A RESOLUTION RENUMBERING AND RENAMING MOTLEY
AVENUE TO LONGVIEW LANE.
BE IT RESOLVED by the Council of the City of San Luis Obispo that the following
changes in street numbers and names will be made effective July 1, 1971:
1. That Motley Avenue will be renamed as Longview Lane.
2. That the present Longview Lane be designated as an unnamed alley.
3. That new Longview Lane be renumbered to correspond with the City's
numbering plan.
On motion of Councilman Blake, seconded by Councilman Spring, and on the
following roll call vote:
AYES: Councilmen Blake, Graham, Spring and Mayor Schwartz
NOES: Councilman 1..aUer

A RESOLUTION DECLARING THE RESULTS OF THE ELECTION
HELD APRIL 20, 1971.
WHEREAS, an Election was held in the City of San Luis Obispo on the 20th day of
April, 1971, which election was duly held and conducted in the manner provided by the
Charter of the City of San Luis Obispo, and as provided by law; and
WHEREAS. within seven days after such election, to wit: on the 27th day of
April, 1971, the City Clerk was appointed as a canvassing board and duly canvassed the
returns of the votes cast at each of the precincts of said election; and
WHEREAS, on April 20, 1971, the counting boards appointed by the City Clerk
met and counted and canvassed all absentee ballots; and
WHEREAS, a statement of the results of said election has been duly entered by
the City Clerk in the minutes and records of the City Council.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo that:
1. The whole number of votes cast in said election within the City of San Luis
Obispo was 6,299.
2. The names of the persons voted for, the office for which each person was voted
for, the number of votes given at each precinct to each person and measure, and the
total number of votes given to each person and measure, are shown by the tabulation of
votes, marked Exhibit "A" and attached hereto, and by this reference incorporated herein
as though fully set forth.
3. KENNETH E. SCH1gARTZ, the candidate having received the highest number of
votes cast at said election for the office of P:ayor, is hereby declared elected to such
office for the term prescribed by the City Charter.
4. JOHN C. BROVIN and T. KEITH GURNEE, the two candidates having received
the highest number of votes cast at said election for the office of City Councilman, are
and each of them is hereby declared elected to such office for the term prescribed by the
City Charter.
5. The City Clerk is directed to notify the County Superintendent of Schools of
the votes cast within the City of San Luis Obispo for Governing Board members of the
San Luis Obispo County Junior College District, Governing Board members of the San
Luis Coastal Unified School District Trustee Area No. 1 and 2, and County Board of
Education District No. 5, said elections having been consolidated with the General
Municipal Election of April 20, 1971.

6. The City Clerk is hereby directed to sign and deliver to each of said
Kenneth E. Schwartz, john C. Brown and T. I:eith Gurnee a certificate of election
certifying to his election to his respective office, as hereinbefore set forth.

following roll call vote:
AYES: Councilmen Blake, Graham, Miller and Mayor Schwartz

RESOLUTION NO. 2184 (1971 Series)
A RESOLUTION APPROVING SELECTED STREET NUNMEP.ING
AND NAME CHANGES.
BE IT RESOLVED by the Council of the City of San Luis Obispo that the following
changes in street numbers and names will be made effective October 1, 1972:
1. That the 100 and 200.biocks of Parker, Beebee, Cypress, Price, Harris,
King, Hutton, Yard and Story Streets are to be changed to the 2000 and 2100 blocks
respectively.
2. That the 400 through 900 blocks of I;ranch, High, Sandercock and South
Streets are to be changed to the 300 through 600 blocks respectively.
3. That High Street east of the railroad tracks is to be changed to Rachel Court.
4. That the 100 through 900 blocks of South Higuera be changed to the 2700 through
4100 blocks.
5. That the 300 block of California Boulevard be changed to the 200 block.
6. That the numbering sequence on California Boulevard be reversed north of
Foothill Boulevard.
7. That the 1000, 1100 and a portion of the 1200 block of Kentwood Drive be
changed to the 1100, 1200 and 1300 blocks respectively.
8. That the 800. and 900 blocks of Meinecl a Street, Murray Street and Rougeot
Place be changed to the 700 and 0000 blocks respectively.
9. That the 1400 block of Newport Street be changed to the 1200 block.
10. That the 1400 block of Newport Street be changed to 7lest Newport Street.
11. That the 3100 bloc:: of Richard Street be changed to the 1300 block.
12. That the 100 througli 600 blocks of Santa Barbara Avenue be changed to the
1700 through 2100 blocks respectively.
13. That the 2900 through 3300 blocks of Southwood Drive be changed to the 1000
through 1400 blocks respectively.

