Dear Mr. Ashbaugh et al.,
Thank you for your prompt response and attention to the concerns. We understand that the circulation
element, itself, can still be modified. However, the issue with the Bypass does appear in the Executive
Summary of the Final EIR (and, I recall, at least one other part of the FEIR).
The following excerpt (from page PC2 -20 of the attached staff memo) shows what appears in the Executive
Summary of the FEIR:
Maximum Circulation Improvements Alternative: This alternative evaluates the environmental conditions thz
result if three additional modfficationswere added to the proposed LUCE Update. These modifications includE
introduction of two circulation improvements that were removed from the EIR traffic modeling (the "Vachel Ls
Raaliiznment" and "Calle loactuin Connector to Dalidio Drive" improvements) and a revised version of the "Bud
to Los Osos Valley I�oad Connection" improvement. The three a� street network changes added to the
Circulation I mprovernents Alternative were options identified during the preliminary public review of potential
system changes but were not included in the proposed Grculation Element traffic modeling..
When it says "...a revised version of the "Buckley Road to Los Osos Valley Road Connection" improvement ", it
is referring to the June 29th Technical Memorandum analysis. This is the particular analysis we have brought
to your attention in our comments -- the one that makes justification to exclude the Bypass, uses Chevron
mitigation, etc., and also the one without the necessary time for public review and comment.
So, this is the language that needs to be struck from the Final EIR before Council certification /approval,
because making the Bypass a "Maximum Circulation Improvements Alternative" (a possibility) and not a
recommended project would be the problem. Details on this concern are in the comment letters we wrote, and
can be seen if one compares the content of the Appendix N and June 29th "Sensitivity Analyses" (Attachments
B and C of the comment on sensitivity analyses).

Apparently the LOVR issue will require some discussion among the Council, based on this communication
from the Los Verdes Estates consultant. I just received a second, 5 -page letter from Sarah Flickinger, and in
fact I just got a THIRD communication from the Los Verdes homeowners moments ago.
Note to Donna and Sarah: Council members — at least THIS Councilmember — received all three letters. Your
concerns with the June 29 Technical Memorandum as being considered part of the Final EIR will be addressed
by staff. Please recall, however, that the action we are considering is certification of a Final EIR in which many
written communications, including detailed responses to public and agency comments, have been folded into
the Final EIR. We are not, however, in this action tomorrow evening, adopting the final policy language for the
general plan. There is still time to work out such language in response to the full spectrum of opinion and
technical analyses that appear in the Final EIR.
