RESOLUTION NO., 3739 (1978 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING AN EASEMENT ENCROACHMENT AGREEMENT WITH KING RESOURCES. BE IT RESOLVED by the Council of the City of San Luis Obispo as follows. SECTION 1. That this council hereby approves an easement encroachment agreement with King Resources.and the Mayor is authorized to sign on behalf of City. SECTION 2.. That the City Clerk is directed to forward a copy of this resolution together with an executed copy of the agreement to King Resources. ATTEST: ►i"� -- Fitzpatrick Approved as to form: City Attorney Approved as to content: Ct ini r tive ices Director of Public Services R 3739 M EASEMENT ENCROACH14ENT AGREEMENT THIS AGREEMENT entered into this 19 th day of December , 1978, by and between KING RESOURCES, a limited partnership, hereinafter called "partners," and the CITY OF SAN LUIS OBISPO, a municipal corporation, herein- after called "City." WITNESSETH: WHEREAS City is grantee of a Deed of Easement in, on, over, along, and through a parcel of real property owned by partners, to construct and maintain a certain sewer easement. Said Deed of Easement is recorded in the Office of the County Recorder, County of San Luis Obispo, in Volume 635, Page 166. Reference is hereby made to said Deed of Easement for further particulars, and, WHEREAS partners have constructed stairs, landings and portions of a porch encroaching over said easement, which improvements might complicate and increase City cost in maintaining, repairing, or replacing, said sewer line. NOW, THEREFORE, in consideration of mutual promises, covenants, and agreements herein contained, the parties do hereby promise, covenant, and agree one with the other as follows: 1. City hereby grants to partners permission for said improvements to'remain encroaching over said sewer easement. 2. Partners agree that, in the event it is necessary to repair or replace the sewer line, that partners shall, at their own expenses, remove and replace any portion of said encroachments necessary to allow City to have reasonable access to said sewer line, or alternatively to pay any extraordinary City cost in main- taining, repairing or replacing said sewer line where said encroachments are responsible for such increased cost. 3. The promises, covenants, and agreements herein shall constitute covenants running with the land and shall be binding on the heirs, successors and assigns of the parties hereto. That this Council, after consideration of the tentative map of tract 688 and the Planning Commission's recommendations, staff recommendations, and reports thereon, makes theJoIlowirig findings:: 1. The tentative map is consistent with the general plan. 2. The design and improvements of the proposed subdivision are consistent with the .general plan. 3. The site is physically suitable for the type of development proposed. 4. The site is physically suitable for the proposed density of development. 5. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. The design of the subdivision or the type of improvements are not1 ikely to:.cause public health problems. 7. The design of the subdivision or the type of improvements will not conflict with easements, for access through or use of property within the proposed subdivison. SECTION 2. That the approval of the tentative map of tract 688 be subject to the following conditions: 1. All streets to be designed with a traffic index of 5.5. 2. The drainage channel and culverts shall be designed to accommodate a 100 -year storm. Hydrology /hydraulics for storm drain design shall be submitted for approval by the city engineer. Provisions for access by city maintenance crews to existing channel at rear of tract is required to satisfaction of public services department, including all- weather surface if required. A note shall be placed on the map and CC &Rs prepared prohibiting fences or other improvements within drainage easements without prior city approval. 3. Sewer, water and storm drain locations shall be redesigned to minimize their crossings to the approval of the city engineer and utilities engineer superintendent. 4. Existing water well to be abandoned per city /state /county health dept. requirements. 5. Drainage channels shall be designed to accept drainage from adjacent property to the west of the tract. Street tree and PUE easements are required per city standards. 8. Street lighting requirement per city standards. 9. Adequate catch basins shall be provided to pick up drainage within tract to satisfaction of city eng- ineer. 10. Lot 22 shall be dedicated to the city as a neighborhood park. 11. Fire hydrants shall be provided per city fire code. 12. Common driveway easements shall be shown on the final map subject to approval of Community Development Director. Conditions imposed by Airport Land Use Commission 13. Soundproofing to mitigate 45 decibels within the building after completion, 14. Avigation easement over the entire property under their development. 15. Notification to each new tenant, either written or in a lease, and notifica- tion to each new owner of the property that (a) there is an airport in close proximity, (b) the apartments are near the flight path, (c) the apartments are subject to frequent noise from aircraft passing overhead; it is-further recommended that this information be noted on the subdivision map. BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the Council, after consideration of this Minor Subdivision SLO -78 -221 and the staff recommendations and reports thereon, makes the following findings: Plan. 1. The proposed parcel map and design are consistent with the General 2. The site is physically suited for the proposed type and density of development permitted by the PF (Public Facilities) and PO (Professional Office) zones. 3. WHEREAS, a special municipal election was consolidated, with the state -wide general election and held and conducted in the City of San Luis Obispo, County of San Luis Obispo, State of California, on Tuesday, the 7th of November, 1978, as required by law; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law, that voting precincts were properly established, that election officers were appointed, and that in all respects said election was held and conducted and the votes cast thereat were received and canvassed and returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to City of San Luis Obispo Resolution No. 3621 adopted on the 31st day of July, 1978, the Board of Supervisors of the County of San Luis Obispo caused the returns of said election to be canvassed and has certi- fied the results to this City Council, said results are received, attached and made a part hereof as Exhibit "A ". TRACT 608 WHEREAS the subdivider is requesting a six month time extension to obtain approval of a final subdivision map; and WHEREAS the Planning Commission found that the request for time extension is justified and recommends approval; and WHEREAS the Planning Commission determined that Condition #4 of the original conditions of tract map approval should be revised to require the