RESOLUTION NO. 2183 (1971 Series)
A RESOLUTION REQUIRING SIDEWALIC IMPROVEMENTS
ON PORM ONS OF VARIOUS STREETS IN THE CITY OF
SAN LUIS OBISPO.
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
1. That the Council hereby preliminarily determines that the public interest,
necessity and convenience require the construction of curbs, gutters, sidewalks and
driveway ramp improvements on those portions of streets within the. City of San Luis
Obispo as set forth on Exhibit "A" attached hereto and incorporated by reference.
2. That May 17, 1971 at 8:00 P. M. in the Council Chambers of the City Hall,
990 Palm Street, San Luis Obispo, California, is the time and place set for public
hearing on said matter, and notice thereof shall he published twice in the Telegram -
Tribune, a newspaper of general circulation in said City; the first publication to be at least
twenty days prior to said hearing. Said parcels shall be posted at least ten days prior
to said hearing.
3. That subject to any modifications or exceptions declared by the Council at the
close of said hearing, said parcels shall be so improved by the property miner, or the
City Engineer shall proceedtohave the work done and the cost thereof shall be made a
lien against the property in accordance with Sections 7350 et. seq, of the San Luis
Obispo Municipal Code.

RESOLUTION NO. 2102 (1971 Series)
A RESOLUTION DECLARING APRIL 22, 1971 AS EARTH
DAY IN SAN LUIS OBISPO.
WHEREAS, the people of the United States find themselves in an ecological
crisis... confronted by pollution of our air, supporting environment; and
WHEREAS, such pollution threatens our way of life, our health and the health
of future generations, our national interests and, potentially, the total ecological
balance of our earth; and
WHEREAS, the solutions to our nation's environmental challenges rest upon the
shoulders of all federal, state and local community leaders; upon our business, civic,
professional and religious leaders; and, indeed, upon our every citizen; and
WHEREAS, April 22, 1971 is the first anniversary of Earth Day which was
designed to focus public attention upon this critical problem facing us today and to
activate the concerned citizens of this state to take roles of productive leadership in their
communities.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. That April 22, 1971 be and the same is hereby declared Earth Day in the
City of San Luis Obispo.
2. That the Council hereby encourages the participation of all civic organizations,
schools and youth organizations in appropriate observances of this special day.

THE MAYOR TO EXECUTE AGREEMENT WITH
THE CALIFORNIA DIVISION OF HIGHWAYS FOR
RELOCATION OF A WATER MAIN ON CALIFORNIA
BOULEVARD AT FREEWAY 101.
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
1. That certain agreement between the California Division of Highways and
the City of San Luis Obispo is hereby approved.
2. The Mayor is hereby authorized and directed to execute said agreement on
behalf of the City of San Luis Obispo.

A RESOLUTION AUTHORIZING THE CITY CLERK TO
MAKE THE OFFICIAL CANVASS OF THE RESULTS OF
THE APRIL 20, 1971 GENERIAL MUNICIPAL ELECTION.
BE IT RESOLVED by the Council of the City of San Luis Obispo that:
1. In accordance with the provisions of Section 22932.5 of the Elections Code
of the State of California, the City Clerk of the City of San Luis Obispo is hereby
ordered and directed to conduct the official canvass of the results of the General
Municipal Election, to be held in said City on April 20, 1971.
2. Upon completion of said canvass, the City Clerk shall certify the results
to the City Council.

BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
1. That Account No. 900.1 Whale Roc:, Salaries be increased by $250 and
Account No. 900.2 Whale Pock Contractual Services be increased by $1 500.
2. That Account No. 200.13 General Government - Miscellaneous Expenditures
be increased by $1 000 and the Unbudgeted Reserve be decreased by $1 000.
3. That Account No. 203.3 City Clerk, i::aterials and Supplies be increased by
$500 and the Unhudgeted Reserve be decreased by $500.

DESCRIPTION AND MAP FOR THE HIGHLP_ND DRIVE
ANNEXATION.
WHEREAS, one of the property owners who had originally requested to be
included in the proposed Highland Drive Annexation has now decided to withdraw until
a larger portion of their property can be included in a proposed annexation; and
WHEREAS, the City of San Luis Obispo is the only other property owner in said
annexation and desires to annex its territory to the City.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The attached legal description of the revised Highland Drive Annexation is
hereby approved and the City Engineer is directed to forward an appropriate map

