HomeMy WebLinkAboutC11 Amend Scope of Work Johnson AviationCity of San Luis Obispo, Council Agenda Report, Meeting Date, Item Number FROM: Derek Johnson, Community Development Director Prepared By: Brian Leveille, Associate Planner SUBJECT: AMEND SCOPE OF WORK WITH JOHNSON AVIATION TO PROVIDE TECHNICAL ASSISTANCE THROUGH ENVIRONMENTAL REVIEW PROCESS AND HEARINGS FOR COUNCIL CONSIDERATION OF LAND USE AND CIRCULATION ELEMENT UPDATE (LUCE) RECOMMENDATION 1. Authorize the Community Development Director to increase the scope of work and execute a contract amendment, using an amount not to exceed $44,900 from unspent contract services budget in the Community Development Department from fiscal year 2013-14, for Johnson Aviation to continue providing technical assistance during the update of the Land Use and Circulation Elements (LUCE), and to support the City in its effort to work with the Airport Land Use Commission on its plans to update the Airport Land Use Plan (ALUP). DISCUSSION Background Johnson Aviation began work with the City in 2010, and has provided ongoing guidance related to airport issues and is uniquely familiar with the City’s General Plan, the San Luis Obispo County Airport Land Use Plan, Airport Master Plan, and State and Federal Guidelines governing the operations and planning of airports. Johnson Aviation was originally selected through a proposal process and has continued to demonstrate ongoing competence in the area of aeronautical and airport planning. Most recently, Johnson Aviation has been assisting the City in developing technical information and analysis related to the County Airport Land Use Commission’s update of the ALUP, as well as identifying constraints associated with that plan that may impact the Land Use Element update. With consideration of land use designations that would allow potential residential development on the Avila Ranch, San Luis Ranch, and Madonna (off Los Osos Valley Road) sites, it is necessary for the City Council to have technical information so that objective and factually supported data is available concerning what are adequate airport safety zones and addresses noise considerations associated with continued and expanded operation of the San Luis Obispo County Regional Airport (Airport) as shown in the adopted Airport Master Plan. Johnson Aviation has been providing that support and developed an airport compatibility report that addresses safety and noise constraints associated with City build-out envisioned in the LUCE, and airport activity anticipated in the Airport Master Plan. Johnson Aviation has been instrumental in providing technical information and support for the Airport Compatibility Chapter of the LUCE update and in preparation of analysis and airport land use related sections of the Draft EIR. Most recently, Johnson Aviation prepared the final referral submittals of the LUCE update project for the Airport Land Use Commission and has provided ongoing support to City staff in preparation of the draft Airport Overlay Zone (AOZ) 8-19-14 C11 C11 - 1 Johnson aviation agreement amendment # 4 Page 2 Chapter. The Draft AOZ chapter is important for the implementation of Airport Land Use Compatibility standards and safety measures in order for the City to demonstrate consistency with State law in regards to the purpose and intent of the State Aeronautics Act (SAA). There are four main work efforts for which the City needs assistance from Johnson Aviation: 1. Continued technical input and review associated with the LUCE Environmental Impact Report (EIR). 2. Continued technical assistance to City staff in working with the County Airport Land Use Commission (ALUC) to establish an update to the Airport Land Use Plan based on technical standards and realistic airport operations assumptions. 3. Technical assistance in the preparation of findings, as required by the Public Utilities Commission, for potential Council overrule of the ALUC’s determination of inconsistency for the LUCE update. 4. Continuing assistance developing standards and regulations that implement the LUCE update in the Airport area with Airport Overlay Zoning Regulations. 