subdivider to install landscaping and.rear yard fencing along certain lots in.the sub- division as subdivision improvements; and WHEREAS the City Council concurs with the Planning Commission recommendation; and WHEREAS the City Council pursuant to Community Development staff recommenda- tion finds that the subdivider should be responsible for undergrounding util- ities on Los Osos Valley Road along the tract boundary; and WHEREAS the City Council finds that Condition No. 3 of the original tract map approval requiring -omission of Lots 56 through 61 should be deleted in that subdivision construction plans show that these lots can be served with gravity sewer service; and WHEREAS the City Council finds that these lots are elevated above Los Osos Valley Road, are very visible from said road, and therefore houses to be built there should be approved by the City Architectural Review Commission. NOW THEREFORE the City Council resolves that Tract 608 is granted a six month time extension to July 5, 1979, subject to the revision of Conditions 3 and 4 and addition of Condition 19 to the original tract map conditions contained in City Council Resolution No. 3363 attached hereto. Conditions 3, 4 and 19 now to read as follows: 3. Lots 56 -61 shall not be padded. House designs shall be approved by the City Architectural Review Commission with particular atten- tion to rear elevation facing Los Osos Valley Road with the ARC having the discretion to require a split level home to minimize rear elevation height. 4. A landscape planting plan shall be submitted and approved by the Planning staff to provide a wind row tree planting scheme for the rear of lots 43 through 55 and north lot line of lot 1. Said landscape plan shall include a fence design for the rear of lots 43 through 55. Said landscaping and fencing shall be installed by the subdivider as part of tract improvements. RESOLUTION NO. 3363 (1977 Series) A RESOLUTION OF THE CITY OF SAN LUIS OBISPO CITY COUNCIL GRANTING APPROVAL OF TENTATIVE TRACT MAP NO: 608, LOCATED ON THE WEST SIDE OF LOS OSOS VALLEY ROAD, NORTH SIDE OF DIABLO DRIVE. WHEREAS the City Council has received a .report from the Planning Commission recommending approval of Tentative Tract Map No. 608, and WHEREAS the City Council has certified the project Environmental Impact Report as being sufficient to comply with CEQA and State Environmental Impact Report Guidelines, and WHEREAS, Environmental Impact Report recommended . mitigation measures have been incorporated into the subdivision design and conditions f approval where feasible, and. WHEREAS the City Council has made. the following findings required by the State Subdivision Map Act: 1. The tract map and design are consistent with the General Plan. 2. The site is physically suited for the proposed type and density of develop- ment permitted by the R -1 zone. 3. The design is not likely to cause substantial environmental damage, or cause serious public health problems. 4. The design of the proposed subdivision will not conflict with public ease- ments for access through, or use of, property within the proposed subdivision. NOW THEREFORE BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: A. That a .variance from minimum lot width standards for Lots 2 through 7, Lots 23 through 27 and Lots 30 through 33 be granted with the determination that: (1) The variance is not a grant of special privilege because of the limitations provided by the unique characteristics of the site in arriving at an acceptable subdivision design. (2) The site in question, because of its unique topography and dimen- sional characteristics, would deprive the property of privileges enjoyed by other properties if the lot width requirements were strictly applied by causing substantially over -sized lots. (3) The variance is not inconsistent with the spirit and intent of the sub - division regulations which.are intended to ensure well designed lot and street patterns and suitably sized lots. B. That Tentative Tract Map No. 608 be granted approval subject to the following conditions: 1.. All of the lots not granted a variance to lot width shall conform to lot size requirements on the final subdivision map. 2. Access rights to Los Osos Valley Road for Lot 1 shall be dedicated to the City. 3. Lots 56 through 61 shall be combined with Lot 1 and a note shall be placed on the final map that Lot 1 is not a buildable site until gravity sewer service is provided. A landscape planting plan shall be submitted and approved by the Planning staff to provide a wind row tree planting scheme for the rear of Lots .43 through 55 and north lot line of Lot 1. Said landscape plan shall include a fence design for the rear of lots 43 through 55 and the tract. CC &R's shall limit fencing along said lot lines to that approved in the landscape plan. 5. A note on the final subdivision map shall indicate that the lots in Tract 608 shall not be padded and that grading on individual lots is not per- mitted except for building foundations, driveways and minor grading for backyard areas. 6. The final map shall contain a note that special building designs are required to compensate for limitations to grading. 7: Where common driveways are shown they shall be noted on the final map as 16 feet wide and centered on common property lines. 8. The subdivider shall prepare a drainage plan suitable to accommodate a 100 year storm which carries storm runoff to an acceptable point of disposal. Said plan shall be approved by the City Engineer and shall include the construction of concrete drainage structures to carry storm runoff across individual lots.. 9. The subdivider shall obtain an easement for the disposal of site drainage across private properties from the property owner(s). 10. A 10 foot easement shall be granted to the City for the drainage culvert across Lot 1. 11. All local streets other than cul-de-sacs shall be designed to a traffic index of 5.5. 12. Overflow relief swales. shall be provided with drainage drop inlets where determined to be necessary by the City Engineer. 13. The final map shall note the Union Oilline and easement in Los Osos Valley Road. 14. The final design of the curve section of Mirada Street shall be approved by the City Engineer. 15. Water and sewer fees shall be paid. 16. 0.84 acre of land shall be dedicated to the City for neighborhood park land. Said land shall contribute to the neighborhood park required for dedication as a part of Tentative Tract 603. 17. Lot 54 shall not be offered for dedication. 