A RESOLUTION SUPPORTING THE ESTABLISHMENT OF A
NATIONAL CEIiETERY AT VANDENBERG AIR FORCE BASE,
CALIFORNIA.
WHEREAS, there are three National Cemeteries in California, located at Fort
Rosecraus, San Diego, Golden Gate National Cemetery at San Bruno and San Francisco
National Cemetery at the Presidio in San Francisco; and
WHEREAS, all three of these National Cemeteries are closed due to space
limitations for internment of deceased military personnel and veterans unless the Vietnam
casualty dies in a hospital nearby to one of these National Cemeteries; and
WHEREAS, according to the latest information from the Chief of Support Services,
Department of the Army, Washington, D.C. , which is currently in charge of national
cemeteries on the national level, no action has been taken to create new national cemeteries
to meet geographical needs; and
WHEREAS, according to Department of Defense records, as of June 30, 1966,
population figures indicated there were 2, 691, 000 veterans in the State of California, plus
137,400 military service retirees; and
WHEREAS, there is government -owned land available at Vandenberg Air Force
Base meeting all established criteria as set forth by the Chief of Support Services,
Department of the Army, Washington, D.C., including utilities, access and support
services, which can be utilized with very minimal expense to establish a National Cemetery;
and
WHEREAS, this government -owned land at Vandenberg Air Force Base is not
programmed for any use at any time in the future under the Muster Operational and
Administrative Plans of the Base; and
WHEREAS, Congressman Charles M. Teague has introduced H. It. 3846 in the
House of Representatives for the establishment of a national cemetery within the boundaries
of Vandenberg Air Force Base, California;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Council of the City of
San Luis Obispo as follows:
1. The City Council of the City of San Luis Obispo hereby requests and encourages
the establishment of a National Cemetery at Vandenberg Air Force Base and is in full
support of H.R. 3846.

WHEREAS, it is estimated that the total cost of the program of such studies is
$9,953, of which the City's share would-be approximately $2,598; and

City of San Luis Obispo;

WHEREAS. legislation which would require compulsory and binding arbitration of
salaries and working conditions of policemen and firemen would enable nonelected individuals
who are not responsible to the taxpayers to have a substantial voice in a city's budZet and
tax rate with no recourse by the people; and
WHEREAS, the final decision on fiscal matters should always reside with the elected
representatives of the people; and
WHEREAS, adoption of compulsory arbitration for wage disputes by policemen and
firemen would have an immediate impact upon wages and fringe benefits of other public
employees of a local agency.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The governing body of the City of San Luis Obispo is strongly opposed to
Senate Bill 333 or any similar state legislation which would require compulsory and binding
arbitration of salaries and working conditions even though such special treatment is initially
limited to policemen and firemen.
2. The City Clerk is hereby authorized and directed to immediately forward copies

WHEREAS, one of the prime assets of the State of California is its tourist
business; and
WHEREAS, the Central Coast area presently served by passenger trains running
between San Francisco and Los Angeles contains much scenic shoreline which is
visible to tourists using the present rail facilities; and
WHEREAS, deprivation of rail service for the coastal communities currently
enjoying the benefits of such transportation would be an unjust hardship to both the
residents of the affected cities and to the tourists who are attracted to California by
its scenic coastal landmarks.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The City of San Luis Obispo hereby requests and urges that rail passenger
service between Los Angeles and San Francisco be continued through the coastal route
via San Luis Obispo and Santa Barbara, and if any passenger rail service is to be
eliminated, that the inland passenger service via Fresno would be the logical route to
be discontinued for the reasons set forth above. The City of San Luis Obispo further
wishes to go on record as protesting any plan which would seek to eliminate rail
passenger service to this community.
2. The City Clerk is hereby authorized and directed to forward a copy of this
resolution to the Chairman of the National Rail Passenger Corporation, to the United
States Secretary of Transportation and to Congressman Burt L. Talcott of the 12th
Congressional District of California and United States Senators - Cranston and Tunney.

containers is producing an adverse effect upon the environment which is injurious to the
health, safety and welfare of the residents of San Luis Obispo, and the entire State of
California; and
WHEREAS, the problems created by the sale of malt and carbonated beverages
m disposable, non -returnable containers cannot be solved on a local level, but must be
dealt with on at least the State level.
NOCJ, THEREFCRE, BE IT RESOLVED by the Council of the City of San Luis
Obispo that it urges the League of California Cities and the County Supervisors'.
Association of California to seek the following actions by the State Legislature to
alleviate the problems of litter and waste disposal created by the sale of malt and
carbonated beverages in disposable, non - returnable containers;
(a) require a deposit on all containers used for the sale of malt and
carbonated beverages;
(b) Promote, encourage and support research by the beverage and
container industries in the field of biodegradable containers; and
(c) Develop, encourage and support pro.-rams aimed at encouraging the
citizens of the State of California to take a more responsible attitude toward the disposal
of beverage containers, including recycling.
BE IT FURTHER RESOLVED that the City of San Luis Obispo hereby requests all
of the cities and counties in California to take similar action urging the League of
California Cities and the County Supervisors' Association of California to sees: action by
the State Legislature which will alleviate the problems of litter and waste disposal created

