CAO RECOMMENDATION 1. Approve the change order for construction of a retaining wall at the southerly end of the Railroad Transportation Center. 2. Appropriate $53,700 from the General Fund Reserves. 3. Authorize the City Engineer to execute the change order. DISCUSSION The Railroad Transportation Center (RTC) is currently under construction and is about 50% complete. The project will provide additional parking for the Railroad Depot and storage parking for the regional transit buses. During the survey layout. of the project, it became evident that a fill slope, supporting the southern end of the project, was designed to be built on the adjoining private property. Discussion with the design consultants indicated there was some misunderstanding as to what this adjacent property owner was going to allow. The owner never authorized, or gave an easement for a fill slope on their property. The RTC project was designed into a very tight space. The parking lot extends right up to the property line at the point where the fill slope was planned. The only way to retain the RTC's design and not encroach onto the neighboring property is to build a retaining wall. The majority of the new wall is 1.2 meters (4ft) tall above the ground, with some segments at 1 meter. A 1.2 meter (4ft) black iron-style safety fence will sit on top of the wall and is required by building codes (reference Detail E on attached Exhibit Q. The ARC has approved plans for a private commercial project adjacent to the RTC and fronting Santa Barbara Street (the Rarig property). A two-story structure will be constructed with front yard landscaping along Santa Barbara Street and vehicle parking located to the rear (eastern portion) of its site. The space needs or this project will not accommodate a fill slope, even if the City were able to obtain an easement for it. Construction of the planned two-story building on the Rarig parcel will largely block the views of this wall and safety fence from Santa Barbara Street. The wall will be visible looking eastward down the Rang project's northern driveway. However, this new project includes a C11-1 Council Agenda Report—Railroad Transportation Center Change Order Page 2 narrow planter area adjoining the base of the wall with a 2:1 slope bank, which should enable some landscape softening of the exposed wall segment. It's important to note that this funding request has nothing to do with the recently-completed wall that borders Santa Barbara Street. The Santa Barbara Street wall will be reviewed by the Architectural Review Commission (ARC) on February 5th. If the ARC directs major design changes, a supplementary funding request will be submitted to the City Council. CONCURRENCES The original project engineering firm (Boyle Engineering) has completed a design for the new wall along the southerly portion of the project. The design was reviewed as a "minor and incidental" architectural review proposal and was approved by the Community Development Department on September 5, 2000. FISCAL IlVIPACT The Contractor has submitted a cost estimate for the new retaining wall. Inadequate funds are currently available in the project contingencies to cover the cost of the new wall. Therefore, staff is recommending that the additional funds come from the General Fund Reserves. Based on actual results for 1999-00 and year-to-date revenue trends, adequate resources are available to fund the proposed appropriation and retain fund balance at policy levels. This project has already used the maximum available from other grant sources just to get to construction. It appears there may be cost savings in some of the contract items that would help to offset the cost of the new wall. However, staff is not able to certify at this time that those funds will be available. The Contractor has a claim period after the project completion during which they can justify additional costs for various items. Contingencies Available for $120,000 Anticipated Cost $35,000 Construction Savings Contingencies Used to Date * $79,200 Contingencies Remaining $40,800 New Retaining Wall $53,700 *901/o of this was used to remove and dispose of additional contaminated materials on the project site. Construction is at about the 50% point; however, we have used 66% of the existing contingency funding. Because of the amount of work remaining in the contract, staff recommends leaving the contingency balance at its current level and supplementing it for construction of the wall. We currently anticipate few remaining changes and should have a contingency balance at the end of the project available to support other projects via the completed projects account: Contingencies remaining after construction will be directed to the General Fund completed projects account. ALTERNATIVES There are no, less costly, alternatives available.
