Council Memorandum CLER »/ COUNCIL MEETING: Date: December 2, 2014 ITEM NO.: [, 3 TO: Mayor and City Council FROM: Anthony Mejia, City Clerk VIA: Katie Lichtig, City Manager SUBJECT: Item C3 - Biennial Review and Amendments to the City's Conflict of Interest Code Staff received the following question regarding Item C3, Biennial Review and Amendments to the City's Conflict of Interest Code, the answer to which are being distributed as supplemental information to the Council and the public. Should members of the Citizens' Revenue Enhancement Oversight Commission be designated in the City's Conflict of Interest Code? During the staff level review of the City's Conflict of Interest Code, each advisory body was analyzed to determine whether the advisory body acting within its authority, and without significant and substantive or intervening review - negotiates, advises, or makes recommendations to the decision -maker regarding the governmental decision. It was determined that although the Citizens Revenue Enhancement Oversight Commission (REOC) will make recommendations directly to the Council, such recommendations are in the context of the budget process and subject to significant and substantive intervening review by the Council. However, as the City's Code Reviewing Body, it is the Council's discretion to add any advisory bodies to the list of designated positions and to assign disclosure categories, as appropriate.
