WHEREAS, a petition signed by more than twenty -five per cent in number of the qualified electors residing in the territory described in said petition and hereinafter in this resolution described, was on the 11th day of October 1948, received by the City Council of the City of San Luis Obispo, said Council being the legislative body of said City, which petition asked that said territory be annexed to, incorporated in, and made a part of the City of San Luis Obispo, and that the property within said territory be, after such annexation, subject to taxation equally with the property within said City of San Luis Obispo,, to pay all of the bonded in- debtedness of said City for the acquisition, - construction and completion of various municipal improvements, incurred and outstanding at the time of the filing of said petition, and all bonded indebtedness heretofore authorized and to be represented by bonds of said City hereafter to be issued. The territory herein referred to is situated in the County of San Luis Obispo, State of California, is contiguous-to the City of San Luis Obispo, and the boundaries thereof are specifically described as follows: Commencing at the Northeasterly corner of Block 5 of the Goldtree Vineyard Tract as shown on map filed and recorded September 30, 1893, in Licensed Surveyors Map book No.l, page 14, San Luis Obispo County Records, said point of com- mencement also being the northeasterly corner of Lot 4, Block 5 of said Goldtree Vineyard Tract; thence Southeasterly and along the Northeasterly boundary of aforementioned block 5 to the Southeasterly corner of Lot 15, Block 5 of afore- mentioned Tract; thence Easterly and along the south line of the aforementioned Tract, said south line also being the south, boundary lines of Lots O,.P, R. and S in said Goldtree Vineyard Tract, to a point distant 1320 feet west of the one - quarter section corner common to Section 36, Township 30 South, Range 12 East, Mount Diablo Base @nd Meridian and Section 31 Township 30 South, Range 13 East, Mount Diablo base and Meridian; thence southerly and along a line parallel to and distant 1320 feet west of the common section line to the aforementioned Sections 36 and 31 to a point 1320 feet north of the common Section line to said Section 36, Township 30 south, Range 12 East and Section 1, Township 31. NOTICE IS ALSO HEREBY GIVEN that Monday, the 1st day of November, 1948, at the hour of 7:30 o'clock P.M. of said day, and ati the Council Chamber of the City Council of said City of San Luis Obispo, in the City Recreation Building, 864 Santa Rosa Street, in said City, are hereby and have been fixed as the day, hour and place . when and where any person own- ing real property within said territory so proposed to be annexed and hav- ing any objections to the proposed annexation, may appear before the City Council of said City of San Luis Obispo and show cause why said territory should not be so annexed. Any protest must be in writing and shall state the name or names of the owner or ovmers of the property affected and the location and area of such property in general terms. Any such protest shall be filed in the office "of the City Clerk of said city not later than the hour set for hearing objections to the proposed election. The "Telegram - Tribune ", a daily newspaper published and circulated in said City is hereby designated as the newspaper in which this resolu= tion shall be published, and the City Clerk is hereby directed to cause this resolution to 'be published in the manner and form required by law. Reference is hereby made to the act of the Legislature of the State of California designated as the "Annexation Act of 1913", approved 4- ao June 11, 1913, as amended, under the provisions of which act the said petition was filed, and under the provisions'of which act all proceedings for such annexation shall be had and conducted. AND BE IT FMTHER RESOLVED AND DETERMINED that a Special Election be, and the same is hereby, called to submit to the qualified electors of the Portions of Blocks 3, 4, and 5 of the Goldtree Vineyard Tract;. Portions of the Southeast one - quarter and the southwest one - quarter of Sedtion 36, Township 30 south, Range 12 East, M.D.B. & DDS; and Portions of the northeast one - quarter and Northwest one - quarter of Section 1, Township 31 South, flange 12 East, M.D.B. & 145, the, question whether said territory shall be annexed to, incorporated in, and made a part of the City of San Luis Obispo and that the property within said territory, after such annexation, be subject to taxation equally with the property within said City of San Luis Obispo to pay for all of the bonded indebtedness of said city for the acquisition, construction and completion of various municipal improvements, incurred and out- standing at the date of such annexation, and all bonded indebtedness heretofore authorized and to be represented by bonds of said city hereafter.to be issued.' Said Special Election shall be held on the 1st day of December 1948, and notice of'said special election shall.be given by the publication of the "Notice of Special Election ", hereinafter set forth. The City Clerk of the City of San Luis Obispo shall cause such. "Notice of Special Election" to be published in the.manner and form and for the time required by law, in the "Atascadero News" a weekly newspaper of general circulation, printed and published outside of-the City of San Luis Obispo but in the County in which the- territory, so proposed to be annexed is situated, and hereby designated as the newspaper in which said notice shall be published. For the purpose of holding said Special Election, the entire territory-so proposed to be annexed is established as a voting precinct. The voting place of said precinct shall be at Roy L. Hilliard Residence, 2487 Johnson Avenue, within said territory, where the polls will be open for such Special Election. The officers of such election shall be two 2- Judges; and one'Inspector, and the following are appointed to act as such: Judges, Mrs. Elizabeth E. I.Villard and Jlrs. Leona E. Hilliard; Inspector, 0. Richard Johnson. The Ballots to be used at said election shall be of ordinary election ticket .paper and of such size and shape to contain the proposition to be submitted at such election. The heading of such ballots must be substantially as follows: "Special Annexation Election December 1, 1948." All marks, except the cross (z) are forbidden. All distin- guishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the Inspector of election and obtain'another.. The manner of holding and conduction said election shall be as follows: 1) As provided for in this-resolution. 2) As provided by law for holding elections of the kind herein called. Ferini, City Engineer City of San Luis Obispo Department of Public Works San Luis Obispo, California Dear Mr. Ferini: Referring to your letter.of March 17, 19499 concerning proposed agreements with the City of San Luis Obispo covering the installation of crossing signals at crossing E 251.4, March 2, San Luis Obispo. Referring to your suggestion that agreement be drawn stipulating the maximum amount to be paid by the City as its share of the installtion cost. The estimate for this project was made as accurately as possible to adequately cover the proposed work, and it is usually possible to perform the work within such estimates, resulting in a saving to the Municipality involved, However, an occasion might arise due to conditions beyond our control where es- timated cost may be slightly exceeded, and in that case, we would expect the City to make up the differ- ence between actual cost and the estimate. In these matters, the Railroad is not in position to act as a contractor and make a firm bid, as it is our practice to perform work at actual cost without profit, -and if we were to increase our estimate to a figure that we would be absolutely sure would not be exceeded, it would be detrimental to the City. We have arrangements with,the State of California in connection with crossing protection in- stallations of this nature, where the State agrees to reimburse the Railroad for the actual cost of the project, based on estimates as in this case, and these arrangements have worked out to the satisfaction of all concerned. 2- 321 -3 Mr.-G. Ferini: San Francisco, April 69 1949 The same procedure is followed in all our agreements with all Cities and Counties in the State, where this type of.work is being done, and the result has worked out to the benefit of all concerned, and we respectfully suggest reconsideration on that basis by the City of San Luis Obispo. Concerning the furnishing of a copy of itemized bill showing all labor and materials used in connection with this signal work, we will be very pleased to do so, as it is our usual practice to fur- nish such fully itemized statements in connection with all matters of this nature.
