I have attached my comments on the recommendation by the City to overrule the Airport Land Use Commission. I
wanted to get this to you before the council meeting on the 21st.

near future.

Should the Council Overrule the Airport Land Use Commission and the
approach to the Airport Overlay Zone in the process of approving LUCE at
its meeting of October 21st?
I have previously recommended the council delay taking an overrule action
because of objections received from the ALUC and California Department
of Transportation, Division of Aeronautics.
The city has recently taken positive steps in revising its approach with
respect to accepting the existing ALUP boundaries. Derek Johnson was
helpful in clarifying the City intends to refer the larger projects, such as
Avila Ranch and San Luis Ranch, to the ALUC for consistency findings that
is also required by the Aeronautics Act for general and specific plan and
zoning actions.
Therefore, I recommend the Council should move to define its land use
objectives by approving the LUCE but continue to work with the ALUC in
its update to achieve consistency between the ALUC and LUCE. I
recognize the elected city council must be able to control land uses within its
jurisdiction and areas to be annexed within the urban reserve line.
However, the Department of Transportation, Division of Aeronautics points
out in its correspondence that the City cannot replace the ALUC land use
standards for its own within PUC Section 21676.5(a), et.al. CalTrans’ notes
as outlined in the Aeronautic Act, the Commission can require projects
included in LUCE to come before the Commission notwithstanding an
overrule.
The next meeting of the ÅLUC will be November 19, when Derek Johnson
has offered to clarify at that meeting the types of land uses anticipated in the
airport area such as the Avila Ranch project. It is expected this will be a
point of departure to achieve consistency between the ALUC and LUCE.
Further, the full commission and not a subcommittee will to work with
county and city staff to achieve consistency as soon as possible. I appreciate
the efforts by city staff in our recent meetings to achieve this goal. Thus I
support the council moving forward to define its land use objectives through
the LUCE process while working with the ALUC in the commission update
process .