18. All cut and fill slopes shall be seeded immediately subsequent to their creation to the satisfaction of the City Engineer. Require Architectural Review Commission approval of all houses to be built in the subdivision because the lots are smaller than otherwise required by virtue of the subdivision being an optional design subdivision with smaller lots and compensating open space dedication; and WHEREAS the City Council concurs with the Planning Commission finding that the time extension is justified but feels that the additional conditions are not appropriate at this time; and WHEREAS the City Council pursuant to staff recommendation finds that the subdivider should be responsible for undergrounding utilities on Los Osos Valley Road along the tract boundary. NOW THEREFORE the City Council resolves as follows: That Tract 603 is granted a six month time extension to July 5, 1979, subject to original tentative tract map conditions as specified in City Council Resolution No. 3362 attached hereto and one additional condition of approval as follows: 1. Subdivider shall underground overhead utility lines on Los Osos Valley Road along the entire frontage of the tract. Responsible for implementing departmental, division and section policies and goals. e. Responsible for channeling information between subordinates and management personnel. f. Responsible for organizing and conducting community meetings in assigned Sector to implement crime prevention, reduction, and resistance tecKniques_wi.th members of the community. g. Responsible for maintaining a continuing awareness of public safety needs in assigned Sector. h. Responsible for planning specific programs and activities designed to suppress crime and criminal conduct using all available departmental and community resources. i. Responsible.for providing counseling, referral and follow -up investigation service to resolve human crises. j.. Responsible for surveying of Sector for potential crime.problems and offering 'reasonable and prudent solutions for the reduction of risks. k. Responsible for attending business; civic, school, neighborhood and other community meetings as necessary to.gather information and maintain an on -going awareness of community problems and concerns. 1. Responsible for gatheri.ng and reporting intelligence informa- tion of possible use in solving or preventing crimes. d. Responsible for resolving conflicts of a potentially violent nature involving a wide variety_of participants, including family members, neighbors, landlords and tenants. merchants and customers and rival youth groups. e. Responsible for providing counseling, referral, and follow -up services to resolve domestic and civil crises and assist in preventing future criminality. f. Responsible for patrolling an assigned.area to provide for quick response to calls for service, facilitate observation of criminal activity -or conditions conducive to criminality, and allow for the gathering of intelligence. g.. Maintaining security for confidential or restricted information. 2. Duties a. Collect fees and .other monies for deposit in the proper account for services rendered. b. Act as guardian of the records of the Police Department. h: Author reports as necessary or as requested. 0. Department Janitor 1. Responsibility a. Responsible for using modern cleaning methods to maintain the interior and exterior of the Police Facility and adjacent parking structure. b. Responsible for the use, care and storage of cleaning materials and equipment. c. Responsible for minor maintenance and repairs of building interior and exterior, and cleaning equipment as.necessary. - 14 - i d. Responsible for maintaining a safe working environment in and around the Police Facility. e. Responsible for developing a maintenance schedule that provides for the needs. of the employees and the public who use the Police Facility. f. Responsible for coordination and purchasing of the necessary supplies to accomplish the functions set forth above. - 15 - III. DUTY A. General Responsibilities On -duty officers of the:Department are responsible for maintenance of public order, the preservation of life and property; suppression of crime, and enforcement of applicable federal; state and local laws and ordinances.' B. Reporting for Duty Employees of'the Department shall be punctual in reporting for duty at the time and place designated by their supervising officer. Any inability to comply with these instructions shall be reported by the employee to the Department.prior to the time set for reporting. . C. Duty Responsibilities Members of the Department are always subject to duty although periodically relieved of its routine performance. While on duty, they shall respond to the lawful orders of superior officers and other com- petent authorities as well as to calls for police assistance or service from citizens. The administrative delegation of the enforcement of certain laws and ordinances to particular units of the Department does not relieve members of other divisions from the responsibility of taking prompt, effective police'action within the scope of those laws and ordinances when the occasion so requires. Those assigned to special duties are not relieved from taking responsible action outside the scope C.. of their specialized function when necessary. D. Off -Duty Reporting Officers off duty shall, upon official notice, report for duty as required. Officers shall report without notification in the event of a major disaster, or any other emergency wherein it would reasonably be expected that the Department would require the additional services of all officers: Sworn officers sha.l.l establish residences within a 20- minute emergency response time--to the .Police Facility prior to successful completion of the initial year period of probationary employment.' E. Off -Duty Service Requirements Officers shall have regular hours assigned to them for active duty and when not so employed shall be considered "off duty." However, for criminal offenses occurring within the City limits or its sphere of influence., "off duty" officers are required to report such offenses and may take appropriate lawful enforcement action. For criminal offenses occurring outside the City limits, off duty officers are only authorized to take official action if they are within the scope of their employment. (See Government Code Section r 815.2.) - 16 - i i C1 F. Physical Fitness for Duty Good physical condition shall be maintained as is consistent with job demands, and employees shall strive to maintain the proper ratio of weight and height, G. Officer Assistance In times of peril, officers shall act together to assist, defend and protect each other from physical harm. Intentional failure to come to the aid and assistance of another officer or officers shall be grounds for disciplinary action. If in doubt as to the propriety or legality of the situation, officers shall first take the required, action, unless such action is clearly in violation of any statute or law. H. Off Duty Arrests Officers shall not make arrests arising out of personal quarrels or those of their family,. except to prevent violence or serious bodily injury in cases where on -duty personnel are,.not available. I. Outside Employment Employees shall report in writing on the proper forms, as required by the City Rules and Regulations' policy on outside employment. Officers shall not accept outside employment as bartenders, ambulance or tow - truck drivers, card dealers or provide services that would .involve a potential conflict of interest with.the stated mission and goals of the Department.. J. Rumors