PUBLIC NUISANCE AND DECLA%ING SAME A SPECIAL

WHEREAS, certain obstructions on property located at 1027 Nipomo Street,
San Luis Obispo, have heretofore been.found and declared by the City Council to be a
public nuisance; and
WHEREAS, public hearings were duly held on the matter at the conclusion of
which the City Council ordered the property owner to remove said obstructions; and
WHEREAS, the obstructions were removed at City expense, when the property
owner failed to voluntarily abate said nuisance, pursuant to Ordinance No. 459
(1969 Series) which provides that the full cost of abating such public nuisances shall be
made a special assessment against the concerned parcel.
NOW, THEREFORE, BE rr RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. That those certain costs of removal of obstructions from the property,
more fully described on Exhibit "A" hereto, owned by Robert D. Leitcher, 642
Monterey Street, San Luis Obispo, California, as set forth in that certain letter dated
January 29, 1971 to Ivir. Leitcher from the City Clerk be and the same are hereby
confirmed and the total cost of such work, being $361.05, is hereby declared to be
and the same shall hereafter be a special assessment and lien against the affected parcel.
2. The City Engineer is hereby authorized and directed to cause to be filed
in the Office of the County Recorder of the County of San Luis Obispo a certificate
in substantially the form attached hereto as Exhibit "B" to give formal notice to
concerned parties of the lien hereby established against the concerned parcel of real
property.

RESOLVED, by.the City Council of the City of San Luis Obispo,
California, that
WHEREAS, said Council did on October 5, 1970, pass and adopt
its Resolution of Intention No: 2104 (1970 Series) relating to the
acquisition and construction of public improvements in said City
under and pursuant to the provisions of the Municipal Improvement
Act of 1913, and amendments thereto, and did therein provide that
serial bonds would be issued thereunder pursuant to the provisions
of the Improvement Bond Act of 1915, reference to said Resolution
of Intention hereby being expressly made for further particulars;
WHEREAS, notice of the recordation of the assessment and of the
time within which assessments may paid in cash, has been duly pub-
lished and mailed in the manner provided by law, and the time so
provided.for receiving the payment of assessments in cash has expired,
and the City Clerk has filed with the City Treasurer a list of all
assessments which now remain unpaid; and
WHEREAS, the Council has duly considered said list and has
determined-that the same is an accurate statement thereof;
NOW, THEREFORE IT IS HEREBY ORDERED, as follows:
1. That the assessments in said unpaid list which now remain
unpaid., and the aggregate thereof, are as shown on Exhibit "A"
hereto attached and by reference made a part hereof.

bear interest from their date at the rate of five percent (5%) per
annum, and the denomination of said bonds with their respective
numbers and dates of maturity are shown on Exhibit "B" hereto
attached and made a part hereof by reference.
4. Said bonds shall be issued in series, and the unpaid assess-
ments as shown on said list filed with the City Treasurer of said
City and determined -by said Council, together with the interest thereon,
shall remain and.constitute a trust fund for the redemption and payment
of said bonds and of the interest which may be due thereon, which un-
paid assessments shall be taxable in annual series corresponding in
number to the number of series of bonds issued, and an annual propor-
tion of each assessment shall be payable in each year preceding the
date of the maturity for each of the several bonds issued, and such
proportion of each assessment coming due in any year, together with
the annual interest thereon, shall in turn be payable in installments
as the general taxes of said City on real property are payable, and
shall become delinquent at the same time and in the same propor-
tionate amounts and bear the same proportionate penalties for
delinquency.
5. Said bonds shall be signed by the Clerk and Treasurer of the
City or bear the Treasurer's engraved, printed or lithographed.

WHEREAS, it has come to the attention of the Council of the City of San Luis
Obispo that the Board of Supervisors recently denied requests to quarry native materials
from the scenic peaks surroundinrr the City of San Luis Obispo; and
VIHEREAS, such action to preserve the scenic beauty of the area and to explore
means of granting the affected property owners appropriate tax relief if open space
easements are granted merits the support of all affected public bodies and citizens of this
area.
NOVI, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. That the Board of Supervisors of the County of San Luis Obispo be and they are
hereby commended for their decision to reject applications to quarry native materials
from the scenic peaks which surround the City of San Luis Obispo.
2. That the City of San Luis Obispo endorses the principle of encouraginU
property owners to dedicate to the public open space easements covering such scenic areas
in return for appropriate adjustments in the assessed valuation of the affected parcels
of real property.

