HomeMy WebLinkAbout100-199K4JH &Til : HNB :miss %- 5-13-57 I RESOLUTION NO. 199 A RESOLUTION ORDERING MODIFICATION OF ASSESSMENTS AND ORDERING CITY "CONTRIBUTION JOHNSON STREET, ET AL PROJECT S -56 -1 RESOLVED, by the City Council of the City of San Luis Obispo, California, that WHEREAS, the estimated cost.of the project under Resolution No. 182 of Preliminary Determination and of Intention adopted by the City Council of said City on'February 18; 1957, was $272,154.25 and following the opening of bids therefor, said estimate may be reduced to $237,517.54; NOW, THEREFORE, IT IS ORDERED as follows: 1. That the City Engineer reduce each of said assessments and the City contribution heretofore provided by a pro -rata share of the amount of difference between said estimates. 2. That he further reduce assessment Nos. 406 and 421 to $6370.36.and $1641.07; respectively. 3. That he further reduce assessment.Nos. 35 and 38 to $154.46 and $177.523 respectively. 4. That he provide for an additional City contribution of $19,462.53 to pay for the difference in cost between an 18 -inch line between Storey Street and Higuera Street and an 8 -inch line between said streets, and further reduce assessment Nos. 193 to 206, inclusive, and,110 to 155, inclusive, by their pro rata share of said contribution. 5. That he reduce assessment Nos. 156 to 161, inclusive, to zero. 6. That he resprdad the total amount (of $3695.61 among assessments Nos. 306 to 311, inclusive; 325 to 339, inclusive; 345 to 360, inclusive; and 364 to 404, inclusive, equally. '1 7. Said changes may either be made on the face of the assessment or by filing an amendment thereto. 9 .I hereby certify that the foregoing resolution was passed by the City Council of the City of San Luis Obispo, California, at a regular adjourned meeting thereof held on the '22nd day of April, 1957, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Nels Beck, Lowell E. Lucksinger NOES, Councilmen: None ABSENT, Councilmen: None r CiVnerkOrthe city or an APPROVED: Luis Obispo /3P RESOLUTION N0. 197 RESOLUTION OF.THE'COUNCIL OF THE CITY,OF SAN LUIS OBISPO DECLARING CANVASS OF CONSOLIDATED SPECIAL.MUNICIPAL BOND ELECTION HELD ON APRIL 9, 19570 WHEREAS, the Council of the City of San Luis Obispo by Resolution No. 181 (1957 Series) duly passed and adopted on February 18, 1957, called and ordered held in said City on April 9, 1951s a general municipal election, designated the precincts and polling places and. appointed the members of the precinct boards for said general municipal election so called and ordered to be held in said City on April 9, 1957, as required by law; and WHEREAS.. pursuant to Ordinance No. 39 (1957 Series) duly adopted by said City Council on.March 4, 1957, a special municipal bond election was called for the purpose of sub= mitting to the qualified electors. -of said City the bond measure hereinafter specified, which said special municipal bond election was by said Ordinance No. 39 (1957 Series) consolidated with the general municipal election hereinabove referred to; and WHEREAS, it appears that said consolidated special municipal bond election was duly held upon due notice in accordance with law and with said call on said date aforesaid, and that the polls for said election were kept open during the time required by law, and that said election was held and conducted, And the votes thereat received and canvassed, and 1 /97 the returns thereof ascertained, determined and declared, all as provided by the laws of-the State of California, and by.said Ordinance, and this Council has duly met.and canvassed the returns of said consolidated election, and the City Clerk of said City has duly filed with this Council .a statement of the result of said election, NOW,. WHEREAS, an Election was held in the City of•San Luis Obispo on the 9th day of April., 1957, which election was duly held and con- ducted in the-manner. provided by the Charter of the City of San Luis Obispo, and as provided by law. AND WHEREAS, within four days after such election, to -wit, on the 16th day of April, 1957, the City Council met as a canvassing board and duly canvassed the returns of the votes cast at each of the precincts of said election. We are enclosing a copy of the assessors plat showing Emily Street and the adjacent properties. The area in blue and Emily Street as crosshatched now stands of record in the names of Q. L. Richard and V. G. Morf, each as to an undivided one half interest. The area in green, stands of records in The National Life and Accident Insurance Company. The City still holds an easement across Emily Street which has not been abandoned according to the Official Re- cords of San Luis.Obispo County. We have not examined the records of the City to determine if such an abandonment has occurred. The owners of the area shaded in green are presumed to have a right to use that portion of Emily Street adjacent as a way of access. (2) With these two facts in mind, we have declined to in- sure the ownership of Emily Street until the street is abandoned and a quitclaim deed is obtained from the owners of the area shaded in green.