1. EIR Work Johnson Aviation’s expertise is required in order to respond to comments received on LUCE land use designations that would accommodate future development within areas currently in the Airport Land Use Plan boundaries. Staff received comments from Cal Trans – Division of Aeronautics and the ALUC that must be responded to with technical accuracy. Several important areas planned for physical changes in the LUCE are directly affected by airport area planning issues, including Avila Ranch, San Luis Ranch, Madonna at Los Osos Valley Road, Residential near Los Verdes Park, Sunset/Prado area, and Broad Street Area - all of which are located within the area covered by the adopted San Luis Obispo County Airport Land Use Plan. 2. Update of Airport Land Use Plan (ALUP) The ALUC is in the process of updating the Airport Land Use Plan. The City continues in its efforts to work with the ALUC in an open and collaborative manner based on factual information, realistic airport operations scenarios, and technically supported standards. Staff continues to rely on Johnson Aviation’s technical expertise to evaluate proposed assumptions used for noise modeling purposes. Johnson Aviation is currently assisting staff with preparation of a technical memorandum which responds to recently proposed noise modeling scenarios for the Airport Land Use Plan update which will be discussed at the next ALUC meeting on August 20, 2014. ALUC Overrule Requirements If the City Council determines it wishes to pursue the draft land use concepts in the LUCE update, the Public Utilities Code §21676.5b authorizes a local jurisdiction to adopt land use regulations that are consistent with the objectives of the State Aeronautics Act (SAA), but are not consistent with an adopted Airport Land Use Plan within an airport area through a statutory overrule process. Johnson Aviation continues to assist staff with preparation of detailed final findings to support a potential Council overrule decision. 4. Development Standards/Regulations In order to implement draft land use concepts and the draft Airport Chapter guidance in the Land Use Element and to fulfill legal overrule requirements of the SAA, the City must have companion implementation standards to address airport safety and noise considerations. Johnson Aviation continues to assist City staff with support in ensuring that requirements of the State Aeronautics Act have been satisfied in the event Council chooses the course of action to overrule the ALUC’s determination the LUCE update is inconsistent with the Airport Land Use Plan. This effort involves ensuring that safety and compatibility criteria of the California Airport Land Use Planning Handbook are fully incorporated into relevant policy sections of the LUCE update, and standards of the draft Airport Overlay Zone (AOZ). If done at the General Plan level, subsequent review by the ALUC of individual development projects consistent with the plan considered as part of the overrule process is not required. While this approach is not typical, it will provide the City with the ability to establish safety zones that have a rational nexus to operational, noise and safety data, and future land use decisions would be made solely by the City. It would also provide a method for aligning the appropriate safety zones and land use considerations with the City’s zoning maps and designations, thereby providing more accurate information and certainty for the community. FISCAL IMPACT Johnson Aviation has been paid approximately $174,000 for services to date, with a significant portion funded by local developers with projects directly impacted by airport land use regulations. The latest proposal from Johnson Aviation entails an additional $44,900 in costs for consultant services (Attachment 1). Funding for this additional work is proposed from the General Fund; unspent contract services budget in Community Development from the 2013-2014 fiscal year. ALTERNATIVES 1. The City Council could opt not to authorize additional work from Johnson Aviation. This is not recommended because Johnson’s continued assistance in the final stages of the LUCE update project is needed. ATTACHMENTS 1. The purpose of this Amendment 4 to the Agreement is to support the environmental process for the Land Use and Circulation Element (“LUCE”) Update of the City’s General Plan, related technical work and conformity determination process with the San Luis Obispo Airport Land Use Commission. We are immediately available to begin work on the project. Proposed Amendment 4 Scope of Work The following is a list of tasks necessary for the project based upon our discussions. These tasks are followed by a preliminary schedule and budget for each task.  Task 4.1: Prepare Technical Memo – ALUC Noise Modeling Approach: Consultant has experience and expertise in airport noise analysis and related aviation forecasting tools, techniques and processes. Consultant will prepare a technical memorandum to the City staff addressing the ALUC’s proposed scope of work and related matters for an update to the San Luis Obispo Regional Airport aircraft operations forecast and related noise analysis. Task 4.1 Meetings: Assumes 2 Conference Calls for coordination with City staff and ALUC staff. Deliverable: Two (2) revisions of Technical Memo.  