OF THE SAN LUIS COASTAL UNIFIED.SCHOOL DISTRICT, SAN
LUIS OBISPO COUNTY JUNIOR COLLEGE DISTRICT AND THE SAN
LUIS OBISPO COUNTY BOARD OF EDUCATION WITH THE APRIL 20,
1971 MUNICIPAL ELECTION.
WHEREAS, Education Code Sections 1331 through 1338 and Elections Code Sections
23300, 23304, 23305, 23307 and 23311 provide for the consolidation of school district
elections with municipal elections when they are held on the same day in the same
territory insofar as the municipal election precincts are entirely within the school
district or coterminous with said districts; and .
WHEREAS, the County Superintendent of Schools, by a letter dated January 18,
1971, has requested the consolidation of the election for members of the governing board
of the San Luis Coastal Unified School District, the election for members of the governing
board of the San Luis Obispo County Junior College District, and the election of the
governing board of the San Luis Obispo County Board of Education to be held on the 20th
day of April, 1971, with the municipal election of the City of San Luis Obispo to be held
on the same date within those portions of said districts located within the City of San
Luis Obispo; and
WHEREAS, it will be in the public interest and a saving of tax money to consolidate
said elections insofar as it is legally permissible.
NOVI, THEREFORE, BE ri RESOLVED and ORDERED by the Council of the City
of San Luis Obispo as follows:
1. That said election for members of the governing board of the San Luis Coastal
Unified School District, the election for members of the governing board of the San Luis
Obispo County Junior College District and the election of the governing board of the
San Luis Obispo County Board of Education be and the same hereby are consolidated with
the municipal election of the City of San Luis Obispo to be held on April 20, 1971, under
the provisions of Sections 23300, et seq, of the Elections Code, and Sections 1331 et seq.
of the Education Code within those portions of said districts which are located within the
boundaries of the City of San Luis Obispo.
2. That within those portions of said school districts which are entirely within the
City of San Luis Obispo, the election shall be held in all respects as if there were only
one election and only one form of ballot shall be used therein.
3. That the County Superintendent of Schools has requested and authorized the
City Council to canvass the returns of said school district elections for those election
precincts which are entirely within the City of San Luis Obispo, _ pursuant to Elections
Code Section 23307.

WHEREAS, studies, have shown that the automobile is one of the major sources
of air pollution; and
WHEREAS, it is in the public interest that every effort be made to minimize
environmental pollution.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The Council hereby urges all citizens of the City of San Luis Obispo to set
aside one working day a month, preferably the 22nd of each month, as a day to give the
air a rest and leave their automobile or other vehicle at home, where practical, and
walk to work or school so each of us can contribute to improving the quality of the air
in this community.
2. The City Clerk is hereby authorized and directed to furnish copies of this

through the peaks southwesterly of the civic center will be kept to a minimum and
appropriately landscaped; and
WHEREAS, the only logical alternate route would cross a portion of Laguna Lake
Park- and because of reverberations from the sides of the hills would project the noise
of heavy traffic to the Laguna Lake residential area to the detriment of the residents.
NOVI, THEREFORE, BE IT.RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. Resolution No. 2130 (1971 Series) adopted January 11, 1971 requesting the
California. Highway Commission and the State Division of Highways to re -study the
section of the proposed new routing of Highway 1 beginning with a point midway between

SECTION 1. TITLE OF 1' ,LS OLUTION
This Resolution shall be :onawn as the Employer - Employee Relations ,esolution
of the City of San Luis Gbispo.
SECTION 2. STATEMENT OF PURPOSE
The purpose of this Restitution is to implement Chapter 10, Division 4, Title
1 of the Government Code of the State of California (Sections 3500 et seq.) captioned
"Public Employee Organizations, " by providing orderly procedures for the administinti m
of employer -employee relations between the City and its employee organizations and for
resolving disputes regarding wages, hours, and other terms and conditions of employment.
SECTION 3. DEFINITIONS
As used in this Resolution, the following terns shall have the meanings indicated:
A. Appropriate Unit —means a unit established pursuant to Section 10 of
this Resolution.
B. City - means the City of San Luis Obispo, a municipal corporation, and where
appropriate herein, "City" refers to the City Council, the governing body of
said City, or any duly authorized management employee as herein defined.
C. Consult or Consultation in Good Faith - means to communicate verbally
or- in writing for the purpose of preoentine and obtaining views or advis nr'r of
intended actions.
D. Employee - means any person regularly employed by the City except hose
persons elected by popular vote.
E. Employee, Confidential - means an employee who is privy to decisions of
City management affecting employer - employee relations.
F. Employee, YAuxge:nent - means:
1. Any employee having significant responsibilities for formulating and
administering City policies and programs, including but not limited to the
chief executive officer and department heads; and
2. Any employee having authority to exercise independent judgment to hire,
transfer, suspend, lay-off, recall, promote, discharge, assign, reward,
or discipline other employees, or having the responsibility to direct them,
or to adjust their grievances, or effectively to recommend such action if in
connection with the foregoing, the exercise of such authority is not of a
merely routine or clerical nature, but requires the use of independent
Judgment.
G. Employee, Professional - means employees engaged in work requiring
specialized knowledge and skills attained through completion of a recognized
course of instruction, including, but not limited to, attorneys, engineers and
architects.