and Gossip Employees shall not engage in rumors, slanderous or malicious talk -about fellow employees or the public. The internal affairs and personalities of the Department and its members shall not be discussed with anyone outside.the Department. K. Improper Use -of Information Employees shall not make known any proposed movements of the Depart- meet without permission of a commanding officer. Employees shall not use police equipment, facilities or files to gain information..for personal use. L. Firearms Registration Officers shall register the firearms they intend to carry on or off duty as provided in the Operations Directives. - 17 - IV. STANDARDS OF CONDUCT A. Rules, Knowledge of Department personnel shall become thoroughly familiar with and abide by all written directives, policies and procedures of the Department. B. Personal and Professional Conduct Private and professional lives shall be conducted in a manner that does not reflect unfavorably upon the individual or the organization or in a manner which would impair job performance, police service or activities. C. Conduct Toward Superior and Subordinate Officers While on duty, superior officers, subordinates and associates shall be treated with respect. In their professional relationships, employees shall establish and maintain a spirit of cooperation, courtesy, and civility. In order to maintain a, professional decorum.in the eyes of the public, on =duty members of the Department shall be addressed by their title or rank when in the public presence. D. Receiving Orders and Conflicting Orders 1. Unlawful Orders No command or supervisory officer shall knowingly issue any order which is in violation of any Iaw or ordinance or departmental rule or regul "ation. 2. Obedience to unlawful orders Obedience to an unlawful order is never a defense for an unlawful act; therefore,,no member or employee is required to obey any order which is contrary to Federal or State law or City Ordinance_ Responsibility for refusal to obey rests with the member. They shall be strictly required to justify their action. 3. Obedience to unjust or improper orders Members or employees who are g.iven.orders they feel to be unjust or contrary to rules and regulations must first obey the order to the best'of their abil "ity and then may proceed to appeal as provided below. 4_ Conflicting orders Upon receipt of an order conflicting with any previous order or instructions, the member affected will advise the.person issuing the second order of this fact. Responsibility for countermanding the original instruction then rests with the individual issuing the second order. If so directed, the Tatter command shall be obeyed first. Orders will b'e.countermanded or conflicting orders will be issued only when reasonably necessary for the good of the Department. - 18 - E. Public, Partiality Toward All citizens shall be accorded equal treatment and protection under law. No employee shall exhibit.-or practice partiality for or against any person because of race,, sex, creed-, position or influence. While on duty, no employee.shall speak discourteously of any nationality, race, religion ' or of ei the ar sex., F. Political Activity Employees shall not.represent their individual political activities as being endorsed by the Police.Department, nor take part in political .activities of any kind while representing the Department or while in uniform. G. Alcohol Unless authorized by a supervisor, no, employee shall drink any alcoholic beverage While on duty. Employees shall not drink any.alcoholic beverage while in uniform r o any part thereof, whether on or off duty. Employees shall not report for duty under.the influence of alcohol/drugs, nor shall they exhibit any indicati.on of having consumed same.. H. Smoking,- Employees of the Department shall not use tobacco when making initial contacts or at any time which would compromise the safety of the individual officer or other person. Employees shall Use good Judgment and common courtesy when using tobacco in the presence or view of citizens. Ii Business Cards Business cards or personal cards which refer to the Department shall be used only in connection with 06 . 1 . ice business, and shall conform with the City approved type. Officers shall 'not inscribe business cards with any, message which purports to exempt the b6arer thereof from the processes of this or ' any other department, or which purports to grant the.bearer. any special privileges. 0. Address and.Telephone-Num-bers Department personnel are required to maintain working telephones in 'their residences. Correct telephone numbers.•and addresses are to be recorded with the Department and if . a change in either is made., it shall be. re= ported in writing I ng to the Chief of police within 24 hours. Addresses and telephone numbers of departmental personnel shall not be given out without the consent of the person involved, unless otherwi,se required by law. SMOM - 20 - K. Use of Department as a Mailing Address - r Employees shall not use the Department as a mailing address for mail or merchandise which is not directly related to their official duties or as an address complying with the motor vehicle registration on licensing provisions. L. Attorneys and Bail Bondsmen On =duty employees shall not post bail for any person arrested; nor shall they recommend a specific attorney or bondsman.', Interested. Persons shall be referred to the yellow pages of the telephone book. M. Contributions --Rewards - _Gratuity Employees shall not solicit or accept, directly or indirectly, any contribution; reward, gift, or anything of value from any citizen; firm or organization.. Should any reward, gratuity, present, or unauthorized compensation come into an employee's possession, it shall be immediately for. - larded to the Chief of,Police; accompanied by a written report outlining all circumstances connected therewith. N. Officers Bearing- The public will often judge the - Police Department on the basis of the bearing and appearance of the individual officers in public view. Each officer's bearing, manner. and deportment shall be maintained . Cy at a high standard of professionalism. Officers shall maintain an alert and attentive attitude toward their work. 0. Deportment Employees, whether on.duty or off duty, shall be governed by the ordinary and reasonable rules of good conduct and behavior, and shall not commit any act tending to bring reproach or di'sc'redit upon them- selves, the department or the City. P. Information Officers shall keep themselves well informed as to departmental matters including rules and regulations, operations directives, special orders, bulletin boards, information, memorandums, etc. - 20 - V. JUDICIAL RESPONSIBILITIES. A.. Civil Actions Employees.shall not institute any civil action arising out of their official duties without first advising the Chief of Police in writing. B. Court Appearance Employees appearing before any court or public hearing shall be dressed either in full uniform or consistent with a professional bearing and