " Throop Park Restroom", Specification No. 99828 and authorize Mayor to execute contract. 2. Approve transfer of $58,800 from the Parkland Development Fund to the project account. DISCUSSION The City operates Throop Park for its recreation program under an agreement with the San Luis Unified School District. The restroom in the park is old, does not comply with the Americans with Disabilities Act (ADA) and requires significant maintenance. Replacement of the facility was identified in the 1997 -99 budget on page E -29. Architect Bruce Fraser has prepared plans and specifications. The Building Maintenance staff has reviewed the plans. The school district has been contacted and provided with plans. The Building and Safety Division of the Community Department is prepared to issue a building permit. The plans were advertised and bids opened on December 14, 2000. Three bids were received, see attached bid summary sheet. The low bid of Maino Construction Company exceeds the amount authorized by the Council for award by the City Administrative Officer and the amount of the budget. The architect and City staff have spoken with the contractor and feel, that there is little that can be done to substantially lower the cost of the project to bring it in at the budget amount. There are potential savings that may be worked out with the contractor during construction, but to redesign and re- advertise would result in added costs that would probably negate any potential savings. On a related issue, the City is in the process of advertising for bids another restroom for the downtown. That project was estimated to be a more expensive project. Based on the results of this bid, staff expects that the Council will be asked to provide additional money when it comes time to award the work. CONCURRENCES Community Development Department has given this project a categorical exemption. WITNESSETH: That the Owner and the Contractor for the consideration stated herein agree as follows: ARTICLE 1, SCOPE OF WORK: The Contractor shall perform everything required to be performed, shall provide and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and transportation services required to complete all the work of construction of Throop Park Restroom, Specification No. 99828 in strict accordance with the plans and specificationstherefor, including any and all Addenda, adopted by the Owner, in strict compliance with the Contract Documents hereinafter enumerated. It is agreed that said labor, materials, tools, equipment, and services shall be furnished and said work performed and completed under the direction and supervision and subject to the approval of the Owner or its authorized representatives. ARTICLE I17, COMPONENT PARTS OF THIS CONTRACT: The Contract consists of the following documents, all of which are as fully a part thereof as if herein set out in full, if not attached, as if hereto attached: 1. Notice to Bidders and information for bidders. 2. Standard Specifications, Engineering Standards and Special Provisions. 3. Accepted Proposal. 4. ARTICLE IV. It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this instrument and the bid or proposal of said Contractor, then this instrument shall control and nothing herein shall be considered as an acceptance of the said terms of said proposal conflicting herewith.