H. Employee Organization - means any organization which includes employees
of the City and which has as one of its primary purposes representing such
employees in their employment relations with the Ciy.
I. Employer - Employee. Relations - means the relationship between the City
and its employees and their employee organization, or when used in a general
sense, the relationship between City management and employees or employee
organizations.
j . Grievance - as this term is defined in Section 13 (A) .
K. Impasse - means (1) a deadlock in the annual (or periodic) discussions bet-
ween a majority representative and the City over any matters concerning which
they are required to meet and confer in good faith, or over the scope of such
subject matter; or (2) any unresolved complaint by an affected employee organization
advanced in good faith, concerning a decision of the Municipal Employee Relations
Officer made pursuant to Sections 9, 10 or 11 of this Resolution.
L. Majority Representative - means an employee organization, or its duly
authorized representative, that has been granted formal recognition by the
Municipal Employee Relations Officer as representing the majority of employees
in an appropriate unit.
M. Mediation or Conciliation - means the efforts of an impartial third person, or
persons, functioning as intermediaries, to assist the parties in reaching a
voluntary resolution to an impasse, through interpretation, suggestion and advice.
Mediation and conciliation are interchangeable terms. All such proceedings shall
be private and the mediator shall make no public recommendations nor take any
Public position concerning the issues.
N. Meet and Confer in Good Faith (sometimes rebrred to herein as "meet and
confer" or "meeting and conferring') - means perf)rmance by duly authorized
City representatives and duly authorized represenatives of an employee
organization recognized as the majority representa:ive of their mutual obligation
to meet at reasonable times and to discuss in good faith matters within the scope
of representation, including wages, hours, and other terms and conditions of
employment, in an effort to: (1) reach agreement on those matters within the
authority of such representatives and (2) reach agreement on what will be re-
commended to the City Council on those matters within the decision malting authority
Of the City Council. 711s does not require either party to agree to a proposal or
to make a concession.

O. Municipal Employee Relations Officer - means the City's principal
representative in all matters of employer - employee relations designated pursuant
to Section 12, or his duly authorized representative.
P. Resolution - means, unless the context indicates otherwise, the Employer -
Employee Relations Resolution of the City of San Luis Obispo.
Q. Peace Officer - as this term is defined in Section 817, California Penal Code.
R. Recognized Employee Organizations - means an employee organisation which
has been acknowledged by the Municipal Employee Relations Officer as an employee
organization that represents employees of the City. The rights accompanying
recognition are either:
1. Formal Recognition - which is the right to meet and confer in good faith
as the majority representative in an appropriate unit; or
2. Informal Recognition - which is the right to consultation in good faith
as appropriate for other recognized employee organizations.
S. Scope of Representation - means all matters relating to employment
conditions and employer - employee relations, including, but not limited to, wages,
hours and other terms and conditions of employment. City Rights (Section 5) are
excluded from the scope of representation.
SECTION 4. EMPLOYEE RIGHTS
Employees of the City shall have the right to form, join and participate in the
activities of employee organizations of their own choosing for the purpose of representation
on all matters of employer - employee relations including but not limited to wages, hours .
and other terms and conditions of employment. Employees of the City also shall have the
right to refuse to join or participate in the activities of employee organizations and shall
have the right to represent themselves individually in their employment relations with
the City. No employee shall be interfered with, intimidated, restrained, coerced or
discriminated against because of his exercise of these rights.
SECTION 5. CITY RIGHTS
The rights of the City include, but are not limited to, the exclusive right-to
determine the mission of its constituent departments, commissions and boards; set standard
of service; determine the procedures and standards of selection for employment and pro -. .
motion; direct its employees; take disciplinary action; relieve its employees from duty
because of lack of work or for other legitimate reasons; maintain the efficiency of
governmental operations; determine the methods, .means and personnel by which govern-
ment operations are to be conducted; determine the content of job classifications; take
all necessary actions to carry out its mission in emergencies; and exercise complete
control and discretion over its organization and the technology of performing its work.

SECTION 6. MEET AND CONFER ,Uq GOOD FAUN - SCOPE
A. The City, through its representatives, shall meet and confer in good faith
with representatives of formally recognized employee organizations with majority
representation rights regarding matters wid n the scope of representation in-
cluding wages, hours and other terms and conditions of employment within the
appropriate unit.
B. The City shall not be required to meet and confer in. good faith on any subject
preempted -by Federal or State law or by die City Charter, nor shall it be re-
quired to meet and confer in good faith on Employee or City Rights as defined in
Sections 4 and 5. Proposed amendments to this Resolution are excluded from the
scope of meeting and conferring..
SECTION 7. CONSULTATION II,. GOOD FAITH - SCOPE
All matters affecting employer- employee relations, including those that are not
subject to meeting and conferring, are subject to consultation. The City, through its
representatives, shall consult in good faith with representatives of all recognized
employee organizations on employer - employee relations matters which affect them.
SECTION 8. ADVANCE NOTICE
WriMeu notice shall be given to each recognized employee- organization af6ecteda-
7ninimnrn of twelve (12) days prior to adoption of any ordinance, rule, resolutions or
regulation directly relating to matters widdu the scope of representation proposea to be
adopted by the City Council or by any board or commission of the City, and each small be
given the opportunity to meet with such body prior to adoption.
SECTION 9. PETITION FOR £ ECOGNPTION
There are two levels of employee organization recognition - formal and informal.
The recognition requirements of each are set forth helovr..
A. FORMAL RECOGNITION - the right to meet and confer in good faith as
majority representative: An employee organization that seep formal recognition
for purposes of meeting and conferring in good faith as the majority representative
of employees in an appropriate unit shall file a petition with the Municipal
Employee Relations Officer containing &.e follavving information and documentation:
1. Name and address of the employee organization.
2. Names and tides of its officers.
3. Names of employee organization representatives who are authorized
to speak on behalf of its members.
4. A statement that the employee organization has, as one of its primary
purposes, representing employees in their employment relations with the City.