courtroom standards. C. Testifying Against the City Any employee subpoened to testify against the City or Police Department in any hearing or trial shall notify the Chief of Police and, when appropriate;.the.District Attorney or City Attorney, in writing, - 21 - VI. VEHICLES AND EQUIPMENT A. All equipment which is the assigned responsibility or under the control of an individual employee shall be clean, in good working order, and conform to Department specifications: Each employee assigned such equipment is responsible for its care and maintenance They shall report promptly any damage, loss, or theft of such equip- ment to the 'Watch Commander who will forward a copy of the. report to the Chief of P, olice. B. Department Vehicles 1. Department vehicles shall not be misued, abused or overextended by Department personnel. Departmental vehicles shall be used for official police business only. 2. Police.vehicle security Unless impossible or- impractical because of duty requirements, employees shall lock the ignition and doors and retain the keys on their person when leaving a department vehicle unattended. C. Police Vehicle .-w Passengers Occupants of a city police vehicle are generally restricted to employees, other law enforcement personnel, prisoners, victims, witnesses, complainants, or others authorized to ride under the guidelines of official Department programs. Patrol officers shall notify the dispatcher when passengers are riding in a police vehicle. - 22 5 I VII. DISCIPLINE A. Discipline Discipline is utilized to maintain the professional standards of the organization. Discipline.is generally defined as training, although it may assume many forms in order to achieve its objectives. In essence, discipline is dispensed in order to improve employee conduct and to maintain adherence to organizational rules and regulations. B. Forms of Discipline 1. Social Training: An educational program directed to an employee which is sponsored and /or endorsed by the Department. 2. Counseling: Advice, admonition, or guidance provided to ensure proper conduct. 3. Reprimand: An official written censure of an employee's conduct. 4, Suspension: A temporary removal from employment with loss of pay for the duration of the suspension. a. By agreement of both the Chief of Police and the employee, one of the following may be taken in lieu of.suspension: (1) Extra duty: An assignment of "extra duty" beyond the employee's regular work schedule. (2) Voluntary surrender of accumulated overtime, vacation time, or pay incentive or differential. 5. Disciplinary Probation: A trial period in which an employee's. performance within the organization is re- evaluated. Disciplinary probation shall not be for more than six conclusive months. Dis- missal may result from unsuccessful performance during this period. 6. Reduction of pay: A withdrawal of salary increments previously granted as. "merit increases ", as provided in the current salary resolutions.. 7. Demotion: A reduction in position from one job classification to another. 8. Dismissal: Termination of employment. 9. Criminal prosecution. C. Causes for Disciplinary Action Causes for disciplinary action against any employee may include, but shall not be limited, to the following: - 23 - 1. Conviction of a felony or misdemeanor under the laws of the State of California:..A plea or verdict of guilty or .a plea of polo contendere is deemed to be a conviction within the meaning of this section.. 2. Intoxication while on duty, 3. Incompetency, inefficiency, inattention, or inexcusable neglect. of duty. 4. Insubordination or willful disobedience of orders. 5. Dishonesty. 6. Unauthorized.or inexcusable absence without leave, or unauthorized use of sick leave.. 7. Discourteous treatment of the public or other employees; 8. Addiction to the use of alcohol, narcotics, or habit - forming drugs. 9. Misuse, abuse, or appropriation..for personal use; of City property, evidence or found property.. 10.. Violation of any of the provisions of the Personnel Rules and Regulations or of any departmental policy, directive or rule and regulation. 11. Violations of the.Vehicle Code. 12, Knowingly making, causing to be made.,or submitting a false statement or report. 13. Malicious, disparaging; or slanderous remarks, writings, etc. directed at another departmental member. D. Departmental Authority-to Discipline Final departmental disciplinary authority and responsibility rests with the Chief of Police. Except for counseling and emergency suspensions, all departmental discipline must be taken or approved by the Chief of Police. Although departmental authority rests with the Chief of Police, all disciplinary actions. involving.suspension, demotion or removal must be approved by the City Administrative Officer. 24 E. Failure to Discipline Failure of a supervisory officer to take proper disciplinary steps when required shall be deemed insubordination and dealt with accordingly, F. Scope of Supervisory Authority Supervisory personnel, other than the Chief of Police, may take the following corrective measures. 1. .Counsel - subordinates. 2. Recommend written reprimand. 3. Invoke emergency.suspension. 4. Make written recommendations for disciplinary measures. G. Emergency Suspension Any supervisor has the authority to impose an emergency suspension effective until the next business day against a member or employee when such action is in the immediate best interest of the Department. H. Emergency Suspension Follow -Up The recipient of an emergency suspension shall report to the office of the.Chief of Police on the next business day unless otherwise directed by competent authority. The command or supervisory officer who imposes or recommended the suspension shall also report to the Chief of Police at the same time. The Department may, from time to time, issue orders and directives not contained in this Manual. New approaches to problem solving growth within the individuals and the organization, advanced technology and new tech- niques of solving people problems are required if we.are to successfully meet the challenges of today and tomorrow. These ever changing condi- tions place new stresses and burdens upon our organization and can only be endured by our department if we have.the necessary character, strength, flexibility -and motivati "onal opportunities designed into our overall or ganizational structure. Most police departments have traditionally been after -the =fact response agencies, reacting to crimes and disorders after they have occurred. We believe that a much more acceptable concept is to develop and build an organi,za= tional structure which will support efforts to take the offensive against such activities by either preventing, suppressing or resisting crime whenever possible by all legal means. This theory stresses that our ef- forts should be directed at minimizing the.impact of crime and its harmful effects on innocent victims:by seeking community involvement, coopera- tion, and support in preventive efforts. Our overall objective should be to firmly establish the fact