Task 4.2: Support LUCE FEIR Development: Consultant will work with City staff and the LUCE EIR consultant to respond to comments provided during the Draft EIR public review period. Responses will need to address airport land use issues, impacts analysis and related documentation and may require assistance with developing mitigation measures in support of the LUCE EIR consultant’s development of the FEIR for the LUCE Update to the City’s General Plan. This task assumes that there will be coordination with both City staff and the LUCE EIR consultant as directed by City staff. Task 4.2 Meetings: Assumes 2 Conference Calls with City staff and LUCE EIR consultant. Attachment 1 C11 - 4 Page 2 of 4 Deliverable: Written review and comment on airport land use-related sections and potential mitigation measures for the FEIR. Written input to response to comments.  Task 4.3: Planning Commission Meeting Support: Consultant will prepare for and attend Planning Commission Meetings to address LUCE Update airport topics, Airport Overlay Zoning and related matters. Task 4.3 Meetings: Assumes 2 conference calls to coordinate with City staff and attendance at 1 Planning Commission Meeting (scheduled for September 24, 2014). Deliverables: Input to presentation materials for Planning Commission Meeting.  Task 4.4: City Council Meetings Support: Consultant will prepare for and attend City Council Meetings to address LUCE Update airport topics, Airport Overlay Zoning and related matters. Task 4.4 Meetings: Assumes 2 conference calls to coordinate with City staff and attendance at 2 City Council Meetings (scheduled for August 19, 2014 and October 21, 2014). Deliverables: Input to presentation materials for City Council Meetings. On-Call Tasks The following additional tasks are included for the City’s planning and budgeting purposes only and would be requested and authorized on an on-call, as-needed basis. City staff would coordinate with the Consultant to request specific assistance within a defined scope, schedule and budget. The Consultant will make every reasonable effort to assist the City with these efforts. An estimated cost per in-person meeting and conference call or web conferencing is included to assist the City with planning and budgeting these potential services.  Task 4.5: Coordinate with City Staff, GIS, City Council (On-Call): Consultant will meet with the City staff and the San Luis Obispo City Council to address airport land use planning, requirements as requested. This task would likely include meeting preparation, development of presentation materials, technical findings development, public hearings and related consultation. City staff will provide guidance and authorization for any services performed under this task.  Task 4.6: Coordinate with ALUC Subcommittee (On-Call): Consultant would likely meet with the ALUP Subcommittee of the SBP ALUC to cover specific technical airport land use planning requirements. These meetings would cover the ALUP Update that is currently underway by the ALUC Subcommittee as directed by the ALUC. City staff will provide guidance and authorization for any services performed under this task.  Task 4.7: Coordinate with ALUC (On-Call): Consultant would likely meet with the ALUC to cover airport land use planning requirements. These meetings would cover the ALUP Update that is currently underway by the ALUC Subcommittee as directed by the ALUC. This task will include meeting preparation, development of presentation materials, public hearings and related Attachment 1 C11 - 5 Page 3 of 4 consultation. City staff will provide guidance and authorization for any services performed under this task. Proposed Amendment 4 Schedule and Budget This Project is assumed to start in August 2014 and continue for approximately eight months. Figure 1 provides an overview of the Proposed Amendment 4 Project Schedule for each of the tasks outlined above. Figure 1: Proposed Amendment 4 Project Schedule The estimated budget for this project is based upon the foregoing scope of work and schedule. It is also based upon our discussions and the City’s planning schedule for the LUCE Update process. Figure 2 provides an outline of the Estimated Amendment 4 Project Budget. Figure 2: Estimated Amendment 4 Project Budget On-Call Tasks costs would be undertaken on a time and materials basis for specific assignments as directed by City staff. Johnson Aviation has been serving the airport land use planning needs of the City for several years and has made extensive use of web conferencing capabilities to provide high quality and cost-effective consultation to the City for these services. We would continue to provide services in this manner as long as the City is comfortable with this approach.