5. A statement whether the employee organization is a chapter or local of,
or affiliated directly or indirectly in any manner with, a regional or state,
or national or international organization, and, if so, the name and address
of each such regional, state or international organization.
b. Certified copies of the employee organization's constitution and by -laws.
7. A designation of those persons, not exceeding two in number, and their
addresses, to whom notice sent by regular United States mail will be deemed
sufficient notice on the employee organization for any purpose.
8. A statement that the employee organization recognizes that the provisions
of Section 923 of the Labor Code are not applicable to City employees.
9. A statement that the employee organization has no restriction on member-
ship based on race, color, creed, sex or national origin.
10. The job classifications or titles of employees in the unit claimed to be
appropriate and the approximate number of member employees therein.
11. A statement that the employee organization has in its possession writvn
proof, dated within six months of the date upon which the petition is filed to
establish that employees in the unit claimed to be appropriate have designated
the employee organization to represent them in their employment relations
with the City. Such written proof shall be submitted for confirmation to the
Municipal Employee Relations Officer or to a mutually agreed upon dis-
interested third party.
12. A request that the Municipal Employee Relations Officer recognize the
employee organization as the majority representative of the employees in the
unit claimed to be appropriate for the purpose of meeting and confer ring
in good faith on all matters within the scope of representation.
B. INFORMAL RECOGNrrION - the right to consult in good faith: An employee
organization that seeks recognition for purposes of consultation in:good faith
shall file a petition with the Municipal Employee Relations Officer containing the
following information and documentation:
1. All of the information enumerated in (A.) (1) through. (9) of this Section
inclusive.
2. A statement that the employee organization has in its possession written
proof, dated within six months of the date upon which the petition is filed, to
establish that employees have designated the employee organization to
represent them in their employment relations with the City. Such written
proof shall be submitted for confirmation to the lvkmicipal Employee
Relations Officer or to a mutually agreed upon disirterested third party.

C. The petition, including all accompanying documents, shall be verified, under
oath, by the Executive Officer and Secretary of the organization that the statements
are true. All changes in such information shall be filed forthwith in lire manner.
D. The k.- :unicipal Employee Plations Officer shall ;rant recognition, in writing,
to all employee or.'a.nizations who have co_ :plied with Section 9 (A) or (B) and (C)
for purposes of consultation in good faith for its members. Employee organizations
seeidng formal recognition as majority representative must, in addition, satisfy
the requirernents of Section 11 (A) (1) below. 110 employee may be represented
by more than one recognized employee or ,a.nization for the purposes of tiis
tesolution.

shall determine whether the proposed unit is an appropriate unit. '=he principal
criterion in rna.langy this determination is whether there is a community ol i iterest
among such employes. I ae following factors, among others, are to be considered
in ma dng such deterr_'=tion:
1. 1hich unit will assure employees the fullest freedom in the exercise
of rights set forth under this resolution.
2. The history of employee relations: (i; in the unit; (i) a._.or. ;- other er_ ployee-
of the City; and (iii; is similar public er_�gIoST,ent.
3. The effect of tae unit on the efficient operation of the City and sound
employer - employee relations.
4. The extent to which employees have common skills, woar .in conditions,
job duties or sim :i1ax educational requirr:_.ents.
5. The effect on &e existing classification structure of dividin." a sin; 3e
classification among two or more units.
Provided, however, no unit shall be established solely on the basis of the =tent
to which employees in the proposed unit have organized.
B. In the establishment of appropriate units (1) professional employees shall
not be denied the right to be represented separately frori: non - professional
employees; and (2) r..anagement and confidential employees who are included in
the same unit with non - -anagement or non - confidential employees .hay not
represent such employees on matters witLin the scope of representation.