that "the people are the police and the police are the people." The department has. recognized the value of its often unrecognized, but very effective civilian employees and hopes to "civi'lianize" those re= maining non- hazardous positions. We continue to encourage career growth and opportunity in this vital human resource area. A distinct separation of tasks, duties and responsibilities has been recommended which will allow uniformed personnel-to devote more time to the complex duties for. which they were specifically trained.. Career mobility opportunity has been expanded and employees at all levels can be rotated-through challenging assignments and exposed to a wide variety of new tasks. The results will be increased opportunities, responsibilities and, hopefully, com- mensurate compensation. We have developed positions of Field Services Technicians, Field Training Officers. Investigators, two .levels of Ser- geants, a civilian position of Coordinator and increased the responsibility of Lieutenants to Division Managers. We believe that the challenges of these new duties will result in significant growth of the individuals involved and improve the overall service level provided to the citizens of our community. The proposed plan of reorganization consists of an Office of the Chief, an Operations Bureau commanded by the Captain, and four functional divi- sions. Three divisions each will be commanded by a lieutenant and the fourth by a civilian director. The Chief will continue to retain direct overall responsibility for the administration of the department. We are proposing two levels of supervision in the Sergeant position and, placing all of these positions where they are most needed in Patrol for increased facility and field supervision. This Position will also prepare or assist in the preparation.of assigned administrative research or Program evaluation reports. Operations Oureau The Operations Bureau will combine the functions of the Patrol and In vestigative Divisions. The Bureau Commander will have the rank of Captain and will be responsible for overall administration of line operations. This position wiil-serve .as a staff resource for the Chief in setting department policy and planning and evaluating department operations and will coordinate investigations of claims against the city or the.depart ment. The Bureau is responsible for providing police services which will be delivered by operating divisions, sections and units functioning through- out the community. Operations personnel will deal directly with the problems and impact of crime, traffic, delinquency and service to the public. The Bureau is divided into two divisions and the Bureau Captain will have direct.control over the following two major functions Patrol Division =-This function will be directly commanded by .a Police Lieutenant assigned to administer this division. This proposed plan differs from.the existing organizational arrangement where the role of a lieutenant is to act as a rotating watch commander, or to command the detectives. The Patrol Lieutenant position will be primarily administrative in nature with strong emphasis on such activities as operational problem solving; identification of training needs; develop- ment of operating procedures and directives; knowledgeable -interpreta- tion of department rules, regulations, policies and directives; over - all responsibility.for div p ision ersonnel cooperation, coordination, ( efficiency, effectiveness and the evaluation of programs, personnel `-' and results." The Patrol Lieutenant is also responsible for the coordination of efforts between watches and sectors and the scheduling of supervisors and adequate personnel to each of the respective shifts. This, posi- tion must also disseminate and coordinate media relations relating to crimes, accidents, special newsworthy events and other daily reported activities. This divi'si'on is assigned the primary responsibility for protecting the community from un.lawful acts and other hazards "to public safety. It provides 24 -hour, around- the, -clock patrol of the city,"investiga- tions of all crimes and incidents detected and reported to the police up to the point or nature at which time an investigator is assigned because of time, location, complexity or seriousness of the offense. The tasks of the patrol division include all police functions - - patrol; investigations; traffic enforcement, collision investigation and rr_porting; control and direction of vehicles and pedestrians; vice suppression; contact and counseling with youths; enforcement of all laws and ordinances assigned to the responsibility of the department; first aid and rescuer serving warrants; detection and arrest of offenders.; and preparing appropriate reports for prosecution and other purposes. Patrol Sergeant-11- Each patrol watch or shift will be the responsibility of a Patrol Ser- geant II position. They will work primarily within the police facility, .4 - n coordinating the activihies,..of, public information, records and communica- tions with those of sector patrol personnel, investigators, or technicians C in the field. Other responsibilities will include reviewing all generated reports, intelligence summaries, messages, citizen complaints, developing effective responses to criminal activity and trends, relaying,depart- mental policies, directives, procedures and rules and regulations to sub- ordinates, and identifying and evaluating overall training, discipline and personnel needs of the individuals assigned to the watch. The assignment of the Report Review responsibility to the Sergeant 11 will: (1) insure timely, accurate and properly completed reports; (2) simplify the flow of reports; and (3) assign administrative responsibility for clearances of cases, follow -up activity, and determination of ap- propriate classification. Patrol Sergeant I This position will serve in the capacity of field supervisor. There will always beone ;field supervisor working during any given shift. Sergeant I's will assist, evaluate,.provide on- the -job training toi and coordinate the activities of all watch sector officers and technicians assigned to field duties. Other regular responsibilities include prepara- tion of summary reports on observed criminal intelligence, suspicious circumstances or events, and violations of directives or rules and . regu - Iations occurring during the assigned watch. Each Sergeant I will also have the responsibility for one of the four - geographical patrol sector teams which divide the city. They will main- tain close continuing awareness of criminal activity and other police= related events or problems that occur in their respective sector and will be expected to recommend and implement approved and appropriate neighbor - hoo& supported corrective actions. Sergeant I's will also hold regularly scheduled meetings attended by members of their sector teams, and as necessary with interested and involved members of the community-to dis- cuss any problems or issues related to the delivery of police services. This