SUBJECT: LOVR INTERCHANGE CONSTRUCTION EASEMENT AMENDMENT
RECOMMENDATION
Accept the First Amendment to Temporary Construction Easement Deed from BNB, a California
general partnership, and authorize the Mayor to execute a Certificate of Acceptance.
DISCUSSION
In August 2013 the City purchased a Temporary Construction Easement (TCE) from the owners
of the ARCO gas station near the southbound freeway off ramp at Los Osos Valley Road
(LOVR). The TCE is needed for access to build a retaining wall within Caltrans’ right of way
and frontage improvements on LOVR in conjunction with the LOVR interchange project. The
original recorded TCE deed stated that work shall not commence prior to April 1, 2016.
Recently, the project manager and construction management firm hired by the City identified the
potential for an accelerated construction schedule that would necessitate commencement of the
TCE one year sooner than originally anticipated. As such, an amendment to the TCE deed is
needed to change the commencement date to no earlier than April 1, 2015. The property owners
have agreed to this earlier date and have signed an amendment to the TCE to this effect.