1. Determine the majority representative of City employees in an
appropriate unit either by arranging for a secret ballot election or by any
other reasonable method which is ha.sce-upon written proof, and is desiLned
to ascertain the free choice of a majority, of such employees. The er__ployee
organization found to represent a nn1.;or' of the err.pioyees in an appropriate
unit shall be granted formal recognition and is the only employee organization
entitled to meet and confer in good faitli on matters within the scope of
representation for employees in such unit. This shall. not preclude other
recognized employee organizations, or individual employees, froLa consulting
with management representatives on e:_.ployer- employee relations matters of
concern to them.
2. Revoke the recog,ution rights of a majority representative which has
been found by secret ballot election-no longer to be the majority representative.
B. The recognition.rihts of the majority representative designated in accordance
with this Section shall not be subject to challenge for a period of twelve months
following the date of such recognition.
SECTION 12. DESIG4NATION OF UIUNICIPAL ED:PLCYEE ::rLATIONS OFFICER.
The City Council hereby desiggiates the City 1.drninistrative Officer as the
Municipal Employee Relations officer who shall be the City's principal representative in
all matters of employer - employee relations, with aathority to meet and confer in 3oor1 faith
on matters within the scope of representation includkig wages, hours and other terns and
conditions of employment.
The i micipal Employee L.elations Officer so designated is authorized to delegate
these duties and responsibilities.
SECTION 13. RESOLMION CF Iii.PASSES
Impasse procedures may invoiced only after the possibility of settlement by
direct discussion has been exhausted.
The impasse procedures are as follows:
A. A DETEr--kvM&TICN BY THE Cl s Y C OUI TCiL - after a hearing on the merits of
the dispute.
B. Any other dispute resolving procedures to which the parties mutually agree or
which the City Council r::ay order.
Any party may initiate the impasse procedure ay filing with the other party (or

position on all disputed issues. in impasse meetin;; shall then be scheduled ay the
Umnicipal Employee F.elations Cificer forthwith after the date of filing of the written
request for such meeting, with vrritten notice to all parties a iected. The purpose of such
impasse meeting is twofold: (1; To permit a review of the position of all parties in a
final effort to reach agreerr_ent on the disputed issues, and (2) if agreement is not con -
cluded, to mutually select the specific impasse procedure to which the dispute shall be
submitted; in the absence of agreement between the parties on this point, the ratter
shall be referred to the City Council.
The fees and expenses, if any, of mediators or of any other impasse procedure,
shall be payable one-half by the City and one -half by the employee organization or employee
organizations.
SECTION 14. Gr IEVANCES
A. A grievance is any dispute concerning the interpretation or application of this
i_esolution or of rules or regulations governin personnel practices or wordng
C onditions, or of the practical consequences of a city rights' decision on wages,
hours and other terms and conditions of er.:ployrnent.
B. Grievances shall be processed in acco.-dance with procedures established by
the City.
SECTION 15. MEIZOr':ANDUIr OF UNDERSTAND-IM
71hen the meeting and conferring process is concluded between the City and a
formally recognized employee organization representing a majority of the employees in an
appropriate unit, all agreed upon hatters shall be incorporated in a written memorandum
of understanding signed by the drily authorized City and majority representatives.
As to those matters within the authority of the City Council, the memorandur.:
of understanding shall be submitted to the City Cowncil for determination.
SECTION 16. PULES AND LEGULATIONS
The City Council may adopt such additional Lules and Regulations as may be
necessary or convenient to implement the provisions of this l esolution and Chapter 10,
Division 4, Title 1 of the Government Code of the State of California (Section 3500, et seq.).
SECTION 17. CONSTRUCTION
A. Nothing in this Resolution shall be conspired to deny any person or er._ployee
the rights granted by Federal and State laws and City Charter provisions.
B. The rights, powers and authority of the • it i Council in all matters, including
the right to maintain any legal action, shall not be modified or restricted by "s

C. Nothing contained in this Resolution shall abrogate any written agreement
between any employee organization and the City in effect on the effective date of
this Resolution. All such agreements shall continue in effect for the duration of
the term specified therein unless modified or rescinded by mutual agreement of
the parties thereto.
D. The provisions of this Resolution are not intended to conflict with the
provisions of Chapter 10, Division 4, Title 1 of the Government Code of the State
of California (Sections 3500, et seq.) as amended in 1968.
SECTION 18. SEPARABILITY
If any provision of this Resolution or the application of such provision to any person
or circumstance, shall be held invalid, the remainder of this Resolution or the application
of such provision to persons or circumstances other than those as to which it is held
invalid, shall not be affected thereby.

A RESOLUTION REQUESTING A n2 -STUDY 01` THE
PROPOSED HIGHWAY ROUTE FOP. HIGHWAY 1 NEAR
THE WESTERLY LIMITS OF THB CITY OF SAN LUIS
Obispo.
WHEREAS, the proposed new route for Highway 1 from its point of diversion near
Camp San Luis Obispo to its junction with Foothill Boulevard and that portion extending
from Foothill Boulevard approximately midway to its junction with Highway 101 appears
acceptable to the City of San Luis Obispo; and
WHEREAS, the City Council has reservations about the portion of the proposed
new route eastward from the mid -point of the section between Foothill Boulevard and
Highway 101.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The California Highway Commission and the State Division of Highways
are hereby requested to re -study the section of the proposed new routing of Highway 1
beginning with a point midway between Foothill Boulevard and Highway 101 and extending
eastward to said Highway 101.
2. The City Clerk is hereby authorized and directed to forward a copy of this
resolution to the California. Highway Commission c/o District Engineer of Division 5.
3. The Mayor is authorized to appear at any scheduled Division of Highway's
hearings relative to the proposed new route for I:ighway 1 to express the objections of
the City Council to the section of the new route which is proposed to be re- studied.