order.will transfer the currently assigned duties, responsibilities and extra compensation of the Team Leaders to the Sergeant I position. Sector Police Officers will continue to be at the heart of the department's 24 -hour a 'day sector patrol function.. They will have direct and early contact with victims, witnesses and criminal suspects and will be the primary source of information concerning current or potential police problems. Each police officer will York an assigned shift and sector and will report for work at.a time designated by a watch supervisor. All polite officers will be involved in a wide variety of police:- related activities primarily related to their interest, training and motivation., This position will conduct initial and follow -up investigations-of crimes, collisions and incidents, carrying them through to reasonable and logical conclusions in all but the most serious and complex cases that require . investigative assistance. Police officers will maintain order in. conflicts that have potential for violence. As the often first official contact for people who are seeking help or who are in trouble., the police officer is required to coordinate appropriate counseling, referral, or follow -up - 5 - c o . services. Police officers will provide initial first aid and rescues in emergency situations until fire or ambulance personnel are at the scene. They will continue to act as the department's eyes and ears and report on criminal information as well as dangerous hazards to public safety. The Traffic Safety Unit is assigned to the Patrol Division and is responsible • for coordinating all related traffic matters. The functions of this unit include planning traffic safety and enforcement programs, coordinating with the City Traffic Engineer for the purposes of correcting recognized traffic hazards'or deficiencies that cause collisions, and studying the causes and implementing enforcement action at high accident frequency locations. Traffic Safety will also provide the Sector Teams with information on the times and location of collision causing violations by pedestrians and drivers and respond to complaints from the community on related traffic matters to ensure acceptable levels of enforcement. In addition, this unit will supply traffic data; studies and reports as required. Traffic Safety will provide follow -up investigations on felony bit and run collisions and other felony traffic offenses involving fatal or major injury collisions. The unit will review and coordinate accident reports that•require further follow -up investigations as a•result of anti- cipated prosecutions.' Finally, this unit will coordinate the planning, development and support of all traffic safety educational activities. It will establish necessary programs for selecting, training, and supervising adult crossing. guards and coordinate the Junior Traffic Safety Patrol. Police Reserves will operate in accordance with department rules, regulations, procedures, duties and functions. A. This unit will assist and coordinate vice enforcement activities between intelligence, uniformed and investigative units. From time to time it may be necessary to supple - ment this section by the temporary assignment of additional personnel to engage in undercover operations. Clerical - Clerical personnel,assigned to this Division will perform tasks for the Operations Bureau Captain, Patrol and Investigative Lieutenants and for personnel assigned by the Operations Captain. Supervision of clerical personnel will be carried out by the Operations Commander. The Technical_ Services Division 'is a newly created function which will be supervised by a Civilian Coordinator who will primarily have administrative responsibility for public information, and records, communications, identi- fication, property and evidence control, budget and fiscal management and facility and inventory maintenance. The Director .will also perform a staff support function for the Chief by representing the Department at selected meetings. This position will replace one of the four currently authorized police Lieutenants. The Technical Services Coordinator will conduct internal program evaluation to assess effectiveness of record and communications functions and recommend any needed improvements, prepare monthly statistical analyses and reports and oversee the preparation and administration of the Department budget. This position will also process Department fiscal. claims, maintain inventory control on equipment and perform related fiscal duties., This division groups logistical activities which are technical in nature, non- administrative,.and in direct support of line units to assist in accomplishing police tasks and services. These activities include service to the public at the front counter and by telephone. Technical Services supports the operational arm of the Department in achieving the primary objectives of service. Every task performed and each service rendered by the components of this division must have as a realistic objective, the enhancement.of the efficiency of the operational line units. . The Public Information and Records Section maintains departmental operating records Offenses, Arrests, Incident, Collisions, Alpha -Index and so forth), .and exercises control over all reporting units to insure timely submission of reports in proper form.. Work performed by this section should be re- arranged to place each process at a single desk to centralize responsibility and productivity for each clerical function. Report reproduction, information collection, storage and retrieval are also assigned to this section. Additionally, personnel from this section will assist the public at the front counter and handle requests for information on the telephone. y'- The Communications Section will be shif,ted.,from its present location to the newly approved centralized fire and police dispatch center located in the \. basement of the police facility. Maximum cross training for all dispatching functions will be conducted by "appropriate fire and police personnel to develop, maintain and ensure high standards of performance and service from all Communications Section personnel. This function will closely coordinate its activities with these of fire and police information and records systems to expedite the information needs of fire suppression and sector patrol units and personnel: Employees assigned to this section will work shifts determined by public safety needs with each shift consisting of at least two dispatchers at all times. The Communications Section will receive information amd reports of crimes and fires from the public and other agencies and assign appropriate units and personnel to the scene. On duty personnel will continue to monitor and channel information to field units. This section also generally controls, the immediate deployment of personnel and equipment subject to command authority in emergency or unusual situations. The Identification, Property and Evidence Control Section currently. is staffed by a police officer, but