Mejia, City Clerk SUBJECT: APPOINTMENTS TO THE CITIZENS’ REVENUE ENHANCEMENT OVERSIGHT COMMISSION (REOC) RECOMMENDATIONS Make appointments to the Citizen’s Revenue Enhancement Oversight Commission, effective immediately, as follows: a. Two members shall be appointed for terms expiring on June 30, 2016. b. Three members shall be appointed to terms expiring on June 30, 2017. DISCUSSION On July 1, 2014, Council adopted Resolution No. 10542 calling a General Municipal Election to be held on November 4, 2014 for the submission to the voters a question whether to extend an existing one-half percent local sales tax for an additional eight years with independent annual audits, public goal-setting and budgeting, and a Citizens Oversight Commission (Measure G-14). On July 15, 2014, Council adopted Ordinance No. 1605 establishing the Citizens’ Revenue Enhancement Oversight Commission (REOC), to review the half-percent sales tax revenues and expenditures, report on the City’s stewardship of this general purpose tax, and provide recommendations directly to the City Council regarding expenditures of these tax revenues as an integral part of the budget process, to be effective following the passage of an extension to the Essential Services Transaction (Sales) and Use Tax. The REOC is to consist of five members who must be residents of the City and preferably have experience with finance, budgeting, or municipal accounting. The recruitment period for REOC applicants was August 29, 2014 through October 24, 2014, although any applications received will continue to be forwarded to Council. Staff has advertised recruitment for REOC as follows: posted the required Notice of Vacancies outside City Hall and on the City’s website; published display advertisements in the Tribune and New Times; sent e- notifications to attendees of past revenue measure events, former Local Revenue Measure Advisory Committee (LRMAC) members, Advisory Body Chairs, City Council, Chamber of Commerce, and neighborhood groups with encouragement to forward to interested individuals. The City’s General Municipal Election was conducted on November 4, 2014 and preliminary results indicate that the voters have approved Measure G-14, Essential Services Transaction (Sales) and Use Tax. Therefore, staff is recommending that City Council take action to appoint members to the REOC. Initial appointments to the REOC were originally proposed to be two year and three year terms. This would cause initial terms to expire at a period in which budget activities are ramping up. Therefore, staff is recommending initial appointments be set to expire on June 30th which will result in initial terms of 1 year, 8 months and 2 years, 8 months. Subsequent appointments would be for full three year terms. Any members appointed to an initial term of 1 year and 8 months 12/02/2014 B2 B2 - 1 CITIZENS’ REVENUE ENHANCEMENT OVERSIGHT COMMISSION APPOINTMENTS Page 2 will be eligible for two additional full terms consistent with Council Policies and Procedures, which states that a partial term less than two years, shall not preclude an appointee from serving two additional full terms. FISCAL IMPACT A budget will have to be created to support REOC operations since it is a newly created advisory body. Annual costs are anticipated to be $15,250, as detailed in the following table. In the short term, costs for December 2014 and January 2015 can be absorbed by the Administration and Records Program (Clerk). ALTERNATIVES 1. Defer making appointments and direct the City Clerk to continue advertising. The City Council may choose to defer making appointments at this time and direct the City Clerk to redouble efforts to advertise recruitment for REOC. This direction will impact the Commission’s participation in early budget and goal-setting processes set to begin in January 2015. Council should give direction on the duration in which to recruit. 2. Make only three appointments and direct the City Clerk to continue advertising. The City Council may choose to make fewer than five, but at least three appointments, to the Commission. This would establish a quorum of the body and will enable staff to work with the Commission to develop bylaws and include them in the upcoming budget process. The City Clerk would return to the City Council after the close of another recruitment period so it may consider making additional appointments. Staff would request that Council give direction on the duration in which to recruit.