the position of civilian evidence technician has been The Facility i,b intenance Section will be responsible for building maintenance cleaning, safety, and other miscellaneous tasks and duties associated with the interior and exterior of the building and its environment. This position will supervise, coordinate and review necessary activities to accomplish administrative functions,.such as personnel management, research, training, public information and other related management functions. The Administrative Lieutenant will review and report on professional Literature to the Chief and department staff and prepare appropriate plans to enhance department effectives in the above- mentioned areas. The technician will assist in crime scene preservation, gather and examine physical evidence,, provide crime scene sketching, charting and photography, search for latent prints and perform other examinations to assist in ,preparing cases for successful prosecution. This section will also-be responsible for processing, (( custody and return of non - department owned property and evidence, destruction of contraband and safety of lost and found property. The Field Services Technicians will conduct an inventory, maintain and dis- tribute department -owned supplies, equipment and property and ensure the proper maintenance of all department vehicles. When not engaged in these" specific tasks, F.S.T.'s will respond to calls for services involving non- hazardous incidents. Examples of duties will include impounding abandoned vehicles, picking up found or Lost property, assisting persons with problems by counseling or referrals, serving subpoenas, and directing traffic at accident scenes. In certain types of incidents, F.S.T.'s will assume some of the burdens of police officers by being report takers for cold petty theft cases, malicious mischief without suspects, ,reported health or safety hazards, minor non - moving vehicle code violations and other types of non - hazardous services encountered during each shift. BE IT RESOLVED by the City of San Luis Obispo as follows: SECTION 1. That this Council, after consideration of the tentative map of Minor Subdivision No. 78 -154 and the Planning Commission's recommendations, staff recommendations, and reports thereon, makes the following findings: (1) The proposed parcel map and design are consistent with the general plan. (2) The site is physically suited for the proposed type and density of develop- ment which is permitted by the M zone. The lines and grades for all of said improvements shall be establshed by the Subdivider in accordance with said approved plans and specifications. The Subdivider a;rees that the work of installing,the above improvements shall begin within thirty (30 ) days from the date of recording of the final map, and, that the work shall be completed within eighteen. (18) months of said recording date, unless an extension has been granted by the City Council, provided that if completion of said work is delayed by acts of God or strikes, the Subdivider shall have an additional period of time equivalent to such period of delay in which to complete such work. Any extension of time hereunder shall not operate to release the surety on the Improvement Security filed pursuant to this agreement. In this connection, the surety waives the provisions of Section 2819 of the Civil Code of the State of California. The Subdivider does also agree to comply with the following conditions establi- shed by the Planning Commission and /or the City Council. 1) Smoke detectors be installed per City code requirements. 2) Repair of street frontage improvements to the satisfaction of Public Services. 3) Correction of drainage deficiencies. 4) Payment of construction tax of $150.00 per unit. (64 units — total of $9,600.00) As to public lands or section property included within said Subdivision, if any, for the restoration of lost section corners and for retracement of Section lines, the method followed shall be in accord with the instructions set forth in the "Manual of Instructions" for Survey of Public Lands of the United States, published by the Commissioner of General Land Office, Department of Interior, Washington, D.C. -2- The Subdivider hereoy attaches hereto, and as an iriLL�arai part hereof, and as security for the performance of this agreement, (instrument of credit /bond) approved by and in favor of the City of San Luis Obispo, and conditional upon the faithful performance of this agreement, which said (instrument of credit /bond) is in the amount of $ 17,000 and which is in the amount of the estimated cost of said improvements. Subdivider agrees to remedy any defects in the improvements arising from faulty workmanship or materials or defective construction of said improvements occurring within twelve (12) months after acceptance thereof. In accordance with Section 11612.1 (c) of the Business and Professions Code of the State of California, upon final completion and acceptance of the work, City will release all but 100 of the improvement security, that amount being deemed sufficient to guarantee faithful performance by the Subdivider of his obligation to remedy any defects in the improve- ments arising within a period "of one year following the completion and acceptance thereof against any defective work or labor done, or defective materials furnished, in the performance of this agreement. Completion of the work shall be deemed to have occurred on the date as of which the City Council shall, by resolution duly passed and adopted, accept said improve- ments according to said plans and specifications, and any approved modifications thereto. Neither periodic or progress inspections or approvals shall bind the City to accept said improvements or waive any defects in the same or any breach of this agreement. If the Subdivider fails to complete the work within the prescribed time, then in that event, the Subdivider agrees that City may, at its option, declare the bond, instrument of credit, or cash deposit, which has been posted by Subdivider, to guarantee faithful performance,.forefeited and utilize the proceeds to complete said improvements, or City may complete said improvements and recover the full cost and expense thereof from the Subdivider or his surety. The Subdivider agrees to deposit with the City a labor and material bond in the amount of 500 of the above described subdivision improvements in accordance with State law. Said Subdivider shall deposit with the City the sum of $ 510.00 from which deposit the City will pay the salary and expenses of an inspector or inspectors to inspect installation.of said subdivision improvements and certify that they have been completed in accordance with the plans and specifications. Any unexpended monies will be returned to the Subdivider. In the event the inspection fees exceed the sum of $ 510.00 , the difference is to be paid by the City of San Luis Obispo. The City reserves the sole discretion in determining -3- f the amounts to be paid for salary and expenses of said inspector or inspectors.
